Wade<\/em>.<\/p>\n<p>Gleicher specifically notes in her opinion that \u201cas of the date this opinion is issued, it is unknown whether the U.S. Supreme Court will overturn <em>Roe v. Wade<\/em>,\u201d but that \u201cshould the United States Supreme Court overrule <em>Roe v. Wade<\/em>, plaintiffs and their patients face a serious danger of irreparable harm if prevented from accessing abortion services.\u201d<\/p>\n<p>She did not immediately respond to a request for comment for this story.<\/p>\n<p>\u201cBecause it is impossible to predict when the United States Supreme Court will issue a decision in <em>Dobbs<\/em>, the Court finds that the issuance of immediate preliminary injunctive relief warranted to avoid the necessity of another motion and further briefing,\u201d she wrote in a footnote. \u201cShould <em>Dobbs<\/em> not overrule <em>Roe<\/em>, or result in a ruling that calls into question any portion of the Court\u2019s analysis, the parties will be expected to advise the Court of the need for additional briefing and a hearing.\u201d<\/p>\n<p>Gleicher previously represented Planned Parenthood in 1997 in a case that involved challenging the very same abortion ban in question, <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2022\/04\/15\/michigan-judge-gleicher-assigned-abortion-law-case-donor-planned-parenthood\/7323810001\/\">according to The Detroit News<\/a>, reporting that the Michigan state Court of Appeals upheld the law at the time.<\/p>\n<p>The judge disclosed her ties to Planned Parenthood in an April 2022 letter to attorneys that claimed her assignment to the 2022 case was random, the publication reported. It does not appear that any of the parties involved with the suit challenged her assignment to the case.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cWhile Judge Gleicher does not believe this warrants her recusal, and is certain that she can sit on this case with requisite impartiality and objectivity, she believes that this letter of disclosure is appropriate,\u201d the letter said, according to The Detroit News. \u201cIf any party disagrees with Judge Gleicher\u2019s assessment, an appropriate motion may be filed.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">But Right to Life of Michigan\u2019s Genevieve Marnon spoke out against Gleicher\u2019s support for Planned Parenthood, telling The Detroit News, \u201cIt seems very difficult to remain impartial under those circumstances.\u201d<\/p>\n<p class=\"gnt_ar_b_p\">Not only has Gleicher frequently donated to Planned Parenthood, she has also frequently contributed to Democratic candidates and organizations like the major pro-abortion rights group Emily\u2019s List and the Michigan Democratic State Central Committee, according to The Detroit News.<\/p>\n<p>She also donated to\u00a0Attorney General Dana Nessel, who is a defendant in the 2022 abortion case, the publication reported, noting that Nessel\u2019s office previously said that it did not have reason to believe that Gleicher\u2019s pro-abortion rights contributions and beliefs would make her biased in the case.<\/p>\n<p>\u201cThere are clear ethical rules that govern conflict and disqualifications,\u201d Nessel spokeswoman Lynsey Mukomel told The Detroit News earlier this year. \u201cJudge Gleicher disclosed her past associations out of an abundance of caution and correspondence from the Court states Judge Gleicher, \u2018\u2026does not believe this warrants her recusal, and is certain that she can sit on this case with requisite impartiality and objectivity.\u2019\u201d<\/p>\n<p class=\"gnt_ar_b_p\">Under the\u00a0<a class=\"gnt_ar_b_a\" href=\"https:\/\/casetext.com\/rule\/michigan-court-rules\/michigan-code-of-judicial-conduct\/canon-7-a-judge-or-a-candidate-for-judicial-office-should-refrain-from-political-activity-inappropriate-to-judicial-office\" target=\"_blank\" rel=\"noopener\" data-t-l=\":b|e|inline click|${u}\">Michigan code for judicial conduct,<\/a>\u00a0judges may make political contributions, but they cannot endorse a candidate. The Detroit News notes that several Republican judicial appointees have donated to Republican candidates.<\/p>\n<p class=\"gnt_ar_b_p\">Democratic Michigan Governor Gretchen Whitmer, a vocal abortion rights proponent, celebrated the Tuesday ruling as \u201can\u00a0important victory for Michiganders.\u201d<\/p>\n<p>\u201cThe opinion from the\u00a0Michigan Court of Claims is clear and sends the message that Michigan\u2019s 1931 law banning abortion, even\u00a0in cases of rape or incest, should not go into effect even if <em>Roe<\/em> is overturned,\u201d she said. \u201cIt will help ensure that\u00a0Michigan remains a place where women have freedom and control over their own bodies.\u201d<\/p>\n<p>But the work of pro-abortion rights advocates is far from over, Whitmer said.<\/p>\n<p>\u201cI want every Michigander to know: no matter what happens\u00a0in DC, I\u2019m going to fight like hell to protect access to safe, legal abortion in Michigan,\u201d she continued. \u201cThat\u2019s why last month,\u00a0I filed a lawsuit and used my executive authority to urge the Michigan Supreme Court to immediately\u00a0resolve whether Michigan\u2019s state constitution protects the right to abortion once and for all.\u201d<\/p>\n<p>\u201cWhile today\u2019s\u00a0preliminary injunction offers immediate, critical relief, we need the Michigan Supreme Court to weigh in and\u00a0establish the right to abortion under our state constitution,\u201d Whitmer said. \u201cWe must protect the rights of nearly 2.2 million\u00a0women in Michigan to make decisions about their bodies because however we personally feel about\u00a0abortion.
