Lindsey Graham said on Sunday that\u00a0<em>Roe v. Wade\u00a0<\/em>created a constitutional right \u201cthat doesn\u2019t exist\u201d when it affirmed the nationwide legalization of abortion.<\/p>\n<p>Graham shared the remarks during an <a href=\"https:\/\/video.foxnews.com\/v\/6305789777112\" target=\"_blank\" rel=\"noopener\">interview<\/a> on \u201cFox News Sunday\u201d with Bret Baier.<\/p>\n<p>\u201cRoe v. Wade created\u00a0a constitutional right that\u00a0doesn\u2019t exist in the written\u00a0constitution,\u201d he said. \u201cIt\u2019s created division from the first day it was decided until\u00a0now.\u201d<\/p>\n<p>The senator also noted that each state would take a different approach if the Supreme Court overturns <em>Roe v. Wade<\/em>.<\/p>\n<p>\u201cDifferent states will take different approaches, so the abortion debate will not go away in the country, it will be decided by the people, not a handful of judges,\u201d he explained.<\/p>\n<p>Graham added that Congress would also have a new role if abortion laws are turned over to individual states.<\/p>\n<p>\u201cCongress will continue to debate this issue, they will finally have control over this,\u201d he said.\u00a0\u201cIf you don\u2019t like the outcome of the abortion debate, now you can kick people out of office who actually vote.\u201d<\/p>\n<p>The South Carolina Republican argued that judges have determined when life begins and ends, but overturning the decision would allow elected officials to be more involved.<\/p>\n<p>\u201cBefore you were shut out. You had no avenue. Five judges, six judges, seven judges determined when life begins and how it ends, and think that was wrong from the start. Now finally elected officials have a say about life and the conditions of abortion. I think that\u2019s the way it should be,\u201d McConnell told Baier.<\/p>\n<p>The leak of an early draft of a Supreme Court majority opinion that indicated Roe v. Wade would likely be struck down was first <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\" target=\"_blank\" rel=\"noopener\">published<\/a>\u00a0by Politico on Monday evening.<\/p>\n<p>\u201cWe hold that\u00a0<i>Roe<\/i>\u00a0and\u00a0<i>Casey<\/i>\u00a0must be overruled,\u201d Justice Samuel Alito wrote in the document, labeled as the \u201cOpinion of the Court.\u201d \u201cIt is time to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives.\u201d<\/p>\n<p>The leaked draft also shows that Alito called\u00a0<em>Roe\u00a0<\/em>wrong from the start.<\/p>\n<p>\u201c<i>Roe<\/i> was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue <i>Roe<\/i>\u00a0and\u00a0<i>Casey<\/i>\u00a0have enflamed debate and deepened division,\u201d Alito presented in the opinion draft.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>South Carolina Republican Sen.
