She faces up to 20 years in prison and a $250,000 fine plus restitution on each count and is set to be sentenced in September.<\/p>\n<p>A new court filing, however, asserts that Holmes was not convicted \u201cbeyond a reasonable doubt,\u201d <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-05-28\/elizabeth-holmes-urges-judge-to-overturn-verdict-and-acquit-her\">according<\/a> to Bloomberg.<\/p>\n<p>\u201cBecause no rational juror could have found the elements of wire fraud and conspiracy to commit wire fraud beyond a reasonable doubt on this record, the Court should grant Ms. Holmes\u2019 motion for judgment of acquittal,\u201d Holmes\u2019 lawyers said.<\/p>\n<p>The filing also argued that a \u201cconspiratorial agreement\u201d between Holmes and Ramesh \u201cSunny\u201d Balwani \u2014 an ex-boyfriend and former Theranos executive \u2014 to defraud investors was never proven. Balwani\u2019s\u00a0<a href=\"https:\/\/www.nbcbayarea.com\/news\/local\/sunny-balwani-trial-postponed-until-june-7-court\/2902339\/\">trial<\/a>\u00a0is set to begin on June 7.<\/p>\n<p>Holmes <a href=\"https:\/\/www.dailywire.com\/news\/how-did-elizabeth-holmes-build-her-fraudulent-biomedical-empire\">rose to Silicon Valley stardom<\/a> by deceiving investors into thinking her company\u2019s portable blood analyzer could \u201cconduct comprehensive blood tests\u201d from no more than a few \u201cfinger drops of blood.\u201d Before her would-be empire collapsed, Holmes managed to secure a $9 billion valuation for Theranos. With a $4.5 billion net worth of her own, she once topped Forbes\u2019 list of \u201cAmerica\u2019s Richest Self-Made Women.\u201d<\/p>\n<p>Holmes managed to attract several prominent political and business leaders to back her firm \u2014 including former Secretary of State George Shultz and former Defense Secretary James Mattis. Holmes also had close ties to the Clinton family and hosted a fundraiser for Hillary Clinton in 2016.<\/p>\n<p>Holmes\u2019 trial <a href=\"https:\/\/www.dailywire.com\/news\/elizabeth-holmes-testimony-everyones-fault-but-hers\">lasted<\/a> for three months and saw over 30 witnesses testify. Her legal team has argued that \u201cshe was merely a young, na\u00efve, ambitious founder who relied too much on others who gave her bad advice\u201d and claimed she lacked experience, according to <a href=\"https:\/\/www.nytimes.com\/live\/2021\/11\/19\/technology\/elizabeth-holmes-theranos-trial?campaign_id=9&#038;emc=edit_nn_20211121&#038;instance_id=45964&#038;nl=the-morning&#038;regi_id=168931662&#038;segment_id=75001&#038;te=1&#038;user_id=3197b7108b8b361e088b72b939e051d0\">The New York Times<\/a>. Holmes also attempted to accuse Balwani of abuse; however, the couples\u2019 text messages seemed to\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/texts-between-theranos-founder-elizabeth-holmes-and-ex-boyfriend-cast-doubt-on-her-abuse-claims\">depict a loving relationship<\/a>.<\/p>\n<p>Former Wall Street Journal investigative reporter John Carreyrou brought many of Theranos\u2019 fraudulent practices to light with a series of articles that began in 2015. Carreyrou wrote in his 2018 book \u201c<a href=\"https:\/\/www.amazon.com\/Bad-Blood-Secrets-Silicon-Startup\/dp\/152473165X\">Bad Blood: Secrets and Lies in a Silicon Valley Startup<\/a>\u201d that Holmes was eventually unable to continue channeling Silicon Valley\u2019s \u201cfake-it-until-you-make-it\u201d culture.<\/p>\n<p>\u201cA sociopath is often described as someone with little or no conscience,\u201d Carreyrou said in his epilogue. \u201cI\u2019ll leave it to the psychologists to decide whether Holmes fits the clinical profile, but there\u2019s no question that her moral compass is badly askew.\u201d<\/p>\n<p>\u201cI\u2019m fairly certain she didn\u2019t initially set out to defraud investors and put patients in harm\u2019s way when she dropped out of Stanford,\u201d he continued. \u201cBut in her all-consuming quest to be the second coming of Steve Jobs amid the gold rush of the \u2018unicorn\u2019 boom, there came a point when she stopped listening to sound advice and began to cut corners. Her ambition was voracious and it brooked no interference.
