It asked Whitmer to consider several questions and provide answers in the coming two weeks.<span class=\"Apple-converted-space\"> Whitmer is utilizing executive authority to request that the court immediately take up her lawsuit, but it does not have to oblige.<\/span><\/p>\n<p class=\"p1\">The questions <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/05\/20\/michigan-supreme-court-whitmer-1931-abortion-lawsuit\/9857162002\/\">include<\/a>, per the Detroit Free Press:<\/p>\n<ul>\n<li class=\"p1\"><i>Whether the Court of Claims\u2019\u00a0injunction makes it unnecessary for the Michigan Supreme Court to immediately take up the governor\u2019s case;<\/i><\/li>\n<li class=\"p1\"><i>Whether the questions posed should be answered before the United States Supreme Court determines the fate of Roe v. Wade, and whether that decision would be binding to the questions of state abortion rights raised by the governor<\/i><\/li>\n<li class=\"p1\"><i>\u201cWhether there is an actual case and controversy requirement and, if so, whether it is met here\u201d;<\/i><\/li>\n<li class=\"p1\"><i>An explanation of the Executive Message powers granted by law and why the question of abortion constitutionality merits using this authority; and<\/i><\/li>\n<li class=\"p1\"><i>Whether the power only allows the governor to defend existing laws, as opposed to questioning the constitutionality of existing laws.<\/i><\/li>\n<\/ul>\n<p class=\"p1\">Earlier this week, Michigan\u2019s Court of Claims <a href=\"https:\/\/www.plannedparenthood.org\/uploads\/filer_public\/bd\/ae\/bdae94a0-991f-40b4-af60-98df7d4a4169\/20220517_opin_and_ord.pdf\"><span class=\"s1\">issued<\/span><\/a> a preliminary injunction blocking the state\u2019s 1931 law that bans abortion, after the state\u2019s Planned Parenthood and an abortion provider sued. Under the order, the attorney general of Michigan is not allowed to enforce the law. Court of Claims Judge Elizabeth Gleicher decided that Planned Parenthood had a high likelihood of winning.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Last month, Whitmer filed a separate lawsuit <a href=\"https:\/\/www.dailywire.com\/news\/whitmer-files-lawsuit-challenging-1931-pro-life-law\"><span class=\"s1\">directed<\/span><\/a> at the 1931 law, which could go back into place if <i>Roe v. Wade <\/i>is overturned by the Supreme Court.<\/p>\n<p class=\"p1\">As Politico\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/04\/07\/whitmer-sues-abortion-law-governors-00023649\"><span class=\"s1\">reported<\/span><\/a>, \u201cThe Michigan law bans abortion at any stage of pregnancy, with an exception for the health of a woman but not for cases of rape or incest. It has remained on the books for decades despite the 1973\u00a0<i>Roe\u00a0<\/i>decision rendering it unenforceable and establishing the right to abortion nationally.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Whitmer\u2019s lawsuit includes 13 prosecutors of counties with abortion clinics. County prosecutors also <a href=\"https:\/\/www.mlive.com\/public-interest\/2022\/05\/michigan-supreme-court-will-consider-gov-whitmers-abortion-lawsuit.html\"><span class=\"s1\">have two weeks<\/span><\/a> to submit their answers to the questions after Whitmer does so.<\/p>\n<p class=\"p1\">Whitmer spokesperson Bobby Leddy <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/05\/20\/michigan-supreme-court-whitmer-1931-abortion-lawsuit\/9857162002\/\"><span class=\"s1\">said<\/span><\/a> Friday, \u201cIn light of the leaked opinion from conservatives justices of the U.S. Supreme Court, and the fact that Michigan has an outdated law on the books from 1931 making abortion a felony even in cases of rape or incest, it has never been more important for the Michigan Supreme Court to resolve whether the state constitution protects the right to abortion.\u201d<\/p>\n<p class=\"p1\">\u201cWe are reviewing the Michigan Supreme Court\u2019s questions, and welcome the opportunity to inform the court of the need to resolve this crucial constitutional question now. Women need clarity and confidence that their rights will be protected, and that\u2019s what Gov, Whitmer is hoping to achieve with this case,\u201d Leddy added.<\/p>\n<p class=\"p1\">States across the country have been <a href=\"https:\/\/www.dailywire.com\/news\/oklahoma-passes-ban-on-almost-all-abortions-starting-at-conception\"><span class=\"s1\">watching<\/span><\/a> for a a ruling from the Supreme Court on the Mississippi case\u00a0<i>Dobbs vs. Jackson Women\u2019s Health Organization.\u00a0<\/i>A recent Supreme Court draft majority opinion on the case showed the high court could very well overturn\u00a0<i>Roe v. Wade\u00a0<\/i>and\u00a0<i>Planned Parenthood v.
