Wade. <\/strong><\/li>\n<li><strong>Legal experts told the Daily Caller News Foundation these claims were speculative and pointed to ways the leak has benefitted Democrats.\u00a0<\/strong><\/li>\n<li><strong>\u201cThe most likely leaker was someone on the left\u2014whether a clerk, staffer, or family member of someone at the Court\u2014who wanted to create public protests and otherwise scare Justice Kavanaugh or Barrett away from joining Justice Alito\u2019s majority,\u201d Georgetown Law professor Ilya Shapiro said.<\/strong><\/li>\n<\/ul>\n<p>Efforts in the media to blame a conservative at the Supreme Court for leaking Justice Samuel Alito\u2019s draft opinion revealing the likely overturning of Roe v. Wade are \u201cmisguided,\u201d according to legal experts.<\/p>\n<p>Several media personalities have claimed the leading theory for the <a href=\"https:\/\/dailycaller.com\/2022\/05\/02\/supreme-court-overturn-roe-v-wade-dobbs-jackson-womens-health-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\">leak<\/a> of Justice Samuel Alito\u2019s draft <a href=\"https:\/\/dailycaller.com\/2022\/05\/02\/supreme-court-roe-v-wade-samuel-alito-politico\/\" target=\"_blank\" rel=\"noopener noreferrer\">opinion<\/a> was that a conservative clerk shared it with the media to cement the non-binding majority vote. Legal experts pointed to ways in which the leak has already benefited <a href=\"https:\/\/dailycaller.com\/2022\/05\/05\/democrats-legalize-third-trimester-abortions\/\" target=\"_blank\" rel=\"noopener noreferrer\">Democrats<\/a> and argued that comments on who may have leaked the draft opinion were purely speculative.<\/p>\n<p>\u201cThe most likely leaker was someone on the left\u2014whether a clerk, staffer, or family member of someone at the Court\u2014who wanted to create public protests and otherwise scare Justice Kavanaugh or Barrett away from joining Justice Alito\u2019s majority,\u201d Georgetown Law professor Ilya Shapiro told the Daily Caller News Foundation.<\/p>\n<p>\u201cIt certainly could be someone on the right, with the intent to steel the spine of any wavering justices, but that\u2019s less likely,\u201d he said. \u201cRegardless, at this point, we have nothing to go on and it\u2019s all speculation.\u201d<\/p>\n<p>Mike Davis, former clerk for Justice Neil Gorsuch and president of the Article III Project, said the media\u2019s portrayal of the leak as the likely work of a conservative was serving the left\u2019s interests. <strong><a href=\"https:\/\/dailycaller.com\/2022\/05\/06\/biden-white-house-supreme-court-justice-address-protest-conservative\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden White House Refuses To Condemn \u2018Disgusting\u2019 Efforts To Intimidate SCOTUS Justices)<\/a><\/strong><\/p>\n<p>\u201cWe do not know exactly who leaked the Supreme Court draft Dobbs opinion, but the efforts by the media to portray the leaker as a conservative are misguided and only serve the interests of the left,\u201d Davis told the DCNF. \u201cOver the past decade, the far left has been shattering norms within our government and society, so I would not be surprised if the leaker was an aggrieved staffer who sought to sway a Justice\u2019s opinion to preserve Roe v. Wade\u2019s precedent.\u201d<\/p>\n<p>\u201cThis will have the opposite of that intended effect. It is very telling that Democrats are cheering on this leak and the naturally resulting illegal intimidation and obstruction campaign at the homes of Justices,\u201d he said.<\/p>\n<p><strong>WATCH:\u00a0<\/strong><\/p>\n<p>NPR reporter Nina Totenberg <a href=\"https:\/\/twitter.com\/ThisWeekABC\/status\/1523297721641168896?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1523297721641168896%7Ctwgr%5E%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.washingtonexaminer.com%2Fnews%2Fnprs-nina-totenberg-leading-theory-is-conservative-clerk-leaked-abortion-opinion\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> the leaker was most likely a conservative on ABC\u2019s \u201cThis Week\u201d Sunday.<\/p>\n<p>\u201cThe leading theory is a conservative clerk who was afraid that one of the conservatives might be persuaded by Chief Justice Roberts to join the much more moderate opinion,\u201d she said.\u00a0\u201cAnd then there\u2019s another theory that it was an outraged liberal clerk,\u201d she said. \u201cBut I think the only one that makes sense is that it came from somebody who was afraid that this majority might not hold, that Chief Justice Roberts might persuade one of the conservatives to come over to him in a much more moderate opinion.\u201d<\/p>\n<p>MSNBC host Chris Hayes\u00a0<a href=\"https:\/\/dailycaller.com\/2022\/05\/03\/msnbc-chris-hayes-suggests-conservative-maybe-leaked-roe-v-wade-opinion-politico\/\" target=\"_blank\" rel=\"noopener noreferrer\">suggested<\/a> May 3 that the leak may have come from a conservative and, like Totenberg, thought it may have been intended to solidify the majority vote.<\/p>\n<p>Jonathan Turley, a law professor at George Washington University, emphasized the potential motives that may have driven a liberal to leak the draft opinion and said Totenberg\u2019s statements were based on limited facts.<\/p>\n<p>\u201cTotenberg insists that this was likely an effort of a conservative to lock in the majority to prevent backsliding. Why is that more likely that a liberal clerk trying to induce backsliding or simply trigger a public backlash?\u201d he <a href=\"https:\/\/jonathanturley.org\/2022\/05\/09\/the-only-one-that-makes-sense-nprs-totenberg-claims-the-leading-theory-is-that-the-leaker-is-a-conservative-clerk\/\">wrote<\/a>.<\/p>\n<p>\u201cThe leak immediately resulted in calls to pass the pending legislation to codify Roe v. Wade as well as a massive fundraising campaign by Democrats.
