The trial officially began in court this week, and Sussmann\u2019s attorney Sean Berkowitz quickly pushed for a mistrial after former Clinton campaign general counsel <a href=\"https:\/\/dailycaller.com\/2017\/10\/24\/flashback-lawyer-linked-to-dossier-cried-about-secret-russian-connection\/\">Marc Elias\u2019s<\/a> testimony Wednesday.<\/p>\n<p>The push for a mistrial surrounded a comment Elias made during cross-examination, <a href=\"https:\/\/www.foxnews.com\/politics\/judge-denies-defense-motion-mistrial-sussmann-testimony-possible\">according<\/a> to Fox News. Elias at one point suggested they \u201cask Mr. Sussmann\u201d when pressed on whether Sussmann went to the FBI with his claims at the behest of the Clinton campaign.<\/p>\n<p>The prosecution subsequently mentioned this answer, prompting the defense to issue the motion for a mistrial, according to Fox News. <strong><a href=\"https:\/\/dailycaller.com\/2022\/02\/14\/jim-jordan-democrats-trump-spying-durham-clinton-campaign\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018As Wrong As It Gets\u2019: Rep. REUTERS\/Julia Nikhinson<\/p>\n<\/div>\n<p>U.S. District Judge Christopher Cooper, upon denying the motion, noted that the court will follow \u201croutine\u201d procedure. Cooper noted that this procedure includes striking \u201cnon-responsive portions of the transcript,\u201d Fox News reported.<\/p>\n<p>Sussmann\u2019s defense also suggested there\u2019s still a chance the defendant may take the stand, with Berkowitz admitting he\u2019s made no official decision as of yet.<\/p>\n<p>Sussmann\u2019s defense previously pushed for the case to be dismissed, but Cooper <a href=\"https:\/\/dailycaller.com\/2022\/04\/13\/michael-sussmann-john-durham-probe-judge-case-will-proceed\/\">ruled<\/a> in April that the case could go forward and that the defense failed to offer \u201clegal authority\u201d proving Sussmann did not give a <a href=\"https:\/\/dailycaller.com\/2022\/04\/08\/durham-questions-clinton-campaigns-privilege-claims-demands-court-review-them\/\">materially<\/a> false statement.<\/p>\n<p>\u201cWhile Sussmann is correct that certain statements might be so peripheral or unimportant to a relevant agency decision or function to be immaterial under \u00a7 1001 as matter of law, the Court is unable to make that determination as to this alleged statement before hearing the government\u2019s evidence. Any such decision must therefore wait until trial,\u201d Cooper ruled at the time.<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2022\/04\/17\/john-durham-data-michael-sussmann-cia-found-user-created\/\">Durham\u2019s<\/a> team began opening arguments Tuesday by <a href=\"https:\/\/dailycaller.com\/2022\/05\/17\/look-leak-lie-john-durham-prosecutor-michael-sussmann\/\">summing<\/a> up its case against Sussmann as \u201ca look, a leak and a lie.\u201d Durham-team prosecutor Deborah Brittain Shaw argued earlier this week that\u00a0Sussmann \u201cused and manipulated the FBI,\u201d Law and Crime <a href=\"https:\/\/lawandcrime.com\/russia-investigation\/durham-prosecutor-kicks-off-false-statement-trial-by-accusing-michael-sussmann-of-using-fbi-as-a-political-tool-for-democrats\/\">reported<\/a>.<\/p>\n<p>Shaw also described Sussmann as a man who tried to \u201ccreate an October surprise on the eve of the presidential election,\u201d according to Law and Crime.
