The court added that the term fish shouldn\u2019t be confined to \u201caquatic\u201d invertebrates under the CESA.<\/p>\n<p>\u201cWe acknowledge the scope of the definition is ambiguous but also recognize we are not interpreting the definition on a blank slate,\u201d the appellate court\u2019s ruling <a href=\"https:\/\/www.courts.ca.gov\/opinions\/documents\/C093542.PDF#page=2\" target=\"_blank\" rel=\"noopener noreferrer\">stated<\/a>. \u201cThe legislative history supports the liberal interpretation of the Act (the lens through which we are required to construe the Act) that the Commission may list any invertebrate as an endangered or threatened species.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2022\/04\/14\/joe-biden-ethanol-gasoline-food-prices-inflation\/\">(RELATED: \u2018Consumers Lose\u2019: Biden\u2019s Ethanol Gambit Will Send Food Prices Soaring, Critics Say)<\/a><\/strong><\/p>\n<p>\u201cFurthermore, limiting the term to aquatic would require a restrictive rather than liberal interpretation of the Act, which is also directly at odds with our duty to liberally construe the remedial statutes contained therein,\u201d the panel <a href=\"https:\/\/www.courts.ca.gov\/opinions\/documents\/C093542.PDF#page=34\">continued<\/a>. \u201cWe thus decline to apply the statutory interpretation canon here.\u201d<\/p>\n<div id=\"attachment_7441270\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7441270\" class=\"wp-caption-text\">Farm laborers line up to get lunch in April 2020 in Greenfield, California. (Brent Stirton\/Getty Images)<\/p>\n<\/div>\n<p>In 2019, the California Fish and Game Commission (FGC) <a href=\"https:\/\/pacificnutproducer.com\/2021\/02\/22\/ca-fish-game-commission-decision-on-appealing-the-courts-decision-on-enlisting-bumble-bees-under-the-ca-endangered-species-act\/\">voted 3-1<\/a> in favor of <a href=\"https:\/\/nrm.dfg.ca.gov\/FileHandler.ashx?DocumentID=161902&#038;inline\" target=\"_blank\" rel=\"noopener noreferrer\">listing<\/a> the Crotch, Franklin\u2019s, Suckley cuckoo and western bumble bees as endangered species, marking the first time insect species were given such protection. The Almond Alliance of California, which represents the state\u2019s almond industry, formed a coalition of various agriculture groups opposing the classification and arguing it would impose a massive financial burden on nut growers who use pesticides, the Pacific Nut Producer <a href=\"https:\/\/pacificnutproducer.com\/2021\/02\/22\/ca-fish-game-commission-decision-on-appealing-the-courts-decision-on-enlisting-bumble-bees-under-the-ca-endangered-species-act\/\">reported<\/a>.<\/p>\n<p>The CESA statute <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=FGC&#038;division=3.&#038;title=&#038;part=&#038;chapter=1.5.&#038;article=1\" target=\"_blank\" rel=\"noopener noreferrer\">lists<\/a> \u201cnative species or subspecies of a bird, mammal, fish, amphibian, reptile, or plant\u201d as candidates for protection.<\/p>\n<p>The appellate court\u2019s ruling Tuesday overturned a 2020 lower court <a href=\"https:\/\/www.documentcloud.org\/documents\/22046765-bees-are-fish-district-court-opinion\">decision<\/a> siding with the Almond Alliance of California.<\/p>\n<p>The Almond Alliance of California and FGC didn\u2019t respond to requests for comment from The Daily Caller News Foundation.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
