In the same way, recent <a href=\"https:\/\/www.breitbart.com\/clips\/2022\/05\/07\/maher-arguing-roe-is-settled-law-is-nonsense-plessy-was-settled-law\/\">comments<\/a> by the very liberal Bill Maher point to ways that we can have a discussion with pro-abortion friends and colleagues without using religious-based arguments.<\/p>\n<p dir=\"ltr\">To be sure, in order to change hearts and minds, we need God\u2019s help. And under no circumstances should we ever back away from our deeply-held, biblically-based convictions about the humanity of the baby within the womb.<\/p>\n<p dir=\"ltr\">At the same time, when talking with people who do not share our religious values or do not hold the Bible in esteem, there are common-sense, logical arguments we can raise that might just get people to rethink their position.\u00a0<\/p>\n<p dir=\"ltr\">At the least, these arguments, especially when tied to people like Rogan and Maher, who are anything but Bible-thumping Christian fundamentalists, might just lower the temperature in the room, allowing for cooler heads to prevail.<\/p>\n<p dir=\"ltr\">Interestingly, it was the late Justice Ruth Bader Ginsburg, herself staunchly pro-abortion, who had warned back in 1992 that Roe was built on a flimsy foundation.<\/p>\n<p dir=\"ltr\">As <a href=\"https:\/\/www.breitbart.com\/clips\/2022\/05\/07\/brooks-roe-was-fragile-and-ginsburg-warned-about-that\/\">pointed out<\/a> by New York Times columnist David Brooks on the PBS NewsHour on May 5, \u201cRuth Bader Ginsburg <a href=\"http:\/\/www.law.nyu.edu\/sites\/default\/files\/ECM_PRO_059254.pdf\">made this point<\/a> back in 1992, that that decision was so big, she said it\u2019s fragile. It\u2019s \u2014 and then law professors, even very pro-choice law professors, have always said, we\u2019re worried about this decision. It\u2019s not a great decision. They liked the outcome. They worried about the decision. So, it was fragile. And so, hanging all that on that decision was always going to be \u2014 it was waiting to go off. And then Alito just ran through it. I \u2014 personally \u2014 there are two separate issues here: Should abortion be a right that people get to enjoy? Should \u2014 does the Constitution guarantee that right? And it\u2019s important to separate those two things.\u201d<\/p>\n<p dir=\"ltr\">In Ginsburg\u2019s own <a href=\"http:\/\/www.law.nyu.edu\/sites\/default\/files\/ECM_PRO_059254.pdf\">words<\/a>, \u201cDoctrinal limbs too swiftly shaped, experience teaches, may prove unstable. The most prominent example in recent decades is Roe v. Wade.\u201d<\/p>\n<p dir=\"ltr\">Boom!<\/p>\n<p dir=\"ltr\">As for saying that Justice Samuel Alito \u201cran through it,\u201d I take Brooks to mean that Alito exposed these very weaknesses in his devastating, leaked opinion. (Prof. Jay Richards rightly <a href=\"https:\/\/twitter.com\/DrJayRichards\/status\/1521640810319695906\">noted<\/a> that, \u201cBecause of the outrage of the leak, etc. Alito&#8217;s opinion has not [yet] gotten enough credit for being an utterly persuasive and accessible piece of legal reasoning. Notice the social media screamers aren&#8217;t engaging his arguments.\u201d)<\/p>\n<p dir=\"ltr\">To <a href=\"https:\/\/www.spectator.co.uk\/article\/full-text-leaked-roe-v-wade-draft-ruling#:~:text=Justice%20Samuel%20Alito%20has%20laid%20out%20the%20case,issue%20of%20abortion%20to%20the%20people%E2%80%99s%20elected%20representatives.\">quote<\/a> Alito directly, \u201cAlthough the Court acknowledged that States had a legitimate interest in protecting \u2018potential life,\u2019 it found that this interest could not justify any restriction on pre-viability abortions. The Court did not explain the basis for this line, and even abortion supporters have found it hard to defend Roe&#8217;s reasoning. One prominent constitutional scholar wrote that he \u2018would vote for a statute very much like the one the Court ended up drafting\u2019 if he were \u2018a legislator\u2019, but his assessment of Roe was memorable and brutal: Roe was \u2018not constitutional law\u2019 at all and gave \u2018almost no sense of an obligation to try to be\u2019. . . .<\/p>\n<p dir=\"ltr\">\u201cAs Justice Byron White aptly put it in his dissent, the decision represented the \u2018exercise of raw judicial power,\u2019 and it sparked a national controversy that has embittered our political culture for a half-century.\u201d<\/p>\n<p dir=\"ltr\">And as a legal colleague of mine mentioned after reading Alito\u2019s 98-page document in full, Alito also cites the views of other liberals who recognized the deficiencies of Roe. Those arguments should be part of our arsenal as well.<\/p>\n<p dir=\"ltr\">Getting back to Joe Rogan, he <a href=\"https:\/\/redstate.com\/beccalower\/2022\/05\/05\/we-can-win-by-listening-to-how-joe-rogan-talks-about-abortion-n560646\">said<\/a>, \u201cI am 100% for a woman\u2019s right to choose. But as a human being, just a person observing things, there\u2019s a big difference between a little clump of cells and a fetus with the eyeball and a beating heart. And for anybody to pretend there\u2019s not.\u201d<\/p>\n<p dir=\"ltr\">Rogan\u2019s guest, comedian Doug Stanhope asked, \u201cWhere do you draw the line?\u201d\u00a0<\/p>\n<p dir=\"ltr\">Rogan replied, \u201cRight. Where do you draw the line? Yeah, that\u2019s the question. It\u2019s what I call a human issue. It\u2019s a very complicated issue. It\u2019s so fraught with emotion. And it\u2019s so political.\u201d<\/p>\n<p dir=\"ltr\">Again, Rogan\u2019s musing represents just one step in the right direction in the midst of his other statements, with which we strongly differ as pro-lifers. But his words do point to the fact that a <a href=\"https:\/\/www.foxnews.com\/politics\/americans-support-abortion-restrictions-poll\">strong majority<\/a> of Americans want some limits on abortion. (On a related note, I believe that if Americans were asked if the states should make their own abortion laws, thereby representing the will of the people in each state, most Americans would agree with this. When they\u2019re asked if Roe should be overturned, most say no, but in my opinion, it\u2019s because they think that would mean a national ban on abortion.)<\/p>\n<p dir=\"ltr\">As for Bill Maher, he said on his Real Time broadcast on May 5, \u201cThis whole [expletive] argument about, well, it\u2019s settled law, so was segregation. Plessy v. Ferguson was settled law in 1896 and thank God somebody said, let\u2019s unsettle it. So, it\u2019s not \u2014 that\u2019s a [expletive] argument. It\u2019s what you think, if you like babies, then you\u2019re pro-life, and if you like women, you\u2019re pro-choice. I like women.\u201d<\/p>\n<p dir=\"ltr\">So, even Maher recognizes that, if your emphasis is on the wellbeing of the baby, then you\u2019ll be pro-life.<\/p>\n<p dir=\"ltr\">He added, \u201cI just \u2014 I feel like\u2026abortion is unique. It is. Because people either \u2014 you just have this view that it\u2019s murder \u2014 I could put the argument on a hat when people talk about a woman\u2019s right, murder isn\u2019t a right. If you think it\u2019s murder \u2014 I don\u2019t \u2014 again, crazy me.\u201d<\/p>\n<p dir=\"ltr\">At the least, using his logic (and quoting him directly), we can ask, \u201cSo, what do you think about what he said? What if you really believe there\u2019s a little baby in there?
