He is one of four ex-Trump administration officials to be held in contempt by the House, along with former Chief of Staff <a href=\"https:\/\/dailycaller.com\/2021\/12\/14\/house-votes-hold-mark-meadows-criminal-contempt-congress\/\">Mark Meadows<\/a>, former Deputy Chief of Staff Dan Scavino, and former economics adviser <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/04\/06\/navarro-scavino-contempt-vote-house\/\">Peter Navarro<\/a>. Unlike the other three, Bannon was not employed by the White House during the 2020 election and its aftermath, <a href=\"https:\/\/dailycaller.com\/2017\/08\/19\/trump-praises-bannons-move-back-to-breitbart\/\">serving<\/a> instead in 2017.<\/p>\n<p>In a <a href=\"https:\/\/www.courtlistener.com\/docket\/60990687\/58\/united-states-v-bannon\/\">motion<\/a> to dismiss filed in April, Bannon and his attorneys argue that his contempt charges are unlawful because the Select Committee violates the rules of the House of Representatives due to its lack of a minority-appointed ranking member. McCarthy\u2019s <a href=\"https:\/\/www.courtlistener.com\/docket\/60990687\/75\/united-states-v-bannon\/\" target=\"_blank\" rel=\"noopener noreferrer\">brief<\/a> supports that <a href=\"https:\/\/www.courtlistener.com\/docket\/60990687\/75\/2\/united-states-v-bannon\/\" target=\"_blank\" rel=\"noopener noreferrer\">position<\/a>, noting that Speaker of the House Nancy Pelosi described an \u201c\u2018unprecedented\u2019 approach to forming the Select Committee.\u201d<\/p>\n<div id=\"attachment_7435933\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7435933\" class=\"wp-caption-text\">WASHINGTON, DC \u2013 NOVEMBER 15: Former Trump Administration White House advisor Steve Bannon waves after speaking to the press on his way out of federal court on November 15, 2021 in Washington, DC. (Photo by Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p>\u201cIt is therefore not at all extraordinary that the House failed to contemplate the possibility of less than thirteen (13) Members being appointed upon passage of Resolution 503,\u201d which requires the inclusion of thirteen committee members, including five appointed by the minority, McCarthy\u2019s brief says.<\/p>\n<p>Republican Wyoming Rep. Liz Cheney has been described as the <a href=\"https:\/\/january6th.house.gov\/news\/press-releases\/chairman-thompson-announces-representative-cheney-select-committee-vice-chair\">vice chair<\/a> of the committee in public statements. However, Bannon\u2019s filing notes, \u201ct<span id=\"page51R_mcid16\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">he authorizing resolution does not grant any power to a vice chair. The resolution uses <\/span><span dir=\"ltr\" role=\"presentation\">the term \u2018ranking minority member,\u2019 a term with a long history. A vice chair is not a ranking <\/span><span dir=\"ltr\" role=\"presentation\">minority member.\u201d<\/span><\/span><\/p>\n<p>In an amicus <a href=\"https:\/\/www.scribd.com\/document\/575598193\/USA-v-Bannon-Amicus-Brief-5-10-2022\">filing<\/a> responding to Bannon\u2019s motion, House General Counsel Douglas Letter described Cheney as the ranking member.<\/p>\n<p>\u201c<span id=\"page30R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Representative Cheney, by virtue of being the first minority party Member appointed to <\/span><span dir=\"ltr\" role=\"presentation\">the Select Committee, is, by definition, the senior ranking minority member of the Select <\/span><span dir=\"ltr\" role=\"presentation\">Committee. Accordingly, pursuant to the House\u2019s longstanding interpretation of \u2018ranking <\/span><span dir=\"ltr\" role=\"presentation\">minority member,\u2019 House Resolution 503 was satisfied by consultation with Vice Chair Cheney,\u201d he wrote.<\/span><\/span><\/p>\n<p>McCarthy\u2019s brief supports supports Bannon\u2019s interpretation, noting the inconsistent descriptions of Cheney\u2019s role and arguing for the importance of minority representation.<\/p>\n<p>\u201cThis distinction is not without a difference,\u201d his lawyers write of Cheney\u2019s position. \u201cMinority leadership on any given committee ensures that deponents are afforded oversight of adherence to congressional rules, precedents, and established decorum.\u201d<\/p>\n<p>Pelosi initially appointed seven Democrats and Cheney to the Select Committee in July 2021, allowing McCarthy to recommend five Republicans. However, the speaker <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/nancy-pelosi-rejects-two-republicans-january-6-select-committee-jim-jordan-jim-banks-capitol-riot\/\">rejected<\/a> two of McCarthy\u2019s picks, Ohio Rep. Jim Jordan and Indiana Rep. Jim Banks. McCarthy then <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/kevin-mccarthy-every-republican-member-january-6-select-committee\/\">pulled<\/a> his other three members, Illinois Rep. Rodney Davis, Texas Rep. Troy Nehls, and North Dakota Rep. Kelly Armstrong, from the committee. <a href=\"https:\/\/dailycaller.com\/2022\/05\/12\/jim-jordan-reacts-january-6-subpoena\/\"><strong>(RELATED: \u2018Totally Partisan\u2019: Rep. Adam Kinzinger to the Select Committee.<\/p>\n<p>The committee subpoenaed McCarthy, Jordan, and three other House Republicans in early May, claiming that they have information about the Capitol riot that should be shared.
