Eric Holcomb\u2019s veto of a bill banning biological males from competing in girls\u2019 sports.<\/p>\n<p>The House voted 67-28 early Tuesday. The state\u2019s Senate voted in <a href=\"https:\/\/www.wishtv.com\/news\/indiana-news\/indiana-trans-athlete-bill-to-become-law-after-gop-overrides-veto-aclu-sues\/\" target=\"_blank\" rel=\"noopener\">favor<\/a> of the override 32-15 to overwhelmingly defeat the governor\u2019s veto.<\/p>\n<p>\u201cBiological males have an inherently stronger physique, and this bill assures there are not any unfair advantages,\u201d Republican state Sen. Jeff Raatz said in a <a href=\"https:\/\/www.indianasenaterepublicans.com\/preserving-fairness-in-female-sports\" target=\"_blank\" rel=\"noopener\">statement<\/a> following the governor\u2019s April veto.<\/p>\n<p>\u201cBiological females have the right to participate on an even playing field against their peers, and ensuring this fairness in female sports is a critical part of providing our youth with meaningful experiences and opportunities beyond the walls of the classroom,\u201d he added.<\/p>\n<p>Holcomb argued in a March <a href=\"https:\/\/www.in.gov\/gov\/files\/Veto-HEA-1041.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a>\u00a0to Indiana state Speaker Todd Huston (R) that the bill would increase \u201cthe likelihood of litigation against our schools with the courts having to adjudicate the uncertainties.\u201d<\/p>\n<p>A second concern the governor expressed in his letter was that the law would not stand in court.<\/p>\n<p>\u201cIn the two cases with initial rulings thus far, the courts have enjoined or prohibited laws with these same substantive provisions from taking effect based on equal protections grounds,\u201d Holcomb added.<\/p>\n<p>The governor noted a third concern as well, noting that the newly proposed law \u201cimplies that the goals of consistency and fairness in competitive female sports are not currently being met. After thorough review, I find no evidence to support either claim even if I support the overall goal.\u201d<\/p>\n<p>The Daily Wire previously reported that many Indiana Republicans disagreed with the governor\u2019s veto, including Indiana Attorney General Todd Rokita (R).<\/p>\n<p>\u201cThe passage of HEA 1041 to ban males from competing on female sports teams is an important step in protecting youth sports and has been championed by my office. We welcome the opportunity to defend this law if challenged in court. <a href=\"https:\/\/t.co\/jNv9NzjDuG\">pic.twitter.com\/jNv9NzjDuG<\/a><\/p>\n<p>\u2014 Todd Rokita (@AGToddRokita) <a href=\"https:\/\/twitter.com\/AGToddRokita\/status\/1501988814348341261?ref_src=twsrc%5Etfw\">March 10, 2022<\/a><\/p>\n<p>A similar situation took place in Kentucky in April as the Republican-led legislature voted to <a href=\"https:\/\/www.dailywire.com\/news\/kentucky-legislators-override-governors-veto-pass-law-to-ban-transgender-athletes-from-girls-sports\" target=\"_blank\" rel=\"noopener\">override<\/a> Democratic Governor Andy Beshear\u2019s veto to enact a law to ban biological males from competing in girls\u2019 sports from 6th-12th grades and from women\u2019s sports in college.<\/p>\n<p>The override occurred after Beshear\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/kentucky-governor-vetoes-transgender-athlete-bill\" target=\"_blank\" rel=\"noopener\">vetoed<\/a> SB 83, the Fairness in Women\u2019s Sports Act, and claimed the legislation would likely not hold up under legal challenges.<\/p>\n<p>The bill originally passed in the Kentucky House of Representatives 70-23 and in the state Senate 26-9.<\/p>\n<p>Several GOP-led states have passed transgender athlete ban laws following controversy over University of Pennsylvania swimmer Lia Thomas, a biological male competing on the university\u2019s women\u2019s swimming team. Thomas won several events, including in competition at the Women\u2019s NCAA National Championship in Atlanta.<\/p>\n<p>Earlier this month,\u00a0Republican South Carolina Gov.
