The narrow margin prompted the Pennsylvania Department of State to <a href=\"https:\/\/www.dailywire.com\/news\/pa-republicans-wont-know-who-their-senate-nominee-is-for-at-least-another-two-weeks-commonwealth-says\">order a recount<\/a> in accordance with commonwealth law. The McCormick campaign has filed suit to make county election boards tally undated mail-in ballots.<\/p>\n<p>Alito, who is in charge of emergency requests for Pennsylvania, issued an administrative stay for the counting of certain ballots, according to <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/05\/31\/supreme-court-pennsylvania-undated-ballots-alito\/\">The Washington Post<\/a>. The Supreme Court is weighing the U.S. Court of Appeals for the Third Circuit\u2019s ruling that undated ballots received on time ought to be counted.<\/p>\n<p>\u201cThe state\u2019s requirement is that mail-ballot voters \u2018fill out, date and sign\u2019 a form declaration on the outer envelope used to return ballots,\u201d the Post explained. \u201cBut the federal judges said not counting the votes of those who did not provide a date violated federal civil rights law because the requirement was immaterial to the voters\u2019 qualifications. There are no indications of fraud, the ballots were received by the state\u2019s deadline and election officials noted they would have counted ballots with the wrong date but not those with no dates at all, the judges said.\u201d<\/p>\n<p>While the McCormick campaign supports the counting of undated ballots, the Oz campaign \u2014 with the <a href=\"https:\/\/www.dailywire.com\/news\/gop-sides-with-oz-in-pennsylvania-recount-election-laws-are-meant-to-be-followed\">backing<\/a> of the Republican National Committee (RNC) \u2014 argues that the ballots should remain uncounted. Indeed, the Oz campaign has claimed that McCormick is \u201cfollowing the Democrats\u2019 playbook\u201d and eroding voters\u2019 confidence in the election.<\/p>\n<p>Oz called himself the \u201cpresumptive Republican nominee\u201d at the end of last week. \u201cIt\u2019s time to unite. I want to hear your ideas and make this country\u2019s future as bright as it has ever been,\u201d Oz said in a social media video. \u201cWith more freedom, less big government, and by empowering our people, America\u2019s light will shine brighter than ever.\u201d<\/p>\n<p>McCormick\u2019s lawsuit asserted that the county election boards are \u201cdisenfranchising\u201d voters who did not date their ballots. The suit, therefore, demands that the boards count ballots \u201cthat were returned on time but that lack a handwritten date on the exterior mailing envelope.\u201d<\/p>\n<p>Both campaigns <a href=\"https:\/\/www.dailywire.com\/news\/pennsylvania-court-hears-arguments-that-could-decide-oz-mccormick-contest\">presented their cases<\/a> to the Pennsylvania Commonwealth Court on Tuesday. Although the court has sided with the Oz campaign\u2019s position in similar past cases, \u201cit will be interesting to see whether the Third Circuit\u2019s opposite stance on the issue influences its thinking going forward,\u201d the <a href=\"https:\/\/www.inquirer.com\/politics\/election\/live\/pa-republican-senate-primary-recount-results-mehmet-oz-david-mccormick-20220531.html\">Philadelphia Inquirer<\/a> observed.<\/p>\n<p>Oz or McCormick will face Pennsylvania Lt. Gov. John Fetterman in November. Fetterman carried every county and <a href=\"https:\/\/www.dailywire.com\/news\/pennsylvania-democrats-pick-basketball-shorts-and-hoodie-clad-john-fetterman-over-rising-star-conor-lamb-in-senate-primary\">defeated rising star<\/a> U.S. Congressman Conor Lamb in the Democratic Senate primary.<\/p>\n<p>Nationwide <a href=\"https:\/\/www.dailywire.com\/news\/new-polls-signal-major-problems-for-democrats-ahead-of-2022-midterm-elections\">midterm polling<\/a> has so far indicated that Democrats face an uphill battle to keep and gain representation in Congress. The November election will determine the successor of Sen. Pat Toomey, a Republican who is retiring after two terms in the Senate.
