Danny McCormick, a Republican \u2014 would acknowledge \u201cthe sanctity of innocent human life, created in the image of God, which should be equally protected from fertilization to natural death.\u201d To ensure \u201cthe right to life and equal protection of the laws\u201d for all preborn babies, it applies statutes about homicide to children in the womb.<\/span><\/p>\n<p><span>On Wednesday, lawmakers on the Louisiana House\u2019s criminal justice committee <\/span><a href=\"https:\/\/house.louisiana.gov\/H_Video\/VideoArchivePlayer?v=house\/2022\/may\/0504_22_CJ\"><span>advanced<\/span><\/a><span> the bill by a 7-2 vote. In an interview with The Daily Wire, Pastor Jeff Durbin \u2014 the head of Christian ministry <\/span><a href=\"http:\/\/endabortionnow.com\"><span>End Abortion Now<\/span><\/a><span>, which motivated the legislation \u2014 explained that the Abolition of Abortion in Louisiana Act is based upon \u201cindisputable, biological fact.\u201d<\/span><\/p>\n<p><span>\u201cAll human life begins at conception. The only difference between what happens at conception and where you are as an adult is a difference of degree,\u201d he said. \u201cSo this provides a standard for the protection of human life in the state of Louisiana. It says if you\u2019re human, you deserve equal protection \u2014 which is something that we would hope everybody could agree with, because we have a history in our own nation of saying somebody is technically human, but does not deserve equal protection under the law \u2026 that\u2019s what they did to our black brothers and sisters with slavery.\u201d<\/span><\/p>\n<p><span>\u201cAnd so we all agree with the abominable character of that kind of belief system,\u201d he continued. \u201cFrom a biblical and a legal standpoint, the unjustified taking of human life is murder. And so this law properly places the unjustified taking of a preborn life into the category of homicide, where it belongs.\u201d<\/span><\/p>\n<p><span>Durbin asserted that passing legislation like the Abolition of Abortion in Louisiana Act ought to be the ultimate goal of the pro-life movement \u2014 especially as the Supreme Court <\/span><a href=\"https:\/\/www.dailywire.com\/news\/breaking-supreme-court-strikes-down-roe-v-wade-decision-in-draft-of-majority-opinion-report-says\"><span>appears poised to overturn <\/span><i><span>Roe v. Wade<\/span><\/i><\/a><span>, as indicated by a leaked draft majority opinion written by Justice Samuel Alito on <\/span><i><span>Dobbs v. Jackson Women\u2019s Health Organization<\/span><\/i><span>.<\/span><\/p>\n<p><span>\u201cThe pro-life industry, ultimately by profession, should agree with this law \u2014 because what they argue for in the national conversation \u2026 is that what\u2019s in the womb is human from conception and all life deserves protection. This is a piece of legislation that the pro-life industry <\/span><i><span>should <\/span><\/i><span>agree with, but they haven\u2019t been fighting <\/span><i><span>Roe v. Wade<\/span><\/i><span> consistently with their profession,\u201d Durbin argued. \u201cThis is the bill that essentially would codify what we\u2019ve been saying \u2014 that it\u2019s human from conception and that all human life deserves equal protection.\u201d<\/span><\/p>\n<p><span>Louisiana\u2019s current pro-life \u201ctrigger bill\u201d \u2014 the Human Life Protection Act \u2014 would only penalize abortionists with $1,000 fines, even as animal cruelty is fined at up to $25,000 in Louisiana.\u00a0<\/span>Meanwhile, Louisiana Right to Life \u2014 one of the state\u2019s leading pro-life lobbies \u2014 currently <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2022\/05\/05\/louisiana-abortion-bill-would-make-crime-murder\/9656102002\/\">opposes<\/a> the Abolition of Abortion in Louisiana Act.<\/p>\n<p><span>\u201cIt goes to show the necessity of consistent legislation in the state,\u201d Durbin commented, \u201cbecause people will often tout some of these incremental laws as victories \u2014 but ultimately there\u2019s partiality in saying things like \u2018You can kill this human, but not this human.\u2019 Or, in some cases, it won\u2019t even make it criminal. For example, in states like Texas and Oklahoma, you\u2019ll have a heartbeat bill that says if the abortionist or his staff finds a heartbeat, that they cannot kill the child. You\u2019re leaving it up to the abortionist, who gets paid as to whether or not he finds the heartbeat. But not only that, you\u2019re also saying that what makes you human and valuable and worthy of protection is whether your heart is working. That\u2019s going to be devastating as you get older in life and your heart fails.\u201d<\/span><\/p>\n<p><span>Durbin again emphasized that the Abolition of Abortion in Louisiana Act is \u201c<\/span><i><span>the <\/span><\/i><span>bill that we\u2019ve all said for 50 years that needs to take place.\u201d<\/span><\/p>\n<p><span>\u201cIt\u2019s a bill of equal protection for all humans from conception,\u201d he said. \u201cIt properly classifies what\u2019s in the woman as human from conception, and it properly offers equal protection and it says that \u2018If you kill a human in this state in an unjustified manner, you\u2019re going to be guilty of homicide.\u2019\u201d<\/span><\/p>\n<p><span>The legislation also revises Louisiana statute to clarify that fertilization \u2014 rather than implantation \u2014 is the beginning of human life. The bill therefore has implications for in-vitro fertilization (IVF) and forms of birth control that prevent implantation of fertilized eggs.<\/span><\/p>\n<p><span>\u201cSo-called conservatives that would oppose this bill are showing their cards. They don\u2019t believe that it\u2019s all human life,\u201d Durbin said. \u201cThey\u2019ll say that to get votes and donations, but now you\u2019re seeing the revelation as to whether they actually believe it\u2019s human life. It\u2019s an indisputable biological fact that what is in the womb is human from conception. You cannot overcome that. And so, when it comes to questions about abortifacient birth controls and IVF \u2014 it\u2019s actually not really a problem in terms of what we believe fundamentally. If we believe it\u2019s coming from conception, then yes, we should be concerned about any birth control that actually allows for the creation of human life and the destruction of human life.\u201d<\/span><\/p>\n<p><span>Durbin said that the bill calls IVF providers to moral consistency.<\/span><\/p>\n<p><span>\u201cWhen it comes to IVF, it is really fascinating because it is such a blessing that through medical technology, we\u2019ve been able to work for the preservation of human life,\u201d Durbin said. \u201cIf you have a couple that cannot get pregnant on their own, we have a medical system that can actually help them create and preserve human life. That\u2019s a huge gift to us. We so value new human life and its creation that maybe we need to adjust some of our standards \u2026 Let\u2019s not just create life and then destroy it like it doesn\u2019t matter. So this particular piece of legislation actually <\/span><i><span>highlights <\/span><\/i><span>the main principles that the IVF industry is depending on \u2014 that human life is valuable and needs to be preserved.\u201d<\/span><\/p>\n<p><span>Another noteworthy component of the Abolition of Abortion in Louisiana Act is a provision stating that it would \u201ctreat as void\u201d any federal laws or court rulings \u2014 namely, <\/span><i><span>Roe v. Wade<\/span><\/i><span> and its judicial progeny \u2014 that \u201cdeprive an unborn child of the right to life or prohibit the equal protection of such right.\u201d<\/span><\/p>\n<p><span>\u201cThis bill ultimately would defy the opinion of <\/span><i><span>Roe<\/span><\/i><span>,\u201d Durbin said. \u201cWhether <\/span><i><span>Roe <\/span><\/i><span>is ultimately overturned or not, this law would defy the tyrannical and erroneous opinion of <\/span><i><span>Roe, <\/span><\/i><span>and it would do it lawfully. <\/span><i><span>Roe v. Wade<\/span><\/i><span> is not a law \u2014 only Congress can create law in our country, and the Supreme Court does not have the power of legislation. So no law came from <\/span><i><span>Roe v. Wade<\/span><\/i><span>.\u201d<\/span><\/p>\n<p><span>Durbin argued that \u201cthe people who understand that best are actually the people on the Democratic side.\u201d Indeed, President Joe Biden and Democratic leaders in the Senate are presently <\/span><a href=\"https:\/\/www.dailywire.com\/news\/schumer-senate-democrats-will-force-a-vote-on-abortion-law-next-week\"><span>seeking to codify <\/span><i><span>Roe<\/span><\/i><\/a> <span>as federal statute.<\/span><\/p>\n<p><span>\u201cWe have a history in our nation of resisting the opinion of the Supreme Court when it is clearly tyrannical, fallacious, and unjust,\u201d Durbin continued. \u201cThe best case to point to is <\/span><i><span>Dred Scott v. Sandford<\/span><\/i><span>. In that ruling, the Supreme Court said that black people were property, and that northern states needed to return slaves who had run away from the southern states. And thank God \u2014 <\/span><i><span>thank God<\/span><\/i><span> \u2014 the states of the North resisted the opinion of the Supreme Court and said, \u2018No, we will not yield to your opinion, that is unjust and immoral.\u2019 And so they resisted the Supreme Court\u2019s ruling.\u201d<\/span><\/p>\n<p><span>\u201cGod\u2019s Word defines what\u2019s in the womb and demands the preservation of human life,\u201d he added, \u201cand these legislators swore an oath not to the Supreme Court, but to the Constitution. The constitutional standards guarantee <\/span><i><span>the right to life<\/span><\/i><span>. So if the Supreme Court violates the Constitution, then the standard has been \u2014 in Christian tradition moving into the American governance system \u2014 <\/span><i><span>lex rex<\/span><\/i><span>, the law is king.\u201d<\/span><\/p>\n<p><span>The Abolition of Abortion in Louisiana Act has gained attention from mainstream and international outlets, including <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/05\/05\/us\/louisiana-abortion-bill-homicide.html\"><span>The New York Times<\/span><\/a><span>, <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2022\/may\/05\/louisiana-abortion-bill-murder-republicans\"><span>The Guardian<\/span><\/a><span>, and <\/span><a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/05\/05\/louisiana-republicans-advance-bill-that-would-charge-abortion-homicide\/\"><span>The Washington Post<\/span><\/a><span>. According to Durbin, progressives\u2019 opposition to the bill fell flat because they \u201cmount an argument against the indisputable biological fact that it\u2019s human from conception.\u201d<\/span><\/p>\n<p><span>\u201cWe\u2019re not finding any ability among the Left to argue with the substance of the bill,\u201d Durbin said. \u201cThey avoid the substance and start appealing to emotional arguments \u2014 typical things like rape, incest, and life of the mother, which only accounts for about 2% of abortions. The other 98% are at-will \u2014 for no stated reason at all \u2014 and so they\u2019re appealing to a very small, limited number of reasons for abortion, that are arguments in order to derive emotional opposition to the bill.\u201d<\/span><\/p>\n<p><span>\u201cOn the issue of rape, we don\u2019t believe that you should give capital punishment to the child for the sins of the father,\u201d Durbin continued. \u201cWe think we should prosecute the rapist and not the child, who had nothing to do with this. There are plenty of people alive today who are the products of rape and were very grateful that they weren\u2019t killed. On the issue of incest, I have friends who are products of incest, and I don\u2019t think we should kill them.\u201d<\/span><\/p>\n<p><span>\u201cWhen it comes to the life of the mother, that is an instance that is so infinitesimally small, yet they use that as a primary reason to resist legal protection for all humans. It goes to show that their real opposition to the bill is that they want to be able to kill children in the womb at will,\u201d he added. \u201cWhen someone says, \u2018This would make somebody who is in medical danger because of an ectopic pregnancy guilty of homicide\u2019 \u2014 it\u2019s another fallacy. When there actually is a medical emergency, doctors are trying to work on the preservation of human life for <\/span><i><span>both <\/span><\/i><span>patients \u2014 the mother and the baby. And if it becomes a rescue operation \u2014 an operation for the preservation of life, not the taking of human life \u2014 mothers go into the hospital to receive care from doctors who have a fundamental commitment to <\/span><i><span>do no harm<\/span><\/i><span>.\u201d<\/span><\/p>\n<p><span>Durbin also rejected the assumption that the bill would criminalize women who have miscarriages.<\/span><\/p>\n<p><span>\u201cMiscarriages and stillbirths are classified as natural deaths and don\u2019t fall under the penalties for a bill of equal protection for all human life. When a woman has a miscarriage, it is such a heartbreaking situation and is through no fault of her own. It\u2019s heartbreaking. My son \u2014 he just experienced that in his marriage, and it\u2019s terrible. There was no taking away from the child with malice aforethought. When someone on the Left looks at a bill like this and attempts to pull our emotional heartstrings to resist it by saying, \u2018What about miscarriages?\u2019 \u2014 well, there\u2019s no attempt on the part of the mother in a miscarriage to purposefully take away the life of her child in an unjustified manner. That\u2019s heartbreaking. This bill has nothing to do with that.\u201d<\/span><\/p>\n<p><span>\u201cWhat you\u2019re seeing is that the Left cannot respond to the <\/span><i><span>substance <\/span><\/i><span>of the bill \u2014 that what\u2019s in the womb is human life from conception,\u201d Durbin concluded. \u201cThey can\u2019t do it. And so what they\u2019re appealing to is red herrings and emotionally driven arguments to try to sway the public.
