The recount marks the seventh since Pennsylvania enacted its mandatory recount law in 2004.<\/p>\n<p>Oz currently has 419,365 votes, while McCormick has 418,463. Conservative commentator Kathy Barnette \u2014 whose campaign surged in the final days of the race \u2014 earned 331,398 votes.<\/p>\n<p>It appears, however, that Pennsylvania Republicans will not identify their nominee for at least another two weeks.<\/p>\n<p>\u201cCounties may begin their recount as early as Friday but must begin no later than June 1,\u201d the Pennsylvania government said. \u201cThey must complete the recount by noon on June 7, and they must submit the recount results to the Department of State by noon on June 8.\u201d<\/p>\n<p>Earlier this week, McCormick <a href=\"https:\/\/www.dailywire.com\/news\/disenfranchising-these-voters-mccormick-sues-pennsylvania-election-boards-to-count-undated-ballots\">sued in Pennsylvania court<\/a> to make county election boards tally undated mail-in ballots.<\/p>\n<p>\u201cThese ballots were indisputably submitted on time \u2014 they were date-stamped upon receipt \u2014 and no fraud or irregularity has been alleged,\u201d McCormick\u2019s lawsuit argued. \u201cThe Boards\u2019 only basis for disenfranchising these voters is a technical error that is immaterial under both state and federal law.\u201d<\/p>\n<p>The lawsuit \u2014 which follows a Friday <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/23\/mccormick-oz-pennsylvania-senate-ballot-fight-court-00034570\">federal court decision<\/a> declaring that undated ballots in a 2021 Pennsylvania county judgeship election <a href=\"https:\/\/www.mcall.com\/news\/pennsylvania\/mc-nws-pa-lehigh-mail-ballot-dates-ruling-20220520-mbbqalcjsrgi5owxj5psgin6hu-story.html\">must be counted<\/a> \u2014 therefore demands that the election boards count ballots \u201cthat were returned on time but that lack a handwritten date on the exterior mailing envelope.\u201d<\/p>\n<p>McCormick\u2019s suit comes days after the Oz campaign alleged that his rival is \u201cfollowing the Democrats\u2019 playbook\u201d and eroding voters\u2019 confidence in election integrity.<\/p>\n<p>\u201cDavid McCormick has been a formidable opponent, but it is becoming obvious that he is likely going to come up short to Dr. Mehmet Oz,\u201d campaign manager Casey Contres said on Saturday. \u201cUnfortunately, the McCormick legal team is following the Democrats\u2019 playbook, a tactic that could have long-term harmful consequences for elections in the Commonwealth of Pennsylvania.\u201d<\/p>\n<p>\u201cIt is a clear contrast between Dr. Mehmet Oz\u2019s efforts to secure America\u2019s democratic process and John Fetterman, the Democratic nominee, who doesn\u2019t even want to require Pennsylvanians to show ID to vote,\u201d Contres argued. \u201cAs a party, and as a people, Dr. Mehmet Oz believes we must restore faith in our government institutions.\u201d<\/p>\n<p>Last week, former President Donald Trump prompted Oz \u2014 his endorsed candidate \u2014 to claim the win. \u201cDr. Oz should declare victory. It makes it much harder for them to cheat with the ballots that they \u2018just happened to find,\u2019\u201d Trump <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/18\/trump-dr-oz-should-declare-victory-pennsylvania-00033420\">claimed<\/a> on Truth Social, his social media company.<\/p>\n<p>Oz or McCormick will face Pennsylvania Lt. Gov. John Fetterman, the winner of the Democratic Senate primary, in November. The victor will then succeed Sen. Pat Toomey, a Republican who is retiring after two terms in the Senate. Democrats, therefore, have a chance to flip the seat in the general election.<\/p>\n<p>Fetterman <a href=\"https:\/\/www.dailywire.com\/news\/pennsylvania-democrats-pick-basketball-shorts-and-hoodie-clad-john-fetterman-over-rising-star-conor-lamb-in-senate-primary\">defeated<\/a> U.S. Congressman Conor Lamb despite <a href=\"https:\/\/www.dailywire.com\/news\/top-democrat-in-pennsylvania-senate-race-to-get-pacemaker-campaign-announces-on-election-day\">suffering a stroke<\/a> in the week before the election and successfully undergoing a procedure to receive a pacemaker on election day.
