Wade<\/em>, California\u2019s left-wing governor pledged to \u201cfight like hell\u201d to save abortion access with the same three words that provoked a <a href=\"https:\/\/thefederalist.com\/2021\/02\/13\/senate-acquits-trump-for-second-time-one-year-after-first-pointless-impeachment\/\">snap impeachment <\/a>of former President Donald Trump.<\/p>\n<p>\u201cOur daughters, sisters, mothers, and grandmothers will not be silenced,\u201d <a href=\"https:\/\/twitter.com\/GavinNewsom\/status\/1521299313808216064?s=20&#038;t=470xitohLKY4-xs_umTV6w\">said <\/a>Gov. Gavin Newsom. \u201cThis world is about to hear their fury. California will not sit back. We are going to fight like hell.\u201d<\/p>\n<p>Newsom pledged California would become a sanctuary for out-of-state abortion, <a href=\"https:\/\/www.nytimes.com\/interactive\/2022\/us\/abortion-bans-restrictons-roe-v-wade.html\">surrounded<\/a> by states with trigger laws restricting access to the deadly procedure upon the repeal of <em>Roe v. Wade<\/em>. The state had already been gearing up for Roe\u2019s reversal after the 6-3 conservative Supreme Court heard arguments in a case to contest a Mississippi abortion ban beyond 15 weeks last December, <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em>. The Guttmacher Institute, a pro-abortion research non-profit, <a href=\"https:\/\/states.guttmacher.org\/#california\">estimates <\/a>out-of-state abortions in California could swell from 46,000 annually to more than 1.4 million, primarily from Arizona. <\/p>\n<p>Here are four bills California lawmakers are determined to pass to make Newsom\u2019s vision of the Golden state as the abortion capital of the country a reality: <\/p>\n<h2>Decriminalized Infanticide <\/h2>\n<p>The left-ward lurch provoked by the elimination of <em>Roe v. Wade<\/em> as standing precedent has led California lawmakers to propose legislation that not just expands abortion access but decriminalizes infanticide.<\/p>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB2223\">Assembly bill 2223<\/a>, proposed by Oakland-area Rep. Buffy Wicks in February, removes safeguards for unsupervised abortions and bars the criminal investigation of fetal deaths even after birth. The bill, now on its way to the Committee on Appropriations, already passed the Assembly Judiciary Committee and the Assembly Health Committee.<\/p>\n<p>Rep. Wicks and her <a href=\"https:\/\/www.latimes.com\/california\/newsletter\/2022-05-05\/california-abortion-bill-ab-2223-essential-california\">allies<\/a> in the left-wing press have sought to dispel claims her legislation opens the door to legal infanticide, <a href=\"http:\/\/claims it does not legalize infanticide but \u201cprotects reproductive freedom by clarifying that the Reproductive Privacy Act prohibits pregnancy criminalization.\u201d\">arguing<\/a> instead the bill \u201cprotects reproductive freedom by clarifying that the Reproductive Privacy Act prohibits pregnancy criminalization.\u201d<\/p>\n<p>The bill\u2019s text, however, is explicit with a prohibition on \u201cusing the coroner\u2019s statements on the certificate of fetal death to establish, bring, or support a criminal prosecution or civil cause of damages against any person,\u201d related to deaths from a \u201cknown or suspected self-induced or criminal abortion.\u201d Criminal liabilities are also eliminated for \u201cactions or omissions\u201d associated with pregnancy or pregnancy outcomes. <\/p>\n<p>Section 7 of the bill outlines the extent of protections for individuals who terminate their own pregnancies stretching to after-birth.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>The Legislature finds and declares that every individual possesses a fundamental right of privacy with respect to personal reproductive decisions, which entails the right to make and effectuate decisions about all matters relating to pregnancy, including prenatal care, childbirth, postpartum care, contraception, sterilization, abortion care, miscarriage management, and infertility care. \u2026<\/p>\n<p>Notwithstanding any other law, a person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights under this article, based on their actions or omissions with respect to their pregnancy or actual, potential, or alleged pregnancy outcome, including miscarriage, stillbirth, or abortion, or perinatal death due to a pregnancy-related cause.<\/p>\n<\/blockquote>\n<p>Legal experts hold varying definitions of \u201cperinatal period\u201d but all include some time after birth. The California Welfare &#038; Institutions Code <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=WIC&#038;sectionNum=14134.5.&#038;article=4.&#038;highlight=true&#038;keyword=PERINATAL\">defines<\/a> the term as \u201cthe period of the establishment of pregnancy to one month following delivery.\u201d The California Department of Public Health regulates \u201cperinatal services\u201d up to 60 days after birth. <\/p>\n<p>The Sacramento Bee <a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article260528472.html\">rated<\/a> claims that Wick\u2019s legislation would legalize infanticide as \u201cfalse\u201d while conceding in its own description of the ruling the \u201cperinatal period\u201d extends beyond birth by the California Welfare &#038; Institutions Code. <\/p>\n<h2>Abortion as a Californian Constitutional Right<\/h2>\n<p>On Wednesday, Newsom announced with assembly leadership that state lawmakers would pursue an amendment to the California Constitution protecting access to abortion.<\/p>\n<p>\u201cWe can\u2019t trust SCOTUS to protect the right to abortion, so we\u2019ll do it ourselves,\u201d Newsom wrote on Twitter.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"Y8lMiqSkCsvQ3r9E\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">NEW: We are proposing an amendment to enshrine the right to choose in the California constitution.<\/p>\n<p>We can\u2019t trust SCOTUS to protect the right to abortion, so we\u2019ll do it ourselves.<\/p>\n<p>Women will remain protected here. <a href=\"https:\/\/t.co\/WTUpfymLS0\">https:\/\/t.co\/WTUpfymLS0<\/a><\/p>\n<p>\u2014 Gavin Newsom (@GavinNewsom) <a href=\"https:\/\/twitter.com\/GavinNewsom\/status\/1521358301794947072?ref_src=twsrc%5Etfw\">May 3, 2022<\/a><\/p><\/blockquote>\n<p><\/span>\n<\/div>\n<\/figure>\n<p>Passage will require supermajorities in both houses of the Democrat-dominated legislature by June 30 to make it in front of voters by November as a statewide ballot measure. <\/p>\n<p>Adoption would mostly be symbolic, given abortion is unlikely to ever become illegal in the state unless Congress were to pass a federal ban in the absence of <em>Roe<\/em> as standing precedent. Republicans, however, have largely expressed the issue as one that belongs to the states to regulate, a position reiterated in the draft opinion authored by Justice Samuel Alito.<\/p>\n<h2>Taxpayer-Funded Cross-Country Abortion Holidays<\/h2>\n<p>Democrat State Sen. Nancy Skinner of Berkeley <a href=\"https:\/\/sd09.senate.ca.gov\/news\/20220317-sen-skinner-announces-sb-1142-expanding-access-abortions-ca\">introduced<\/a> legislation in March to empower out-of-state residents to travel to California for abortions funded by state tax dollars. <\/p>\n<p>The proposed law, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SB1142\">Senate Bill 1142<\/a>, establishes a government website to navigate access to abortions in California while offering taxpayer dollars to out-of-state residents who seek the procedure. The state travel fund offered to both in- and out-of-state residents covers \u201cairfare, lodging, ground transportation, gas money, meals, dependent childcare, doula support, and translation services, to help a person access and obtain an abortion.\u201d<\/p>\n<p>Skinner\u2019s bill passed both the state Senate Health and Judiciary Committees in April.<\/p>\n<h2>From \u2018Safe, Legal, And Rare,\u2019 to Common and Unregulated<\/h2>\n<p>In March, California State Senate Pro Tempore Toni Atkins, a Democrat from San Diego, proposed a law to lower supervision requirements for abortions in the first trimester. <\/p>\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220SB1375\">Senate bill 1375<\/a> allows certified nurse practitioners to execute abortions within the first trimester of pregnancy without a supervising physician. To qualify for carrying out the procedure, nurse practitioners must have practiced medicine for at least three years or 4,600 hours. <\/p>\n<h2>Civil Protections for Abortion<\/h2>\n<p>After Texas passed one of the most restrictive abortion laws in the country last fall <span><span><u>without interferen<\/u><\/span>ce<\/span> from the Supreme Court, California lawmakers proposed legislation to counter the rival state\u2019s policy that empowers residents to enforce the measure on behalf of the unborn. <\/p>\n<p>In Texas, citizens may sue abortion clinics for violating the state\u2019s ban on the fatal procedure after six weeks of pregnancy. Citizens who press charges may earn $10,000 per violation from the culprit clinics or providers if successful.<\/p>\n<p>One month after the Supreme Court refused to strike down the law, California Democrat Rep. Rebecca Bauer-Kahan proposed a bill to offer civil protections for patients and providers, shielding them from out-of-state retaliation in California.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Tristan Justice is the western correspondent for The Federalist.
