Other democrats, such as Senate Majority Leader Chuck Schumer, have <a href=\"https:\/\/dailycaller.com\/2021\/03\/16\/life-changing-schumer-urges-biden-pay-out-50000-debt-students\/\" target=\"_blank\" rel=\"noopener noreferrer\">signaled<\/a> they would like to forgive up to $50,000 in student debt.<\/p>\n<div id=\"attachment_7423636\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7423636\" class=\"wp-caption-text\">Rep. (Photo by Anna Moneymaker\/Getty Images)<\/p>\n<\/div>\n<p>Biden himself has said he is unsure he has the authority to take such action through executive order.<\/p>\n<p>\u201cI don\u2019t think I have the authority to do it by signing with a pen,\u201d Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/02\/17\/remarks-by-president-biden-in-a-cnn-town-hall-with-anderson-cooper\/\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> during a CNN town hall last year.<\/p>\n<p>\u201cBut I do think that, in this moment of economic pain and strain, that we should be eliminating interest on the debts that are accumulated, number one,\u201d he added. \u201cAnd number two, I\u2019m prepared to write off a $10,000 debt, but not 50 [thousand].\u201d<\/p>\n<p>Under the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/STATUTE-79\/pdf\/STATUTE-79-Pg1219.pdf#page=37\" target=\"_blank\" rel=\"noopener noreferrer\">1965 Higher Education Act<\/a>, the Education Secretary can \u201cenforce, pay, compromise, waive, or release\u201d an unspecified amount of student loan debt, which advocates say gives the executive branch flexibility, the WSJ reported.<\/p>\n<p>But Rose argues \u201cit is fair to discern Congress has inferred that the [Education] Department should not decide the question of mass forgiveness of performing loans,\u201d according to his memo, the WSJ reported. Instead, he suggested rule changes through the federal regulatory process, which he said would provide a stronger legal basis.<\/p>\n<p>Since the start of the pandemic, payment and interest on federal student loans <a class=\"sharedStyles__StyledLink-sc-1id463a-0 kMEgXB\" href=\"https:\/\/www.wsj.com\/articles\/biden-extends-pause-on-federal-student-loan-payments-through-august-11649253606?mod=article_inline\" target=\"_blank\" rel=\"noopener noreferer noreferrer\" data-type=\"link\">has been<\/a> paused, but is expected to resume on <a href=\"https:\/\/dailycaller.com\/2022\/04\/05\/joe-biden-moratorium-student-loan-payments-inflation\/\" target=\"_blank\" rel=\"noopener noreferrer\">Aug. 31<\/a>.<\/p>\n<p>The White House and the DOE did not respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
