Wade<\/em> and\u00a0<em>Planned Parenthood v. Casey\u00a0<\/em>would galvanize Democrats and send them to the polls in November may be premature.<\/p>\n<p>To the contrary, a new <a href=\"https:\/\/s3.documentcloud.org\/documents\/21903171\/abortion-politics.pdf\">CNN poll<\/a> suggests that the leaked draft may not increase Democratic turnout in the fast-approaching midterms.<\/p>\n<p>\u201cThe share of registered voters who say they are extremely or very enthusiastic about voting this fall rose 6 points between the first survey and the second, but that increase is about even across party lines,\u201d <a href=\"https:\/\/www.cnn.com\/2022\/05\/06\/politics\/cnn-poll-abortion-midterms-roe-v-wade\/index.html\">CNN reported<\/a>. \u201cAmong Democrats, 43% now say they are extremely or very enthusiastic, up 7 points. Among Republicans, it\u2019s 56%, up 9 points. And voters who say overturning Roe would make them \u2018happy\u2019 are nearly twice as enthusiastic about voting this fall as those who say such a ruling would leave them \u2018angry\u2019 (38% extremely enthusiastic among those happy, 20% among those angry).\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">New CNN polling: Comparing pre- and post-polling, the draft opinion does not appear to have shaken the midterm landscape. <a href=\"https:\/\/t.co\/eLlKUOlc7t\">https:\/\/t.co\/eLlKUOlc7t<\/a><\/p>\n<p>\u2014 Jennifer Agiesta (@jennagiesta) <a href=\"https:\/\/twitter.com\/jennagiesta\/status\/1522668283467649025?ref_src=twsrc%5Etfw\">May 6, 2022<\/a><\/p>\n<\/blockquote>\n<p>The poll also noted that a majority of Americans \u2014 66% \u2014 say that\u00a0<em>Roe<\/em> should not be entirely struck down and 59% would support federal legislation that established a right to abortion nationwide. But that may also be a doomed prospect, given the current makeup of Congress and the likelihood that Republicans <a href=\"https:\/\/dailywire.com\/news\/newt-gingrich-predicts-gop-could-gain-up-to-70-house-seats-in-midterms\/\">will see gains<\/a> rather than losses in November.<\/p>\n<p>As soon as the early opinion draft leaked, people on both sides began to speculate about who might have leaked the draft and why.<\/p>\n<p>Liberals suggested that a conservative clerk <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/05\/05\/who-leaked-supreme-court-abortion\/9643088002\/?gnt-cfr=1\">might have leaked<\/a> the early opinion \u2014 which may or may not reflect the final decision the Court plans to render \u2014 in an effort to pressure the conservative justices to stand by that. Conversely, conservatives suggested that the leak probably came from a liberal clerk, hoping that public outcry might <a href=\"https:\/\/dailywire.com\/news\/wsj-editorial-board-worries-abortion-fanatic-might-commit-an-act-of-violence-to-prevent-a-pro-life-ruling\/\">drive the court<\/a> to change the decision, increase Democratic turnout in November\u2019s midterm elections, or press President Joe Biden and the Democrat-controlled Congress to codify\u00a0<em>Roe<\/em> and pack the Supreme Court before the final decision was announced.<\/p>\n<p>Democrats have already called for Congress to codify\u00a0<em>Roe<\/em>, and have even put forth the\u00a0Women\u2019s Health Protection Act \u2014 but with a 50\/50 split in the Senate and Vice President Kamala Harris as the tie-breaker, such a measure cannot pass without every Democrat also voting to end the Senate filibuster or at least agree to a carve-out for this specific issue.<\/p>\n<p>Senator Joe Manchin (D-WV) has already said that he <a href=\"https:\/\/dailywire.com\/news\/manchin-sinema-dodge-far-left-calls-to-break-filibuster-to-pass-abortion-bill\/\">would not vote<\/a> to end the filibuster in order to pass a federal law sustaining abortion rights \u2014 and without him, the Democrats\u2019 only hope would be to win over Republicans like Senator Susan Collins (R-ME) who <a href=\"https:\/\/www.cnn.com\/2022\/05\/05\/politics\/susan-collins-democrat-abortion-rights-bill\/index.html\">voiced disappointment<\/a> in Justices Neil Gorsuch and Brett Kavanaugh, saying that if they had voted to overturn\u00a0<em>Roe<\/em>, that was \u201ccompletely inconsistent\u201d with the answers they gave on the subject during their confirmation hearings.<\/p>\n<p>But Collins, who introduced her own measure to codify\u00a0<em>Roe<\/em> with Senator Lisa Murkowski (R-AK), has already the Democrats\u2019 bill is \u201ctoo broad\u201d and makes no provisions for issues of conscience.<\/p>\n<p>\u201cIt supersedes all other federal and state laws, including the conscience protections that are in the Affordable Care Act,\u201d Collins explained. \u201cIt doesn\u2019t protect the right of a Catholic hospital to not perform abortions.
