Richard Blumenthal and cosponsored by 47 other Senate Democrats, would create a right to <a href=\"https:\/\/dailycaller.com\/2022\/05\/04\/planned-parenthood-abortion-lobby-naral-democrats-roe-v-wade\/\">abortions<\/a> before viability, which is generally defined at around six months. It would also effectively bar states from outlawing abortion even in the third trimester if a health care worker says the pregnancy is bad for the mother\u2019s mental or physical health.<\/p>\n<p>Senate Majority Leader Chuck Schumer said the Senate would vote on the bill next week, Politico <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/04\/senate-abortion-vote-manchin-collins-problems-00030148?\" target=\"_blank\" rel=\"noopener noreferrer\">reported<\/a>. A leaked Supreme Court draft opinion <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\" target=\"_blank\" rel=\"noopener noreferrer\">published<\/a> by Politico Monday revealed that justices would likely overturn Roe v. Wade, intensifying Democrats\u2019 push to codify abortion rights into federal law.<\/p>\n<p>The bill would <a href=\"https:\/\/www.congress.gov\/117\/bills\/s1975\/BILLS-117s1975is.xml\">ban<\/a> \u201cprohibition[s] on abortion after fetal viability when, in the good-faith medical judgment of the treating health care provider, continuation of the pregnancy would pose a risk to the pregnant patient\u2019s life or health.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">via <a href=\"https:\/\/twitter.com\/alizaslav?ref_src=twsrc%5Etfw\">@alizaslav<\/a>: Senate Majority Leader Chuck Schumer just announced the Senate will vote next week on a version of the Women\u2019s Health Protection Act.<\/p>\n<p>The legislation has no real path forward in the current split 50-50 chamber.<\/p>\n<p>\u2014 Daniella Diaz (@DaniellaMicaela) <a href=\"https:\/\/twitter.com\/DaniellaMicaela\/status\/1522251708528836611?ref_src=twsrc%5Etfw\">May 5, 2022<\/a> <\/p>\n<\/blockquote>\n<p>The legislation does not distinguish between physical and psychological health, <a href=\"https:\/\/www.washingtonexaminer.com\/weekly-standard\/senate-democrats-introduce-bill-to-strike-down-state-abortion-laws\">according<\/a> to Blumenthal, and the bill urges courts to interpret its provisions \u201cliberally.\u201d<\/p>\n<p>If the bill passes, it will strike down every <a href=\"https:\/\/dailycaller.com\/2022\/04\/23\/red-blue-state-republican-democrat-florida-california\/\">state law<\/a> and regulation limiting <a href=\"https:\/\/dailycaller.com\/2022\/05\/03\/abortion-planned-parenthood-naral-emilys-list-center-for-reproductive-health-supreme-court-dobbs-roe\/\">abortions<\/a> in the first six months of pregnancy, including specific testing requirements and telehealth restrictions that apply to abortion but not comparable medical procedures. <strong><a href=\"https:\/\/dailycaller.com\/2022\/05\/03\/legal-experts-supreme-court-roe-v-wade-dobbs-v-jackson-womens-health\/\">(RELATED: \u2018Lives Of Justices In Danger\u2019: Legal Experts Urge Immediate Ruling On Roe)<\/a><\/strong><\/p>\n<p>The bill also grants health care providers, including non-physicians, the right to perform abortions, including midwives, nurse practitioners and physician\u2019s assistants.<\/p>\n<p>\u201cThe strategy behind the WHPA seeks to hide, censor, and avoid the fact that abortion is designed to kill a human being,\u201d Thomas Jipping, senior legal fellow at the Edwin Meese III Center for Legal and Judicial Studies, <a href=\"https:\/\/www.heritage.org\/life\/commentary\/womens-health-protection-act-unconstitutional-and-more-radical-roe-v-wade\">wrote<\/a>.<\/p>\n<p>Blumenthal and Schumer did not respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
