The <a href=\"https:\/\/dailycaller.com\/2022\/04\/13\/michael-sussmann-john-durham-probe-judge-case-will-proceed\/\">court<\/a> heard opening arguments Tuesday at a courthouse in D.C., and Durham-team prosecutor Deborah Brittain Shaw argued that Sussmann \u201cused and manipulated the FBI,\u201d Law and Crime <a href=\"https:\/\/lawandcrime.com\/russia-investigation\/durham-prosecutor-kicks-off-false-statement-trial-by-accusing-michael-sussmann-of-using-fbi-as-a-political-tool-for-democrats\/\">reported<\/a>.<\/p>\n<p>Shaw also described Sussmann as a man who tried to \u201ccreate an October surprise on the eve of the presidential election,\u201d according to Law and Crime. That \u201cOctober surprise,\u201d according to Durham\u2019s team, involved three steps.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">\u201cWe are here because the FBI is our institution. It should not be used as a political tool for anyone \u2013 not Republicans. Not Democrats. Not anyone,\u201d she said. \u201cWhatever your political views might be, they cannot be brought to your decisions.\u201d<\/p>\n<p>\u2014 Sarah N. Lynch (@SarahNLynch) <a href=\"https:\/\/twitter.com\/SarahNLynch\/status\/1526562332834467842?ref_src=twsrc%5Etfw\">May 17, 2022<\/a><\/p>\n<\/blockquote>\n<p>First, the \u201clook\u201d \u2014 when Sussmann met with Christopher Steele, a former British Intelligence agent responsible for the now-<a href=\"https:\/\/dailycaller.com\/2021\/12\/21\/john-durham-filing-igor-danchenko-clinton-campaign-testify-probe-trump\/\">debunked<\/a> anti-Trump <a href=\"https:\/\/dailycaller.com\/2020\/08\/12\/christopher-steele-trump-russia-dossier-tape\/\">dossier<\/a>.<\/p>\n<p>Durham previously said Sussmann and Steele met in 2016\u00a0at the Perkins Coie offices to speak about possible connections to Russia, <a href=\"https:\/\/www.foxnews.com\/politics\/durham-cia-concluded-data-alleging-trump-russia-connection-not-technically-plausible-user-created\">according<\/a> to Fox News. In one court filing, Durham accused Sussmann of \u201crepresent[ing] and work[ing] for the Clinton campaign in connection with its broader opposition research efforts,\u201d the outlet reported.<\/p>\n<p>The second part of of the case, <a href=\"https:\/\/twitter.com\/JFHaughey58\/status\/1526564366774063105\">according<\/a> to Shaw, is the \u201cleak.\u201d<\/p>\n<p>This references <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/sussmann-doesnt-want-clinton-tweet-touting-collusion-claims-to-be-admissible\">allegations<\/a> from the prosecution that Sussmann, alongside others that included \u201cagents of the Clinton campaign,\u201d sent out various \u201callegations and \u2026 derogatory information about Trump and his associates to the media and the U.S. government,\u201d Durham <a href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-accidentally-releases-fusion-gps-emails-that-were-meant-to-be-under-seal\">previously<\/a> noted.<\/p>\n<p>Durham recently argued that a slew of emails sent by Fusion GPS, the opposition firm hired by Clinton\u2019s 2016 campaign that subsequently hired Steele, resulted in various news articles tying together Trump and Russia. <strong><a href=\"https:\/\/dailycaller.com\/2022\/02\/14\/jim-jordan-democrats-trump-spying-durham-clinton-campaign\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018As Wrong As It Gets\u2019: Rep. Jim Jordan Calls Out Liberal Media And Democrats For Denying That Trump Was Spied On)<\/a><\/strong><\/p>\n<p>\u201cIf rendering such advice was truly the intended purpose of Fusion GPS\u2019s\u00a0retention, one would also expect the investigative firm to seek permission and\/or guidance from [the Clinton campaign] or its counsel before sharing such derogatory materials with the media or otherwise placing them into the public domain,\u201d Durham previously wrote in a court filing arguing that Fusion GPS\u2019s research should not be covered by attorney-client privilege,\u00a0The Washington Times <a href=\"https:\/\/www.washingtontimes.com\/news\/2022\/apr\/26\/durham-gps-fusion-employees-emailed-reporters-unve\/\">reported<\/a>.<\/p>\n<p>Finally, the \u201clie.\u201d This, according to Durham\u2019s team, represents when Sussmann went to the FBI \u2013 and is what <a href=\"https:\/\/dailycaller.com\/2022\/04\/17\/john-durham-data-michael-sussmann-cia-found-user-created\/\">Sussmann<\/a> now faces charges over.<\/p>\n<p>\u201cNo one should be so privileged as to walk into the FBI and lie,\u201d Shaw argued Tuesday, <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-sussmann-lawyers-clash-in-opening-to-trial\">according<\/a> to the Washington Examiner.<\/p>\n<p>The three-part plan summed up by Shaw allegedly isn\u2019t just limited to Sussmann, Reuters\u2019 Justice Department reporter Sarah N. Lynch highlighted.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">She said the plan had three parts: \u201cA look. A leak. And a lie.\u201d This included a plot by Internet executive Rodney Joffe, who is not charged, to connect Trump\u2019s campaign to Russia\u2019s Alfabank using DNS data<\/p>\n<p>\u2014 Sarah N.
