As The New York Times pointed out, some states <\/span><a href=\"https:\/\/www.nytimes.com\/interactive\/2022\/us\/abortion-bans-restrictons-roe-v-wade.html\"><span>had<\/span><\/a><span> abortion bans in place before the <\/span><i><span>Roe <\/span><\/i><span>decision took effect in 1973, including Michigan, Alabama, Arizona, West Virginia, and Wisconsin. If <\/span><i><span>Roe<\/span><\/i><span> is overturned, as is expected, those old laws could become active again.\u00a0<\/span><\/p>\n<p><span>Michigan Democratic Gov. Gretchen Whitmer already filed a lawsuit asking the state Supreme Court to clear up the issue, and she is openly pro-choice. Wisconsin Gov. Tony Evers \u2013 a Democrat \u2013 has <\/span><a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/wisconsin-s-democratic-governor-vetoes-five-gop-abortion-bills-n1285350\"><span>vetoed<\/span><\/a><span> pro-life bills in the past.\u00a0<\/span><\/p>\n<p><span>Other states put abortion <\/span><a href=\"https:\/\/www.nytimes.com\/interactive\/2022\/us\/abortion-bans-restrictons-roe-v-wade.html\"><span>bans<\/span><\/a><span> on the books after <\/span><i><span>Roe<\/span><\/i><span>,<\/span> <span>with the intention that they would likely go into effect if the Supreme Court let the<\/span><span>m. These are often called \u201ctrigger\u201d laws. They have different parameters, but those states include Arkansas, Idaho, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, Oklahoma, South Dakota, Tennessee, Texas, Utah, and Wyoming.\u00a0<\/span><\/p>\n<p><span>According to Guttmacher, seven states have \u201claws that express the intent to restrict the right to legal abortion to the maximum extent permitted by the U.S. Supreme Court in the absence of Roe,\u201d and nine states have post-Roe limitations that are currently blocked in the courts.<\/span><\/p>\n<p><span>Four states, including Alabama, Louisiana, Tennessee, and West Virginia, have amended their state constitutions to specifically exclude the right to an abortion.\u00a0<\/span><\/p>\n<p><span>Some states have moved in the opposite direction to expand access to abortion, and make it even more accessible to women, especially for women who may travel from more restrictive states to obtain the procedure.\u00a0<\/span><\/p>\n<p><span>Four states have moved to allow abortion throughout the full term of pregnancy, including Colorado, New Jersey, Oregon, and Vermont. The District of Columbia also has this provision.<\/span><\/p>\n<p><span>Colorado and California in particular have some of the most permissive laws. Colorado recently<\/span> <a href=\"https:\/\/www.dailywire.com\/news\/colorado-codifies-access-to-abortion-into-law-says-the-pre-born-do-not-have-rights\"><span>passed<\/span><\/a><span> a bill that specifically states that a fetus does<\/span> <span>not<\/span> <span>have human rights prior to birth.<\/span><\/p>\n<p><span>California Gov. Gavin Newsom has expressed a goal for California to become a destination for abortion if and when women are restricted in neighboring states. C<\/span><span>alifornia Democrats in the state legislature have also pushed for a bill that bars the state from fully investigating perinatal deaths, including infant deaths within the first week of birth.\u00a0<\/span><\/p>\n<p><span>As The Daily Wire previously <\/span><a href=\"https:\/\/www.dailywire.com\/news\/california-democrats-are-pushing-a-bill-opening-the-door-to-decriminalizing-infanticide-pro-lifers-warn\"><span>reported<\/span><\/a><span>, the bill, \u201c<\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2223\"><span>AB 2223<\/span><\/a><span>, which passed the Assembly Health Committee on Tuesday, states that mothers cannot be held liable for either civil or criminal penalties \u2018based on their actions or omissions\u2019 connected to a \u2018perinatal death due to a pregnancy-related cause.\u2019\u201d<\/span><\/p>\n<p><span>Earlier this year, Newsom also <\/span><a href=\"https:\/\/www.gov.ca.gov\/2022\/03\/22\/governor-newsom-signs-legislation-to-eliminate-out-of-pocket-costs-for-abortion-services\/\"><span>signed<\/span><\/a><span> the Abortion Accessibility Act, wh<\/span><span>ich in most situations,<\/span> <a href=\"https:\/\/www.dailywire.com\/news\/california-moves-radical-on-abortion\"><span>makes abortion <\/span><\/a><span>taxpayer funded.\u00a0<\/span><\/p>\n<p><b><\/b><span>Politico <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\">leaked <\/a><\/span><span>a draft majority opinion titled, \u201cOpinion of the Court\u201d written by Justice Samuel Alito, and joined by the four other conservative-leaning justices. Alito wrote, \u201cWe hold that <\/span><i><span>Roe<\/span><\/i><span> and <\/span><i><span>Casey<\/span><\/i><span> must be overruled,\u201dadding, \u201cIt is time to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives.\u201d\u00a0<\/span><\/p>\n<p><span>If this decision becomes final, it will be up to each state to legislate whether or how they want to limit abortion access.<\/span><\/p>\n<p><span>If <\/span><i><span>Roe<\/span><\/i><span> is overturned, local voters will be able to decide their own rules based on their values. Based on opinion polling, the majority of Americans, almost 7 in 10, favor having some access to abortion.<\/span><\/p>\n<p><span>More than half of voters think the limit should be around 15 weeks, however, which is comparable to the standard throughout most of Europe.
