Wade<\/em> has panicked many reproductive technology advocates, specifically the<a href=\"https:\/\/www.reproductivefacts.org\/news-and-publications\/news-and-research\/press-releases-and-bulletins\/asrm-issues-statement-regarding-roe-v.-wade-and-its-possible-implications-on-access-to-reproductive-care\/\"> American Society for Reproductive Medicine<\/a>. When abortion policy is decided by individual states, personhood laws such as Louisiana\u2019s <a href=\"http:\/\/legis.la.gov\/Legis\/Law.aspx?p=y&#038;d=97020\">Human Life Protection Act<\/a> and Texas\u2019s <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-58406496\">Heartbeat Act<\/a> could immediately criminalize many aspects of Big Fertility\u2019s business model. That\u2019s because destroying human life is part and parcel of in vitro fertilization (IVF).\u00a0<\/p>\n<p>The violation of lab-created children\u2019s right to life begins in the petri dish. First, IVF often involves the <a href=\"https:\/\/fertilityinstitute.com\/fertility-treatments\/ivf\/pgt\/\">preimplantation screening of 6 or 7 day old blastocysts<\/a> (early embryos), to not only determine the likelihood of implantation success, but also screen for chromosomal abnormalities such as Down Syndrome, and inherited genetic anomalies such as breast cancer, cystic fibrosis, and spinal muscular atrophy. Only the tiny humans determined to be \u201cgenetically healthy and normal\u201d are transferred for implantation or frozen for future use. The rest are discarded. <\/p>\n<p><a href=\"https:\/\/www.futurity.org\/ivf-fertilization-embryos-pregnancy-2574772\/?utm_source=rss&#038;utm_medium=rss&#038;utm_campaign=ivf-fertilization-embryos-pregnancy-2574772\">Researchers have found<\/a>, however, that embryos with abnormal cells have the ability to self-correct, or push the abnormal cells out and replace them with normal cells. Eliminating these early embryos, of course, therefore destroys untold numbers of developing human beings that might have later been designated as \u201cgood quality.\u201d <\/p>\n<p>Judith Daar of Northern Kentucky University believes the genetic testing that is routinely performed on embryos could be banned as a result of personhood laws, <a href=\"https:\/\/www.cnn.com\/2022\/05\/11\/politics\/roe-abortion-fertility-ivf\/index.html?utm_source=facebook&#038;utm_medium=news_tab\">according to CNN<\/a>. How many babies would be alive today if they were indeed not subjected to \u201cquality\u201d screenings?<\/p>\n<p>But even if IVF babies aren\u2019t discarded, they still aren\u2019t out of the woods. Many are considered \u201csurplus\u201d or \u201cleftovers\u201d and cryogenically frozen. According to Southern Methodist University professor <a href=\"https:\/\/www.cnn.com\/2022\/05\/11\/politics\/roe-abortion-fertility-ivf\/index.html?utm_source=facebook&#038;utm_medium=news_tab\">Seema Mohapatra<\/a>, who specializes in assisted reproduction, \u201cThere\u2019s always extra embryos \u2026 You don\u2019t know if it\u2019s going to take on the first cycle.\u201d <\/p>\n<p>We currently have <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14636778.2018.1546574?journalCode=cngs20\">more than 1 million frozen embryos<\/a> in this country because the practice is so widespread. If embryos are legally considered human beings, clinics may violate the law if they continue discarding or <a href=\"https:\/\/www.theguardian.com\/us-news\/2022\/may\/12\/ivf-treatment-us-anti-abortion-laws-bills\">freezing<\/a> those \u201cextra\u201d and \u201cunwanted\u201d embryos.<\/p>\n<h2>\u2018Selective Reduction\u2019 of Multiple Embryos<\/h2>\n<p>Further, pro-life laws could hinder the widespread practice of <span style=\"text-decoration: line-through;\">abortion<\/span> \u201cselective reduction,\u201d standard in <a href=\"https:\/\/thembeforeus.com\/dear-legislative-allies-this-is-how-surrogacy-harms-children\/\">surrogacy contracts<\/a>. Not only is there concern that clinics could be in violation of state law if they discard chromosomally abnormal embryos, but they will no longer be allowed to \u201cselectively reduce\u201d any \u201cextra\u201d children who may implant. Translation: pre-born IVF children are designer and disposable commodities, both in the lab and in the womb.<\/p>\n<p>This means overturning <em>Roe<\/em> could finally end the routine discarding, freezing, and terminating of lab-created life.<\/p>\n<p>Why the need to create, store and over-implant so many embryos? Harvard Law professor Mary Ziegler <a href=\"https:\/\/www.cnn.com\/2022\/05\/11\/politics\/roe-abortion-fertility-ivf\/index.html?utm_source=facebook&#038;utm_medium=news_tab\">tells you<\/a> what many fertility clinics won\u2019t: \u201cThe chances of a successful IVF cycle aren\u2019t that high, so doctors will often implant multiple embryos to maximize the odds at least one pregnancy comes to term.\u201d The standard operating fertility clinic procedures \u2014 including discarding undesirable embryos and quality and quantity control abortions \u2014 means that <a href=\"https:\/\/www.google.com\/url?q=https:\/\/thembeforeus.com\/dear-legislative-allies-this-is-how-surrogacy-harms-children\/&#038;sa=D&#038;source=docs&#038;ust=1652462487831825&#038;usg=AOvVaw2Zca3L2Wcu1q6RSGt-4nKI\">only 7 percent<\/a> of all lab-created children are born alive.<\/p>\n<h2>Lives Lost through Trial and Error<\/h2>\n<p>For the lucky embryos who do get a shot at implantation and avoid \u201cselective reduction,\u201d <a href=\"https:\/\/www.ivfauthority.com\/ivf-success-rate\/#:~:text=Trends%20in%20IVF%20Success%20Rates%20by%20Age%20,%20%2088%20%207%20more%20rows%20\">the average live birth rate<\/a> among women aged 35-37 (using their own eggs) is 42.8 percent. Women aged 38-40 using IVF have a live birth rate of 35.5 percent. <\/p>\n<p>Further, after the first IVF cycle, less than 30 percent of women have a live birth, and there\u2019s a paltry 45 percent success rate after <em>three<\/em> full cycles of IVF. Two-thirds of patients will be successful after <em>six or more<\/em> cycles. How many little lives are being lost through this extensive trial and error transfer process?<\/p>\n<p>What happens to embryos that aren\u2019t fortunate enough to be among the 7 percent born alive or their siblings who at least died in their mother\u2019s womb? They are discarded, indefinitely frozen, \u201cdonated to research\u201d and experimented on until death, or \u201c<a href=\"https:\/\/thefederalist.com\/2019\/12\/04\/why-embryo-adoption-damages-childrens-rights\/\">donated<\/a>\u201d to other adults. This industry is no respecter of human life.<\/p>\n<h2>Will Abortion Laws Actually Affect IVF?<\/h2>\n<p>While the Supreme Court declaring the humanity of the preborn under the U.S. Constitution would be an enormous step toward preserving embryonic life, pro-life legislators do not anticipate IVF being affected solely by the overturning of <em>Roe<\/em>.<\/p>\n<p><a href=\"https:\/\/aul.org\/author\/clarkeforsytheaul\/\">Clarke Forsythe, a senior counsel at Americans United for Life<\/a>, told me, \u201cJustice Alito\u2019s leaked draft opinion, if it becomes the official opinion of the Supreme Court, specifically limited the scope of the Court\u2019s decision to <em>Roe v. Wade<\/em> and the \u2018abortion right\u2019 which the Court has defined as the right to \u2018terminate pregnancy.\u2019 Which means an inter-uterine pregnancy.\u201d <\/p>\n<p>Alito made clear that his opinion is limited to abortion and does not affect other areas of law, Forsythe said.\u00a0Ex utero, laboratory embryos have not been covered by <em>Roe<\/em> nor by abortion law, and IVF has not been protected by <em>Roe<\/em>. <\/p>\n<p>\u201cWhat has protected IVF and its growth since 1981 has been public opinion, paying clients, and the special interests that want IVF,\u201d according to Forsythe.<\/p>\n<p>\u201cThere has not been sufficient regulation of IVF, but virtually no state has sought to prohibit IVF because of its popularity. If there has not been much regulation before <em>Dobbs<\/em>, I don\u2019t see a lot of regulation coming after <em>Dobbs<\/em>.\u00a0But it\u2019s possible that stronger regulations might arise in red states,\u201d he said.<\/p>\n<h2>Current State Abortion Bans Would Ban \u2018Selective Reduction\u2019<\/h2>\n<p>Genevieve Marnon, legislative director of <a href=\"https:\/\/rtl.org\/\">Right to Life of Michigan<\/a>, says, \u201cFirst, each state will be different because of different state laws and state constitutions. Second, the leaked draft was very clear that overruling<em> Roe<\/em> will simply reverse the egregiously wrong decision in <em>Roe<\/em>, which allowed abortion but is silent on leftover embryos. The leaked draft did not go so far as to declare the unborn child a person under the federal constitution\u2026 Therefore, I do not see the overruling of <em>Roe<\/em> banning the destruction of embryonic life, absent a state law to that effect.\u201d\u00a0<\/p>\n<p>Marnon gave the example of Michigan\u2019s state law: \u201cWe have a <a href=\"http:\/\/www.legislature.mi.gov\/(S(enqs452xmlf4pud1d2vz34t0))\/mileg.aspx?page=GetObject&#038;objectname=mcl-Article-I-27\">2008 constitutional provision<\/a> that expressly grants the right to experiment on leftover embryos from IVF. This constitutional right will not be impacted by removing a federal constitutional right to abortion. And in Michigan, we have a <a href=\"http:\/\/www.legislature.mi.gov\/(S(5vnpemdpen3fl0kypmc0pvov))\/mileg.aspx?page=GetObject&#038;objectname=mcl-750-14\">complete ban on abortion<\/a>, but our constitution would supersede a state statute. In other states, abortion on demand throughout all 9 months will continue unabated. IVF will not be affected in any way whatsoever.\u201d\u00a0\u00a0<\/p>\n<p>The only way IVF would be affected in Michigan, Marnon says, is regarding selective reduction. If Michigan\u2019s complete ban on abortion is allowed to go back into place, then selective reduction would be banned. \u201cSadly, making, freezing, and destroying embryos will continue unabated,\u201d Marnon added.<\/p>\n<p>Big Fertility\u2019s fear that pro-life laws will wreck their business model is justified, even if these fears are likely overestimated.
