Wade<\/i>\u00a0and\u00a0<i>Doe v. Bolton<\/i> \u2013 they <a href=\"https:\/\/www.washingtontimes.com\/news\/2019\/aug\/15\/roe-v-wade-fault-line\/\">destroyed<\/a> all abortion laws in the 50 states.<\/p>\n<p>It created legal chaos.<\/p>\n<p>They bullied their pro-abortion viewpoint into the law without evidence, a <a href=\"https:\/\/www.scstatehouse.gov\/CommitteeInfo\/SenateMedicalAffairsCommittee\/The_Medical_Assumption_Roe_Clark_Forsythe.pdf\">trial<\/a>, or even any national consensus. They also made possible the deaths\u00a0of more than <a href=\"https:\/\/www.nationalrighttolifenews.org\/2022\/01\/factsheet-reported-annual-abortions-1973-2019\/\">63 million<\/a>\u00a0preborn infants and counting. But according\u00a0to a leaked <a href=\"https:\/\/www.politico.com\/f\/?id=00000180-874f-dd36-a38c-c74f98520000\">draft<\/a> of a Supreme Court decision in the\u00a0<i>Dobbs v. Jackson\u00a0<\/i>case that challenged\u00a0<i>Roe<\/i>\u2019s extremism,\u00a0<i>Roe<\/i>\u00a0and\u00a0<i>Doe<\/i>\u00a0may soon be historical footnotes.<\/p>\n<p>Despite the frenzied <a href=\"https:\/\/www.plannedparenthood.org\/about-us\/newsroom\/press-releases\/planned-parenthood-on-supreme-court-leak-our-worst-fears-confirmed-supreme-court-appears-poised-to-overturn-roe\">response<\/a> of the billion-dollar abortion franchise, the sky is not falling (although their profits might). In fact, what happens next is a return of the issue of abortion to the states for a discussion and a debate blocked by the courts for too long. The reason is simple. While abortion is <em>not<\/em> in the Constitution, states\u2019 rights are.<\/p>\n<p><em>Roe\u2019s<\/em> flaws in blocking engagement with people drew even the ire of pro-abortion\u00a0Justice <a href=\"https:\/\/www.washingtontimes.com\/news\/2019\/aug\/15\/roe-v-wade-fault-line\/\">Ruth Bader Ginsburg,<\/a> who, like many people, believed the Supreme Court was mistaken when it bypassed \u201cwe the people\u201d and \u201cinvited no dialogue with legislators.\u201d It also had no connection to logic or the law.<\/p>\n<p>In 1973, in the <a href=\"https:\/\/www.jstor.org\/stable\/795536\">Yale Law Journal<\/a>, legal luminary John Hart Ely wrote a devastating analysis of <i>Roe<\/i>\u2019s flaws. Though he supported abortion, he knew\u00a0<i>Roe\u00a0<\/i>and\u00a0<i>Doe<\/i>\u00a0were nonsense.<\/p>\n<p>Ely ridiculed the Supreme Court\u2019s choice for viability as a \u201cmagic moment\u201d that offers certain rights for humans without explaining the reasoning behind that unprecedented line in the gestational sand.<\/p>\n<p>The state has a right to make laws, even when<i>\u00a0humans\u00a0<\/i>are not involved. Ely wrote that in fact, \u201cIt has never been held or even asserted that the state interest needed to justify forcing a person to refrain from an activity, whether or not that activity is constitutionally protected, must implicate either the life or the constitutional rights of another person.\u00a0Dogs are not \u2018persons in the whole sense\u2019 nor have they constitutional rights, but that does not mean that the state cannot prohibit killing them.\u201d<br \/><b><\/b><br \/>And that\u2019s an important point, can a state pass laws to protect preborn life? Before 1973, the answer was yes. And we\u2019ve been trying to get back there ever since.<\/p>\n<p>After <em>Roe<\/em> shut down most discussions of abortion, several cases challenged its iron rule. Not much happened. But in 1992, a case known as <a href=\"https:\/\/www.\u200binquirer.\u200bcom\/news\/planned-parenthood-v-casey-abortion-ruling-pennsylvania-alito-20220503.html\"><em>Planned Parenthood v. Casey<\/em><\/a> cracked open the door for more regulation of abortion.<\/p>\n<p>It\u2019s important to understand that prior to <em>Roe<\/em>, almost all <a href=\"https:\/\/www.\u200bguttmacher.\u200borg\/gpr\/2003\/03\/lessons-roe-will-past-be-prologue\">states<\/a> severely prohibited abortion or limited it to saving a mother\u2019s life. And that\u2019s how it will be again, each state making a choice (and pro-choice is supposed to be good, right?)<\/p>\n<p>Today,\u00a026 <a href=\"https:\/\/nypost.\u200bcom\/2022\/05\/03\/26-states-where-abortion-will-be-illegal-if-roe-v-wade-falls\/\">states<\/a>\u00a0are ready with limits on the deadly procedure. And Students for Life Action has been working to add even more.<\/p>\n<p>Over the last two years, Students for Life Action has worked in 30 states, to rebuild protections for life with an emphasis on early abortion \u2014 as more than 9 in 10 abortions take place by 12 weeks, according to the <a href=\"https:\/\/www.\u200bcdc.\u200bgov\/reproductivehealth\/data_stats\/abortion.htm\">CDC<\/a>. As we <a href=\"https:\/\/www.\u200bwashingtonpost.\u200bcom\/nation\/2022\/05\/02\/abortion-ban-roe-supreme-court-mississippi\/\">said<\/a> to members of Congress just this week, \u201cIf we are not focusing on limiting early abortions, we are not really addressing the violence of abortion at all.\u201d<\/p>\n<p>One example is Heartbeat <a href=\"https:\/\/studentsforlife.\u200borg\/2022\/02\/07\/life-is-up-in-texas-thanks-heartbeat-bill\/\">legislatio<wbr \/>n<\/a> that protects humans with the universal sign of life. We\u2019ve also worked to ban online, no test distribution of <a href=\"https:\/\/thisischemicalabortion.\u200bcom\/\">Chemical Abortion Pills<\/a> that can leave women injured, infertile, and even <a href=\"https:\/\/thefederalist.\u200bcom\/2022\/01\/12\/injury-infertility-and-death-from-chemical-abortions-are-a-ok-with-the-fda\/\">dead<\/a> \u2013 and that now are used to commit at least\u00a054% of all <a href=\"https:\/\/www.\u200bguttmacher.\u200borg\/article\/2022\/02\/medication-abortion-now-accounts-more-half-all-us-abortions\">abortion<\/a>. And we\u2019ve championed a\u00a0Protection at Conception\u00a0<a href=\"https:\/\/www.\u200bstudentsforlifeaction.\u200borg\/protection-at-conception-pledge\/\">initiative<\/a>.<\/p>\n<p>While we work to protect life in law, we also work to protect life in service. For SFLA, that means our Standing with You\u00a0<a href=\"https:\/\/www.\u200bstandingwithyou.\u200borg\/\">initiative<\/a> that connects women with vital resources. The pro-life movement has always prioritized caring for women and their children, born and preborn as our hallmark achievement. As noted at a pro-life coalition event on <a href=\"https:\/\/studentsforlife.\u200borg\/2022\/02\/14\/the-pro-life-movement-to-women-happy-valentines-day\/\">Valentine\u2019s Day<\/a>, \u201cWe live in a country with about 3,000 pregnancy resource centers and approximately 400 maternity homes<i>,\u00a0<\/i>offering free services and tangible support to women and their families during pregnancy and motherhood.\u201d<\/p>\n<p>While the pro-life movement is making plans to expand legal protections for the preborn and their mothers, as well as adding supportive services for them, others prepare to bring abortion violence to the <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2022\/05\/03\/abortion-rights-protests-supreme-court-leak\/9628280002\/\">streets<\/a>.<\/p>\n<p>As I wrote in <a href=\"https:\/\/www.\u200bnewsweek.\u200bcom\/roe-almost-50-whats-next-abortion-america-opinion-1669557\">Newsweek<\/a>, pro-life work today means being ready for ugly confrontations.<\/p>\n<p>Threats and acts of violence against pro-life activists are becoming increasingly common. Students for Life students and team members have endured everything from <a href=\"https:\/\/www.\u200byoutube.\u200bcom\/watch?v=qxtrYrwy6a8\">physical<\/a> <a href=\"https:\/\/www.\u200bstudentsforlifeaction.\u200borg\/female-team-member-punched-at-supreme-court\/\">attacks<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.\u200bfoxnews.\u200bcom\/opinion\/pro-choice-instigators-crossing-the-line-from-harassment-into-dehumanization\">arson<\/a> to\u00a0<a href=\"https:\/\/studentsforlife.\u200borg\/2019\/09\/19\/horrible-pro-choicer-creates-bomb-scare\/\">bomb threats<\/a> and <a href=\"https:\/\/www.\u200bcampusreform.\u200borg\/?ID=10753\">intimidation<\/a>, making security <a href=\"https:\/\/www.\u200bwsj.\u200bcom\/articles\/campus-censorship-hits-pro-lifers-hard-1526942093\">issues<\/a> a vital concern and expense for pro-life events. When Justice <a href=\"https:\/\/www.\u200bnewsweek.\u200bcom\/topic\/brett-kavanaugh\">Brett Kavanaugh<\/a> \u2014 who was seen as a possible pro-life vote \u2014 was confirmed to the Supreme Court, protestors stormed the Court, <a href=\"https:\/\/www.\u200bnbcnews.\u200bcom\/politics\/supreme-court\/protests-build-capitol-hill-ahead-brett-kavanaugh-vote-n917351\">banging<\/a> on the doors. Outside the <a>U.\u200bS.\u200b,<\/a> violent protests broke out in\u00a0<a href=\"https:\/\/abcnews.\u200bgo.\u200bcom\/Health\/wireStory\/polish-court-seals-divisive-ruling-tighten-abortion-law-75517953\">Poland<\/a> and <a href=\"https:\/\/www.\u200bcnn.\u200bcom\/2021\/09\/29\/americas\/latin-american-abortion-rights-protests-intl\/index.html\">Latin America<\/a> when those countries contemplated pro-life policies. Black-clad demonstrators have protested my own speaking <a href=\"https:\/\/www.\u200bchristianpost.\u200bcom\/news\/antifa-protests-christian-fascist-students-for-life-president-kristen-hawkins.html\">tours<\/a> and recently the Chicago <a href=\"https:\/\/www.\u200bbreitbart.\u200bcom\/faith\/2022\/01\/09\/antifa-counter-protest-at-march-for-life-chicago\/\">March for Life<\/a>.<\/p>\n<p>But as I travel across the country on behalf of an organization that operates in all 50 states, I find courageous Millennials, Gen Z, and Gen Y ready to take their place on the front lines to make abortion unthinkable and unimaginable. Their love is fierce and focused, and they\u2019re ready to vote pro-life first.<\/p>\n<p>On the other side, all they have is the deliberate ending of innocent life \u2013 for profit \u2014 hidden behind talking points.
