Braden, an eighth-grader in Wisconsin\u2019s Kiel Area School District, was the subject of a sexual harassment complaint and investigation, the principal told her.<\/p>\n<p>\u201cI was like, \u2018What? Sexual harassment? What are you talking about?&#8217;\u201d Braden\u2019s mom, Rose Rabidoux, recalled to The Federalist. \u201cBecause when I think of sexual harassment, I think of rape. I think of inappropriate touching.\u201d<\/p>\n<p>Braden hadn\u2019t been accused of any of these things. He hadn\u2019t groped or stalked anybody or even made lewd comments. <\/p>\n<p>The school was instead going after him and two other eighth-grade boys for using so-called \u201cincorrect pronouns\u201d for a female student who decided she wanted to be called \u201cthey\u201d or \u201cthem.\u201d According to the school, because an unknown complainant alleged that Braden had used feminine singular pronouns to refer to a female student, he was being investigated for sexual harassment under Title IX. <\/p>\n<p>\u201cWhen he told me that the sexual harassment allegations were for pronouns, I just was floored,\u201d Rose said. <\/p>\n<p>Rose told The Federalist that when the principal called her on that Monday to tell her about the allegations and ask if she was available to answer some questions with Braden the following day, the principal suggested he could just question Braden alone if Rose wasn\u2019t available.<\/p>\n<p>\u201cI said, \u2018Absolutely not,&#8217;\u201d Rose said. \u201c\u2018I don\u2019t want him in there talking to you without me.&#8217;\u201d<\/p>\n<p>According to Luke Berg \u2014 deputy counsel for the Wisconsin Institute for Law and Liberty, which is representing the three boys and their families and sent a letter urging the school to drop the complaint \u2014 it appears the school district is inflating the scope of its own policies and Title IX. The latter is the part of the Education Amendments of 1972 that prohibits sex-based discrimination in federally funded educational settings. The school, however, is weaponizing it to conflate \u201cgender identity\u201d and \u201csexual orientation\u201d with \u201csex.\u201d<\/p>\n<p>The district did not respond to a request for comment.<\/p>\n<h2>The \u2018Parade of Horribles\u2019<\/h2>\n<p>If this sounds familiar, it\u2019s because the Biden administration is working to <a href=\"https:\/\/thefederalist.com\/2022\/05\/06\/new-biden-title-ix-order-will-help-schools-push-transgenderism-on-your-kids-behind-your-back\/\">expand<\/a> the meaning of \u201csex\u201d in Title IX in the same manner on a nationwide scale. On his very first day in office, President Joe Biden issued an <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/20\/executive-order-preventing-and-combating-discrimination-on-basis-of-gender-identity-or-sexual-orientation\/\">executive order<\/a> directing his Department of Education to redefine \u201csex\u201d in Title IX to mean \u201cgender identity\u201d and \u201csexual orientation.\u201d<\/p>\n<p>If Biden and his Democrat allies get their way, every public and charter school across the country will, instead of educating kids, be pouring their allotted taxpayer dollars into investigating the ones who don\u2019t subscribe to the left\u2019s orthodoxy on wrong pronouns or who accidentally use a student\u2019s correct pronoun instead of their \u201cpreferred\u201d false pronoun.<\/p>\n<p>Berg said Biden\u2019s Title IX push is \u201ccertainly related\u201d to the Supreme Court\u2019s erroneous 2020 ruling in <em>Bostock v. Clayton County<\/em>, wherein the court read \u201csexual orientation\u201d and \u201cgender identity\u201d into the meaning of \u201csex\u201d in Title VII. That part of the Civil Rights Act of 1964 is almost the same as Title IX but deals with employment instead of education. Biden cited the <em>Bostock<\/em> ruling in pushing for Title IX expansion.<\/p>\n<p>\u201cThat actually was in one of the <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/17-1618#DISSENT_4-61ref\">dissents<\/a> in <em>Bostock<\/em>,\u201d Berg told The Federalist. \u201cHere is the parade of horribles that\u2019s going to happen as a result of this ruling. And one of the parade of horribles listed \u2026 was that they\u2019re going to interpret Title IX in such a way that \u2018mispronouning\u2019 is sexual harassment. And here we are.\u201d<\/p>\n<p>Biden\u2019s expansion attempt in the educational sphere hasn\u2019t become active regulation yet, however, meaning the Kiel School District\u2019s \u201csexual harassment\u201d investigation is of its own accord \u2014 and not even consistent with its own policies. According to school <a href=\"https:\/\/go.boarddocs.com\/wi\/kiel\/Board.nsf\/Public?open&#038;id=policies#\">policy<\/a>, so-called \u201cmispronouning\u201d doesn\u2019t come close to the bar for sexual harassment, which typically means things like stalking, dating violence, unwanted or inappropriate touching, or quid pro quo sexual favors. Furthermore, the school isn\u2019t even abiding by its own processes with regard to the investigation, despite its claims to the contrary.<\/p>\n<p>\u201cAs a public school district, we are bound to follow all state and federal laws regarding bullying and harassment,\u201d District Superintendent Brad Ebert wrote in an email to parents after the school attracted some media attention for the pronoun circus. \u201cWe have and will continue to comply with these obligations.\u201d<\/p>\n<p>The school, however, flouted its policies and Title IX from the very start. Although both require the school to notify the accused about the allegations before starting an investigation so the student has \u201csufficient time to prepare a response before any initial interview,\u201d the district gave only a vague, one-page notice a day before seeking to interrogate the boys, letting them know simply that they were accused of \u201cusing incorrect pronouns.\u201d According to WILL, the district began its investigation and conducted interviews without giving the students and their parents any more information or time to prepare.<\/p>\n<p>Furthermore, according to Berg, the law and district policies require the school to immediately drop the complaint if the accusations, even if true, wouldn\u2019t amount to sexual harassment. In this case, a complaint about \u201cmispronouning\u201d should have been dismissed outright.<\/p>\n<h2>The Fallout<\/h2>\n<p>Nobody knows whether the school will drop the complaint and investigation, but Rose noted that during her and Braden\u2019s interview with the school principal, her son asked if this would be going on his permanent record.<\/p>\n<p>\u201cHow is this going to affect college and scholarships?\u201d she recalled him asking. <\/p>\n<p>\u201cHe couldn\u2019t answer,\u201d Rose said of the principal\u2019s response. \u201cHe just kind of stared at him blankly and shrugged his shoulders and said, \u2018I don\u2019t know.\u2019 And I was floored.\u201d<\/p>\n<p>The whole ordeal has taken a toll on the middle-schoolers. Braden is still attending the school because his mother doesn\u2019t want his academics to suffer from the incident, and the other two boys are now being homeschooled.<\/p>\n<p>\u201cIt has them worried about things they shouldn\u2019t have to worry about. It has them worried about going to school. It has them embarrassed. They don\u2019t understand. They feel judged,\u201d Rose said, noting that even though the boys have a lot of support from their fellow students, all this heat is coming from the administration. \u201cBraden is struggling to go every day. He used to love school, and he doesn\u2019t anymore.\u201d<\/p>\n<p>It\u2019s an awful story, and one that, if it ends in disciplinary action for the boys, will most assuredly result in WILL filing a federal lawsuit. But this story is bigger than a legal battle. It\u2019s bigger than Braden and his eighth-grade friends in one school district in one state with one disgruntled female student who wants to go by plural pronouns. <\/p>\n<p>This story is a preview of exactly the kind of routine hostility we can expect for students all over the country, First Amendment be damned, if Biden and his bureaucrats successfully write \u201csexual orientation\u201d and \u201cgender identity\u201d into the meaning of \u201csex\u201d in education. <\/p>\n<p>If they prevail, you could be the next one getting a phone call to let you know your child is a sexual harasser for discerning between the sexes and between singular and plural words.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<div class=\"article-author-description fst-italic\">\n  Kylee Zempel is an assistant editor at The Federalist.
