Clayton County<\/em><\/a>\u00a0and that these guidance documents were only summaries, not binding rules,\u201d <a href=\"https:\/\/thetexan.news\/judge-rules-texas-may-continue-lawsuit-over-federal-requirement-that-employers-accommodate-transgender-pronouns-facility-use\/\">The Texan<\/a> reported.<\/p>\n<p>\u201cThe Biden Administration\u2019s constant attack on Texas values will not be met without a fight,\u201d Republican Attorney General Ken Paxton <a href=\"https:\/\/texasattorneygeneral.gov\/news\/releases\/ag-paxton-victorious-again-court-green-lights-texas-suit-against-biden-administration\">said<\/a>. \u201cWe stand by the law of the land and will not bend to Biden\u2019s empty threats that twist the U.S. Constitution. I will protect our children from life-altering procedures that put their lives at risk. Texans will not be bullied to adopt the Biden Administration\u2019s sexual ideology. I look forward to our day in court.\u201d<\/p>\n<p>The Biden Administration also argued that Texas\u2019 lawsuit was premature because President Biden\u2019s threatened enforcement actions had not yet been implemented. But Judge Matthew Kacsmaryk sided with Texas.<\/p>\n<p>\u201cThe March 2 Guidance \u2018does not simply repeat the relevant provisions\u2019 of the statutes and regulations it relies on,\u201d Kacsmaryk <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/executive-management\/20220526_53%20ORDER%20Granting%20and%20Denying%20in%20Part%20Ds&#039;%20MTD.Judge%20Kacsmaryk.pdf\">wrote<\/a>. \u201cInstead, the March 2 Guidance \u2018purports to interpret authoritatively\u2019 those statutory and regulatory requirements. The March 2 Guidance states: \u2018Section 1557 protects the right of individuals to access the health programs and activities of recipients of federal financial assistance without facing discrimination on the basis of sex, which includes discrimination on the basis of gender identity.\u2019\u201d<\/p>\n<p>\u201cTherefore \u2014 according to HHS \u2014 \u2018[c]ategorically refusing to provide treatment to an individual based on their gender identity <em>is <\/em>prohibited discrimination,\u2019 and \u2018federally-funded covered entities restricting an individual\u2019s ability to receive medically necessary care, including gender-affirming care, from their health care provider solely on the basis of their sex assigned at birth or gender identity <em>likely violates <\/em>Section 1557,\u2019\u201d he noted.<\/p>\n<p>\u201cBut Section 1557 does not include the terms \u2018sex\u2019 or \u2018gender identity I,\u201d he explained. \u201cInstead, Section 1557 expressly incorporates Title IX, which prohibits discrimination \u2018on the basis of sex.\u2019 Based on the ordinary public meaning conveyed when Congress enacted Title IX and \u201cjudicially accepted principles of linguistics in reading the whole \u2014 including compositionality . . . .
