I would remind President Biden that we have defeated him in litigation before and are ready to do so again,\u201d Noem added, referencing her state\u2019s lawsuit against the Occupational Safety and Health Administration (OSHA)\u00a0vaccine mandate, which the Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a244_hgci.pdf\">struck down<\/a> in January.<\/p>\n<p>\u201cMr. President,\u201d the governor warned, \u201cwe\u2019ll see you in court.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">South Dakota will stand up to defend freedom. <a href=\"https:\/\/twitter.com\/JoeBiden?ref_src=twsrc%5Etfw\">@JoeBiden<\/a> see you in court.<\/p>\n<p>\u2014 Governor Kristi Noem (@govkristinoem) <a href=\"https:\/\/twitter.com\/govkristinoem\/status\/1436060414970892288?ref_src=twsrc%5Etfw\">September 9, 2021<\/a><\/p>\n<p>Noem\u2019s warning draws on a promise from the U.S. Department of Agriculture\u2019s (USDA) Food and Nutrition Service (FNS) that it will interpret \u201cthe prohibition on discrimination based on sex found in Title IX of the Education Amendments of 1972 \u2026 to include discrimination based on sexual orientation and gender identity.\u201d<\/p>\n<p>This would mean that schools that do not allow biological males in women\u2019s sports, women\u2019s locker rooms, or women\u2019s restrooms would be considered to be discriminating against students based on their sexual orientation or gender identity.<\/p>\n<p>\u201cUnder the leadership of the Biden-Harris Administration, USDA and FNS are issuing this interpretation to help ensure its programs are open, accessible and help promote food and nutrition security, regardless of demographics,\u201d the USDA said.<\/p>\n<p>\u201cThis action is in line with President Biden\u2019s\u00a0<a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/20\/executive-order-preventing-and-combating-discrimination-on-basis-of-gender-identity-or-sexual-orientation\/\">Executive Order on Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation<\/a>, and is consistent with the Supreme Court\u2019s decision in\u00a0<em>Bostock v. Clayton County<\/em>, in which the Court held that the prohibition on sex discrimination under Title VII of the Civil Rights Act of 1964 extends to discrimination based on sexual orientation and gender identity,\u201d the department said in a release.<\/p>\n<p>State and local agencies, as well as program operators and sponsors receiving funds from FNS will be required to \u201cinvestigate allegations of discrimination based on gender identity or sexual orientation,\u201d the USDA said, and these organizations must update their policies and signage to \u201cinclude prohibitions against discrimination based on gender identity and sexual orientation.\u201d<\/p>\n<p>The department did not immediately respond to a request for comment from The Daily Wire.<\/p>\n<p>Secretary of Agriculture Tom Vilsack said in a statement that the USDA \u201cis\u00a0committed to administering all its programs with equity and fairness, and serving those in need with the highest dignity.\u201d<\/p>\n<p>\u201cA key step in advancing these principles is rooting out discrimination in any form \u2013 including discrimination based on sexual orientation and gender identity,\u201d Vilsack said. \u201cAt the same time, we must recognize the vulnerability of the LGBTQI+ communities and provide them with an avenue to grieve any discrimination they face. We hope that by standing firm against these inequities we will help bring about much-needed change.\u201d<\/p>\n<p>The Daily Wire first\u00a0<a href=\"https:\/\/www.tuberville.senate.gov\/wp-content\/uploads\/Sen.-Tuberville-Title-IX-Letter-to-ED-Sec.-Cardona-5.31.22.pdf\">obtained a May 31 letter <\/a>sent by Republican Alabama Sen.
