Ron DeSantis, allows the state to fine social media companies up to $250,000 a day if they ban candidates for elected office from using their platforms and allows banned candidates to seek up to $100,000 in damages. It also prohibits platforms from using algorithms to promote or suppress content. A District Court judge <a href=\"https:\/\/dailycaller.com\/2021\/06\/30\/ron-desantis-florida-big-tech\/\">ruled<\/a> in June 2021 that the legislation does not address a legitimate government interest and enjoined Florida from enforcing it. <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/24\/strongest-thing-any-state-has-done-ron-desantis-lauds-floridas-anti-big-tech-bill\/\">(RELATED: \u2018Strongest Thing That Any State Has Done\u2019: Ron DeSantis Touts Florida\u2019s Anti-Big Tech Bill)<\/a><\/strong><\/p>\n<p>The Eleventh Circuit panel upheld District Court Judge Robert Hinkle\u2019s injunction against several provisions in the law, <a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202112355.pdf\">finding<\/a> that \u201cs<span id=\"page5R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ocial-media com<\/span><span dir=\"ltr\" role=\"presentation\">panies \u2014 even the biggest ones \u2014 are \u2018private actors\u2019 whose rights <\/span><span dir=\"ltr\" role=\"presentation\">the First Amendment protects.\u201d<\/span><\/span><\/p>\n<p>\u201cT<span class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">heir so-called \u2018content-moderation\u2019 decisions consti<\/span><span dir=\"ltr\" role=\"presentation\">tute protected exercises of editorial judgment, and that the provi<\/span><span dir=\"ltr\" role=\"presentation\">sions of the new Florida law that restrict large platforms\u2019 ability to <\/span><span dir=\"ltr\" role=\"presentation\">engage in content moderation unconstitutionally burden that pre<\/span><span dir=\"ltr\" role=\"presentation\">rogative,\u201d Trump-appointed Judge Kevin <a href=\"https:\/\/www.ca11.uscourts.gov\/judges\/hon-kevin-c-newsom\">Newsom<\/a> wrote for the unanimous panel.<\/span><\/span><\/p>\n<p>The court also overturned portions of Hinkle\u2019s injunction that prohibited Florida from enforcing parts of the bill requiring companies to disclose candidate advertising and rule changes. Newsom wrote that Florida\u2019s interest in making sure users \u201c<span id=\"page145R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">are fully <\/span><span dir=\"ltr\" role=\"presentation\">informed about the terms of that transaction and aren\u2019t misled <\/span><span dir=\"ltr\" role=\"presentation\">about platforms\u2019 content moderation policies\u201d is \u201clikely legitimate.\u201d<\/span><\/span><\/p>\n<p>Florida Attorney General Ashley Moody praised the latter portion of the ruling.<\/p>\n<p>\u201c<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">We are pleased the court recognized the state\u2019s authority to rein in social media companies and upheld major portions of Florida\u2019s law leading the way in doing so. He <a href=\"https:\/\/dailycaller.com\/2021\/05\/24\/strongest-thing-any-state-has-done-ron-desantis-lauds-floridas-anti-big-tech-bill\/\">claimed <\/a>in May 2021 that technology firms \u201care more powerful than the monopolies of the early 20th century\u201d because they use \u201ctheir power to enforce orthodoxy and suppress speech and candidates that they disagree with.\u201d<\/p>\n<p>He ordered an investigation into Facebook in September 2021, <a href=\"https:\/\/dailycaller.com\/2021\/09\/27\/desantis-orders-investigation-into-facebook-over-alleged-election-interference\/\">claiming<\/a> that the company may have interfered in the 2020 election.
