Kay Ivey signed the law that made providing hormone treatments, transition surgery, or puberty blockers to anyone under 19 years old in the state punishable by up to 10 years in prison.<\/p>\n<p class=\"\">Ivey said in a <a href=\"https:\/\/www.nbcnews.com\/nbc-out\/out-politics-and-policy\/alabama-governor-signs-bill-criminalizing-transgender-health-care-mino-rcna23674\" target=\"_blank\" rel=\"noopener\">statement<\/a> when she signed the bill last month that \u201cif the Good Lord made you a boy, you are a boy, and if he made you a girl, you are a girl.\u201d<\/p>\n<p class=\"\">\u201cWe should especially protect our children from these radical, life-altering drugs and surgeries when they are at such a vulnerable stage in life,\u201d she added.<\/p>\n<p>Republican state Rep. Wes Allen, who sponsored the bill in the Alabama House of Representatives, said in April that the legislation is about protecting minors.<\/p>\n<p id=\"5NWUJ77MEBAEBMFBI7T2IZNMJY\" class=\"article__paragraph article__paragraph--left\">\u201cIt\u2019s about protecting these minors,\u201d Allen <a href=\"https:\/\/www.al.com\/news\/2022\/04\/ban-on-transgender-medical-treatments-for-minors-at-top-of-alabama-house-agenda.html\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cAnd it\u2019s not about adults, but it\u2019s about those minors. Their minds are not fully developed to make these decisions on these medications and surgeries.\u201d<\/p>\n<p>Alabama\u2019s law makes it the second state to attempt to ban puberty blockers for minors, and the first state to enact such a law. In April 2021, Arkansas passed a similar bill that was vetoed by Republican Gov. Asa Hutchinson because he said it was too broad.<\/p>\n<p>\u201cThe law is very similar to legislation passed in Florida banning teachers from teaching on the issues between kindergarten and third grade. Critics dubbed the legislation, signed by Republican Gov. Ron DeSantis, as the \u2018don\u2019t say gay\u201d bill,\u201d Fox News <a href=\"https:\/\/www.foxnews.com\/us\/alabama-law-criminalizing-gender-transition-surgery-drugs-for-minors-takes-effect?intcmp=tw_fnc\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>U.S. District Judge Liles Burke concluded a hearing on Friday regarding a lawsuit by the Human Rights Campaign and GLBTQ Legal Advocates &#038; Defenders that is attempting to temporarily stop enforcement of the law while the suit is pending.<\/p>\n<p>\u201cThe U.S. Department of Justice has joined the case, saying the Alabama law \u2018violated the equal protection clause\u2019 of the U.S. Constitution\u2019s Fourteenth Amendment,\u201d according to a Reuters <a href=\"https:\/\/www.reuters.com\/world\/us\/alabama-ban-gender-affirming-care-transgender-youth-takes-effect-2022-05-09\/\" target=\"_blank\" rel=\"noopener\">report<\/a>.<\/p>\n<p><span>In addition to Alabama, twenty states have similar bills under consideration, <\/span><a href=\"https:\/\/freedomforallamericans.org\/legislative-tracker\/student-athletics\/\"><span>according to<\/span><\/a><span> the group Freedom for All Americans.<\/span><\/p>\n<p>Texas Republican Gov. Greg Abbott ordered state agencies in February to investigate reports of transgender children who have received gender change surgery.<\/p>\n<p>\u201cTexas law imposes reporting requirements upon all licensed professionals who have direct contact with children who may be subject to such abuse, including doctors, nurses, and teachers, and provides criminal penalties for failure to report such child abuse.\u201d Abbott <a href=\"https:\/\/www.documentcloud.org\/documents\/21272649-abbott-letter-to-masters\" target=\"_blank\" rel=\"noopener\">wrote<\/a>\u00a0to the Texas Department of Family and Protective Services.<\/p>\n<p>Texas Attorney General Ken Paxton also released a formal attorney general opinion in February concluding that performing certain \u201csex-change\u201d procedures on children, and prescribing puberty-blockers to them, is \u201cchild abuse\u201d under Texas law.<\/p>\n<p>\u201cThere is no doubt that these procedures are \u2018abuse\u2019 under Texas law, and thus must be halted,\u201d Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/ag-paxton-declares-so-called-sex-change-procedures-children-and-prescription-puberty-blockers-be\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cThe Texas Department of Family and Protective Services (DFPS) has a responsibility to act accordingly.
