That\u2019s why Justice Ruth Bader Ginsburg and Justice Stephen Breyer have both <a href=\"https:\/\/redstate.com\/nick-arama\/2021\/09\/10\/liberal-justice-stephen-breyer-brings-the-fire-against-dems-who-have-ideas-about-court-packing-n441086\" target=\"_blank\" rel=\"noopener\">spoken out against court-packing <\/a>because they thought that would harm the nature of the court. Democrats don\u2019t care about that integrity, which is why they have been pushing court-packing to take over the Court and <a href=\"https:\/\/redstate.com\/nick-arama\/2022\/05\/10\/wh-makes-despicable-statement-about-protests-at-homes-of-scotus-justices-n562547\" target=\"_blank\" rel=\"noopener\">encouraging marching on the homes of the justices<\/a> to try to affect their vote.<\/p>\n<p>But Justice Clarence Thomas\u2019 new remarks at a judicial conference in Dallas indicate just how badly the leak of the draft opinion dealing with <em>Roe v. Wade<\/em> has hurt the Court.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/clarence-thomas-tremendously-bad-abortion-draft-leak-changed-supreme-court-forever\" target=\"_blank\" rel=\"noopener\">From Fox News: <\/a><\/p>\n<blockquote>\n<p>\u201cI do think that what happened at the court is tremendously bad\u2026 I wonder how long we\u2019re going to have these institutions at the rate we\u2019re undermining them,\u201d Thomas said at the Old Parkland Conference.<\/p>\n<p>The leak \u2014 not the decision\u2019s potential implication of overturning Roe v. Wade \u2014 has potentially done irreparable harm to people\u2019s trust in the institution, the veteran justice said.<\/p>\n<p>\u201cWhen you lose that trust, especially in the institution that I\u2019m in, it changes the institution fundamentally. You begin to look over your shoulder. It\u2019s like kind of an infidelity that you can explain it, but you can\u2019t undo it,\u201d Thomas added.<\/p>\n<p>The high court\u2019s secrecy has been an integral part of the judicial process, allowing justices to deliberate free of outside pressures, he added, noting the members of the court did not think such a leak could even occur.<\/p>\n<p>\u201cOh, that\u2019s impossible. No one would ever do that,\u201d he said, theorizing how people thought of the Supreme Court\u2019s exclusivity prior to the leak.<\/p>\n<p>\u201cNow that trust or that belief is gone forever,\u201d Thomas claimed.<\/p>\n<\/blockquote>\n<p>Thomas also said that he didn\u2019t think you would see conservatives going to Supreme Court justices\u2019 homes, as the left has been doing, \u201cYou would never visit Supreme Court justices\u2019 houses when things didn\u2019t go our way. We didn\u2019t throw temper tantrums. I think it is \u2026 incumbent on us to always act appropriately and not to repay tit-for-tat.\u201d<\/p>\n<p>That\u2019s not good when Thomas is describing this as \u201cinfidelity,\u201d and that \u201ctrust\u201d is gone forever. Infidelity leads to divorce, and it sounds like this has put a bad stake through the heart of the relationships on the Court. It\u2019s also clear that he thinks it was someone on the left, for all the people speculating on who the leaker is. But even beyond that, Joe Biden and the Democrats have harmed the institution by not defending it, indeed trying to undermine it.<\/p>\n<p>Justice Alito<a href=\"https:\/\/www.foxnews.com\/us\/roe-draft-fallout-alito-supreme-court-abortion-protests\" target=\"_blank\" rel=\"noopener\"> said on Thursday<\/a>, \u201cThis is a subject I told myself I wasn\u2019t going to talk about today regarding, you know \u2014 given all the circumstances. The court right now, we had our conference this morning, we\u2019re doing our work. We\u2019re taking new cases, we\u2019re headed toward the end of the term, which is always a frenetic time as we get our opinions out.\u201d<\/p>\n<p>But what was missing from the remarks of both Thomas and Alito was the usual talk about judicial comity, that while justices might disagree, they all get along. That\u2019s another indication that there\u2019s an internal issue that needs to be resolved.<\/p>\n<p>Interestingly, we\u2019ve heard from Chief Justice John Roberts, Clarence Thomas, and even in this limited way, Justice Alito. But who we haven\u2019t heard from is anyone on the left on the Court, not even to just say this was wrong or we\u2019re standing all together as a Court against this. Perhaps they are standing on the comments of Roberts, who condemned it, so they may feel they don\u2019t have to say anything further. But it might go a long way to helping the institution if they spoke out against the leak. That could be an indication that they were coming back from this, still unified.
