The NRA&nbsp;<\/span><a href=\"https:\/\/freebeacon.com\/courts\/inside-the-nras-strategy-to-escape-disaster\/\"><span data-contrast=\"none\">believes<\/span><\/a><span data-contrast=\"auto\">&nbsp;the bankruptcy filing would require James to petition the bankruptcy court\u2014in addition to the New York state court she is suing the group in\u2014if she wants to seize the group&#8217;s assets. The removal of bankruptcy protection would likely require the group to rethink its entire legal strategy.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">NRA lawyer William Brewer said the move by James was &#8220;another transparent move in a partisan crusade to shut down the NRA.&#8221; He pointed&nbsp;to James calling the NRA&nbsp;a &#8220;terrorist organization&#8221; during her campaign for office as evidence of her bias against the group.&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">&#8220;It is no surprise she now objects to the NRA&#8217;s plan to avail itself of the benefits of Chapter 11\u2014for its members and all who support its Second Amendment advocacy,&#8221; Brewer said.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">James called the NRA&#8217;s <a href=\"https:\/\/freebeacon.com\/policy\/nra-flees-new-york-for-texas\/\">attempt to move to Texas<\/a> &#8220;extraordinary&#8221; in her filing and said the group &#8220;has decided that it can cross state borders with its assets and open up in a different jurisdiction to evade law enforcement action&#8221; in New York. She noted the group, which reported&nbsp;<\/span><a href=\"https:\/\/freebeacon.com\/guns\/nra-reveals-assets-from-charlton-heston-statue-to-range-rover-in-latest-bankruptcy-filing\/\"><span data-contrast=\"none\">its assets were more than double its liabilities<\/span><\/a><span data-contrast=\"auto\">&nbsp;in a filing on Monday, claims to be solvent and accused it of using bankruptcy simply &#8220;to avoid regulation in the state where [it] is chartered and subject to oversight.&#8221;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">Brewer disputed her claims and said the group looks forward to its day in court.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">&#8220;Attorney General James claims that Chapter 11 is an attempt to \u2018end run&#8217; litigation between her office and the NRA. That is false,&#8221; Brewer said. &#8220;As the Association has said repeatedly, it welcomes the opportunity to litigate these contrived claims and the motives which led to their filing.&#8221;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">If the case is not thrown out, James asked the court to remove the NRA&#8217;s&nbsp;leadership&nbsp;and appoint a trustee to oversee the group during bankruptcy.
