However, in compliance with the court\u2019s injunction, the Biden Administration will continue to enforce the CDC\u2019s 2020 Title 42 public health authority pending the appeal. This means that migrants who attempt to enter the United States unlawfully will be subject to \u00a0expulsion under Title 42, as well as immigration consequences such as removal under Title 8.\u201d<\/p>\n<p>\u201cAs the appeal proceeds, the Department of Homeland Security will continue planning for the eventual lifting of Title 42 in light of CDC\u2019s public health judgment, at which point anyone who attempts to enter the country unlawfully will be subject to Title 8 Expedited Removal proceedings, if they do not have grounds to remain in the United States,\u201d she added.<\/p>\n<p>The <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-statement-ruling-louisiana-v-cdc\">Department of Justice<\/a> also issued its own statement Friday announcing its intent to appeal the ruling. \u201cThe Centers for Disease Control and Prevention (CDC) invoked its authority under Title 42 due to the unprecedented public-health dangers caused by the COVID-19 pandemic,\u201d DOJ spokesman Anthony Coley said. \u201cCDC has now determined, in its expert opinion, that continued reliance on this authority is no longer warranted in light of the current public-health circumstances. That decision was a lawful exercise of CDC\u2019s authority. The Department of Justice intends to appeal the court\u2019s decision in <em>Louisiana et al. v. CDC et al.\u201d<\/em><\/p>\n<p>Western District of Louisiana Judge Robert Summerhays granted the request for a preliminary injunction in the case of\u00a0<em>Louisiana v. Centers for Disease Control and Prevention.\u00a0<\/em>Summerhays explained the Court\u2019s reasoning for issuing the injunction in a <a href=\"https:\/\/www.scribd.com\/document\/575103436\/Title-42-preliminary-injunction\">47-page ruling<\/a>. Among the reasons for issuing the injuction, Summerhays ruled that the anticipated end of Title 42 would lead to a massive increase in border crossings.<\/p>\n<p>\u201c<span class=\"a\"><span class=\"l11\"><span class=\"l9\"><span class=\"l6\"><span class=\"l7\">The record <\/span><\/span><\/span><\/span><\/span><span class=\"a\">reflects that\u2014based on the government\u2019s own predictions\u2014that the Termination Order will result <\/span><span class=\"a\">in an increase in daily border crossings and that this increase could be as large as a three-fold <\/span><span class=\"a\">increase to 18<span class=\"l7\">,00<span class=\"l6\">0 daily\u00a0bo<span class=\"l8\">rder crossings\u201d the judge wrote. \u201cMoreover, the CD<span class=\"l10\">C\u2019s own Termination Order\u00a0<\/span><\/span><\/span><\/span><\/span><span class=\"a\">acknow<span class=\"l6\">led<span class=\"l7\">ges that\u00a0the order\u00a0will\u00a0lead to an increase in a\u00a0number of no<span class=\"l8\">n-citizens being processed <\/span><\/span><\/span><\/span><span class=\"a\">in DHS\u00a0fac<span class=\"l7\">ili<span class=\"l6\">ties which co<span class=\"l11\">uld result\u00a0in ov<span class=\"l10\">ercrowding in congregate settings. The reco<span class=\"l9\">rd also <\/span><\/span><\/span><\/span><\/span><\/span><span class=\"a\">inc<span class=\"l6\">ludes evi<span class=\"l7\">dence supporting the Plaintiff States\u2019 positio<span class=\"l8\">n\u00a0that\u00a0such an\u00a0increase in border\u00a0crossings <\/span><\/span><\/span><\/span><span class=\"a\">wil<span class=\"l6\">l increase their\u00a0costs fo<span class=\"l8\">r\u00a0healthcare reim<span class=\"l9\">bursements\u00a0and educatio<span class=\"l7\">n services. These costs are not recoverable.\u201d<\/span><\/span><\/span><\/span><\/span><\/p>\n<p>Attorneys General from 24 states, led by Louisiana, filed a lawsuit claiming that rescinding Title 42 would violate federal regulatory procedures, <a href=\"https:\/\/www.dailywire.com\/news\/breaking-judge-blocks-biden-administration-from-ending-title-42\">The Daily Wire<\/a> reported. Title 42 has been in place since the beginning of the COVID-19 pandemic in March 2020, and was used to prevent more than 100,000 migrant crossings in April alone.
