Jackson Women\u2019s Health Organization<\/em>, the Supreme Court case involving a 2018 Mississippi law banning abortions after 15 weeks, addressing whether bans on abortion before fetal viability are constitutional.<\/p>\n<p class=\"p1\">\u201cWill this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?\u201d the justice <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/583814-sotomayor-suggests-court-wouldnt-survive-stench-if-abortion-rights\/amp\/\">asked<\/a> an attorney who backed the Mississippi law in late 2021, suggesting that the Supreme Court would be seen as highly politicized. \u201cI don\u2019t see how it is possible.\u201d<\/p>\n<p>On Monday evening, <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\">Politico revealed<\/a> a draft opinion showing that the justices will likely rule to overturn <em>Roe v. Wade.\u00a0<\/em>The news has sparked nationwide protests and frenzy as pro-abortion rights supporters grapple with the potential that <em>Roe v. Wade<\/em> could soon be overturned.<\/p>\n<p>Experts and political commentators on the right <a href=\"https:\/\/www.dailywire.com\/news\/abortion-supporters-leaked-supreme-court-draft-to-intimidate-the-court-pro-life-advocates-say\">have suggested<\/a> that the draft opinion was leaked, most likely by a progressive Supreme Court clerk, in efforts to intimidate the court and change its decision.<\/p>\n<p>It has not yet been determined who the leaker is.<\/p>\n<p>\u201cThe leak appears to be totally political in nature, not only intended to damage the Court and pressure the justices, but more immediately to incite Democrats to push their laundry list of terrible anti-life ideas, including blowing up the filibuster and attempting to codify abortion violence at the federal level prior to the November elections,\u201d Katie Glenn, Government Affairs Counsel at Americans United for Life (AUL), told The Daily Wire late Monday evening.<\/p>\n<p>The draft majority opinion, which is not final, says <i>Roe v. Wade<\/i> was egregiously wrong. \u201cWe hold that <i>Roe<\/i> and <i>Casey<\/i> must be overruled,\u201d Alito wrote, according to POLITICO. \u201cIt is time to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives.\u201d<\/p>\n<p>Judicial Crisis Network\u2019s President Carrie Severino <a href=\"https:\/\/www.dailywire.com\/news\/conservatives-legal-experts-call-for-justices-to-release-roe-v-wade-decision\">said<\/a> the unprecedented\u00a0<a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\">news<\/a>\u00a0merits an \u201cunprecedented response\u201d \u2014 that the \u201cCourt should release its majority opinion as soon as possible.\u201d<\/p>\n<p>\u201cObviously no one can actually force the Chief Justice\u2019s hand,\u201d Severino told The Daily Wire, \u201cbut he may want to release the opinion early to avoid exposing the Court to further pressure and intimidation tactics that risk undermining the Court as an institution as a result of the draft opinion hanging out there for what could be months.\u201d<\/p>\n<p>The Wall Street Journal Editorial Board also discussed Tuesday how fast the court should move to release its decision.<\/p>\n<p>\u201cThere\u2019s an argument for getting it out fast to make it a fait accompli,\u201d the WSJ Editorial Board <a href=\"https:\/\/www.wsj.com\/articles\/the-supreme-court-leak-on-roe-v-wade-samuel-alito-john-roberts-abortion-draft-opinion-11651605792?mod=opinion_lead_pos1\">said<\/a>. \u201cPolitico said the Alito draft was circulated in February, so the Justices have had ample time to absorb it and respond. We hate to say this, but some abortion fanatic could decide to commit an act of violence to stop a 5-4 ruling.
