Susan Collins (R-ME) might be a pro-choice Republican, but that does not mean she supports the Democratic Party\u2019s latest attempt to codify <em>Roe v. Wade<\/em> into federal law.<\/p>\n<p>On Wednesday, Majority Leader Senator Chuck Schumer (D-NY) announced that the Senate would vote on the Women\u2019s Health Protection Act (WHPA). That act \u201cwould establish a right to abortion through all nine months of pregnancy in all 50 states,\u201d National Review <a href=\"https:\/\/www.nationalreview.com\/2022\/05\/schumer-will-hold-another-vote-on-radical-abortion-bill\/\">reported<\/a>.<\/p>\n<p>On Thursday, Collins told media reporters that she has serious concerns about the bill.<\/p>\n<p>\u201cIt supersedes all other federal and state laws, including the conscience protections that are in the Affordable Care Act,\u201d Collins <a href=\"https:\/\/www.cnn.com\/2022\/05\/05\/politics\/susan-collins-democrat-abortion-rights-bill\/index.html?utm_source=facebook&#038;utm_medium=news_tab\">lamented<\/a>.<\/p>\n<p>\u201cIt doesn\u2019t protect the right of a Catholic hospital to not perform abortions. That right has been enshrined in law for a long time,\u201d she also explained.<\/p>\n<p>For his part, Schumer denied that the bill would force Catholic hospitals to provide abortions.<\/p>\n<p>\u201cSome are saying that this legislation would tell hospitals \u2014 certain religious hospitals \u2014 that they have to perform abortions,\u201d Schumer <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/05\/05\/sen-collins-voices-opposition-legislation-that-would-create-statutory-right-abortion\/?utm_source=twitter&#038;utm_campaign=wp_main&#038;utm_medium=social\">said<\/a> on Thursday. \u201cThat is simply not true. This bill simply gives providers the statutory right to provide abortion care without medically unnecessary restrictions. That\u2019s plain and simple. So, this rumor is false.\u201d<\/p>\n<p>The House version of the bill H.R. 2975, which passed last September, does indeed imply that Catholic doctors who do not perform abortions could lose access to public funds.<\/p>\n<p>\u201cUnder H.R. 2975, doctors and nurses who conscientiously refuse to participate in abortion could lose their jobs and Catholic and other religious hospitals could be forced to provide abortions or lose public funds,\u201d The Charlotte Lozier Institute <a href=\"https:\/\/lozierinstitute.org\/ten-things-you-need-to-know-about-hr-2975\/#_Toc32252705\">reported<\/a> at the time.<\/p>\n<p data-qa=\"drop-cap-letter\" data-el=\"text\">\u201cSection 4(a)(10) creates a statutory right to provide an abortion without any limitation \u2018on a health care provider\u2019s ability to provide immediate abortion services when that health care provider believes, based on the good-faith medical judgment of the provider, that delay would pose a risk to the patient\u2019s health,&#8217;\u201d Lozier explained.<\/p>\n<p>\u201cAs defined in Section 3(2), the term \u2018health care provider\u2019 includes entities as well as individuals,\u201d the research non-profit continued. \u201cLaws that prohibit hospitals and other entities from discriminating against doctors and nurses who conscientiously refuse to participate in abortion would fail under H.R. 2975 if the entity health care provider could show that such laws limit its ability to provide \u2018immediate\u2019 abortion services and it believes based on it.\u201d<\/p>\n<p>National Review also <a href=\"https:\/\/www.nationalreview.com\/2022\/05\/schumer-will-hold-another-vote-on-radical-abortion-bill\/\">noted<\/a> that the House version of the bill \u201cis doomed in the Democratic Senate. It has the support of only 48 or 49 senators.\u201d<\/p>\n<p>Collins, as well as Sen. Lisa Murkowski (R-AK), have introduced their own bill that is a weakened version of the WHPA.
