The report noted that \u201cthe rate of unruly air passenger incidents fell to its lowest level since late 2020 soon after the judge\u2019s mask mandate ruling.\u201d<\/p>\n<p>\u201cThe findings in the CDC order likewise provide ample support for the agency\u2019s determination that there was good cause to make the order effective without delay,\u201d the DOJ <a href=\"https:\/\/twitter.com\/kerpen\/status\/1531777712473399300\">said<\/a> in its appeal.\u00a0\u201cNone of the district court\u2019s quarrels with the CDC order comes close to showing that the CDC has acted outside the \u2018zone of reasonableness.\u2019\u201d<\/p>\n<p>U.S. District Judge Kathryn Kimball Mizelle in Tampa <a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-judge-in-florida-voids-bidens-national-mask-mandate-at-airports-planes-public-transit\">terminated<\/a>\u00a0the administration\u2019s mandate in mid-April, ruling that the mandate \u201cexceeded the CDC\u2019s statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions.\u201d<\/p>\n<p>The ruling said that Court declared the mandate to be unlawful because \u201cour system does not permit agencies to act unlawfully even in pursuit of desirable ends.\u201d<\/p>\n<p>\u201cThe Court DECLARES UNLAWFUL and VACATES the Mask Mandate, remanding it to the CDC for further proceedings consistent with this order,\u201d Mizelle ordered. \u201cThe Court directs the Clerk to TERMINATE President Joseph R. Biden, Jr., as a Defendant to this action, to ENTER final judgment in favor of Plaintiffs as prescribed in this order, and to CLOSE this case.\u201d<\/p>\n<p>The move by the Biden administration comes as Biden has failed to stop the COVID-19 pandemic like he promised he would while campaigning to be president.<\/p>\n<p>More Americans have died under Biden\u2019s leadership than died under the previous administration despite the fact that Biden had multiple highly effective vaccines at the start of his presidency to fight the pandemic.<\/p>\n<p>The administration\u2019s push to have mask mandates again on airplanes comes after The New York Times called into question the efficacy of mask mandates in a report published this week.<\/p>\n<p>\u201cIn U.S. cities where mask use has been more common, Covid has spread at a similar rate as in mask-resistant cities,\u201d The New York Times <a href=\"https:\/\/www.nytimes.com\/2022\/05\/31\/briefing\/masks-mandates-us-covid.html\">reported<\/a>. \u201cMask mandates in schools also seem to have done little to reduce the spread.
