Russo and James C. The complaint against Burger King <\/span><span> (iStock)<\/span><\/p>\n<\/div>\n<\/div>\n<p>Russo and Kelly are representing Justin Chimienti, a resident of New York, and &#8220;similarly situated individuals&#8221; who feel burger ads from Wendy\u2019s and McDonald\u2019s are misleading. The complaint demands a jury trial.<\/p>\n<p><a href=\"https:\/\/www.foxbusiness.com\/lifestyle\/lawsuit-burger-king-sandwich-sizes-ads-mislead-customers\" target=\"_blank\" rel=\"noopener\"><strong><u>LAWSUIT ALLEGES BURGER KING SANDWICH SIZES IN ADS MISLEAD CUSTOMERS<\/u><\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p>Much like the complaint Russo and Kelly filed against Burger King on March 28, the complaint against Wendy\u2019s and McDonald\u2019s cites various <a href=\"https:\/\/www.foxbusiness.com\/category\/food-drinks\" target=\"_blank\" rel=\"noopener\">food<\/a> reviews on YouTube and lifestyle publications that note inconsistencies in menu item sizes and advertisements as well as a list of protests made public on social media.<\/p>\n<p>Unlike the Burger King complaint, this filing cites a 2014 video interview with personal finance news website Money Talks News, where a food stylist revealed she prefers to undercook burger patties so it has a fuller appearance. In the video, the stylist works with &#8220;a simple burger purchased from a grocery store,&#8221; according to the narrator, who is also the founder of the news site.<\/p>\n<p>The stylist has worked with Wendy\u2019s and McDonald\u2019s, according to her online portfolio.\u00a0<\/p>\n<p>FOX Business reached out to the stylist, Wendy\u2019s and McDonald\u2019s for comment.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/food-drink\/kings-hawaiian-sued-not-made-hilo-hawaii-anymore\" target=\"_blank\" rel=\"noopener\"><strong><u>KING&#8217;S HAWAIIAN BEING &#8216;DECEPTIVE&#8217; ABOUT WHERE ITS ROLLS ARE ACTUALLY MADE, LAWSUIT ALLEGES<\/u><\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p>Russo and Kelly\u2019s class-action complaint alleges that &#8220;meat shrinks 25% when cooked,&#8221; but Wendy\u2019s and McDonald\u2019s burger patties appear &#8220;approximately 15-20% larger&#8221; in ads compared to what\u2019s served to customers in real life.<\/p>\n<p>The complaint claims Wendy\u2019s &#8220;materially overstates&#8221; representations depicted in advertisements, including the Big Bacon Cheddar Cheeseburger, the Big Bacon Cheddar Cheeseburger Double, the Big Bacon Cheddar Cheeseburger Triple, the Bourbon Bacon Cheeseburger Double, the Bourbon Bacon Cheeseburger Triple, Dave\u2019s Single, Dave\u2019s Double, Dave\u2019s Triple, the Baconator, the Son of Baconator, the Big Bacon Classic, the Big Bacon Classic Double, the Big Bacon Classic Triple, the Bacon Double Stack, the Jr. Bacon Cheeseburger, the Jr. Cheeseburger Deluxe, the Jr. Cheeseburger and the Double Stack.<\/p>\n<p>As for McDonald\u2019s the complaint claims the <a href=\"https:\/\/www.foxnews.com\/category\/food-drink\/food\/fast-food\" target=\"_blank\" rel=\"noopener\">fast food<\/a> chain &#8220;materially overstates the size of the beef patties for nearly every menu item in its current advertisements.&#8221;<\/p>\n<p><a href=\"http:\/\/www.foxbusiness.com\/apps-products\"><strong><u>GET FOX BUSINESS ON THE GO BY CLICKING HERE<\/u><\/strong><\/a><\/p>\n<p>The McDonald\u2019s menu items the complaint names as &#8220;overstated&#8221; but customer photos show the real-life patty &#8220;comes nowhere near the edge of the bun.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxbusiness.com\/technology\/how-to-identify-false-ads\" target=\"_blank\" rel=\"noopener\"><strong><u>HOW TO IDENTIFY FALSE ADS<\/u><\/strong><\/a><\/p>\n<p>Kelly told FOX Business that he thinks it\u2019s important to protect consumers from materially false advertisements, so they won\u2019t feel cheated or disappointed.<\/p>\n<p>&#8220;There is no good reason why Wendy\u2019s and McDonald\u2019s should be allowed to use trickery in their advertising,&#8221;
