When asked about the leak of <a href=\"https:\/\/www.dailywire.com\/topic\/samuel-alito\">Justice Samuel Alito<\/a>\u2019s draft opinion and related protests at the Washington-area homes of \u00a0justices expected to vote to overturn <em>Roe v. Wade, <\/em>the landmark 1973 case determining a federal right to abortion, she demurred.<\/p>\n<p>\u201cI can\u2019t answer that,\u201d Jackson answered when asked if leaking the draft opinion \u201cwas a good thing or a bad thing.\u201d<\/p>\n<p>When asked what she thought about the ongoing protests outside the homes of Alito and fellow justices Clarence Thomas, Amy Coney Barrett, Brett Kavanaugh, Neil Gorsuch, and Chief Justice John Roberts, who did not sign the draft opinion, Jackson was equally oblique.<\/p>\n<p>\u201cI don\u2019t have any comment,\u201d she said.<\/p>\n<p>McCarthy, also a Fox News contributor, was scathing in his criticism of Jackson\u2019s refusal to take a position in a <a href=\"https:\/\/www.nationalreview.com\/corner\/judge-jackson-wont-say-dobbs-leak-is-wrong-and-wont-object-to-protests-at-her-soon-to-be-colleagues-homes\/\">National Review column<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING NEWS: Protesters wearing outfits from The Handmaid\u2019s Tale protest outside of anti-choice Supreme Court Justice Amy Coney Barrett\u2019s house to hold her accountable for her stance against Roe v. RT THIS IF YOU SUPPORT THE PROTESTERS!<\/p>\n<p>\u2014 Occupy Democrats (@OccupyDemocrats) <a href=\"https:\/\/twitter.com\/OccupyDemocrats\/status\/1524560588524904448?ref_src=twsrc%5Etfw\">May 12, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cThis ranges from somewhere between cowardly and sinister, much like the failure of the justices to issue a joint statement that echoes the chief justice\u2019s condemnation of the leak and statement of determination to identify the leaker, and that condemns <a href=\"https:\/\/www.nationalreview.com\/corner\/dojs-silence-on-the-lefts-lawless-intimidation-of-supreme-court-justices\/\" target=\"_blank\" rel=\"noopener\" data-testid=\"dynamic-link\">the protests, which violate federal law<\/a>,\u201d McCarthy wrote.<\/p>\n<p>Roberts has ordered an internal investigation into the leak of the opinion in a case called <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>. The case challenges the\u00a0constitutionality of a 2018 Mississippi state law that bans most abortion operations after the first 15 weeks of pregnancy. The draft opinion not only rules in favor of the state law, but overturns <em>Roe v. Wade<\/em> and the 1992 case\u00a0<em>Planned Parenthood v. Casey<\/em>, which affirmed the federal right to abortion.<\/p>\n<p>The final decision could come anytime within the next month or so. But the leak touched off widespread \u00a0pro-abortion protests at both the U.S. Supreme Court and at the homes of justices. The Biden administration has encouraged the protests, but <a href=\"https:\/\/www.dailywire.com\/news\/psaki-on-peaceful-protests-at-supreme-court-justices-homes-we-certainly-continue-to-encourage-that\">called for demonstrators to remain peaceful<\/a>.<\/p>\n<p>Attorney General Merrick Garland last week ordered the\u00a0U.S. Marshal Service to provide additional security protections to Supreme Court justices. Garland acted as Virginia Gov. Glenn Youngkin and Maryland Gov.
