Jackson Women\u2019s Health Organization <\/em>shocked even the most hardened political observers. Most people expected the Court to uphold the Mississippi abortion law at the heart of the case. Many even expected the Court to overrule <a href=\"https:\/\/www.dailywire.com\/topic\/roe-v-wade\"><em>Roe v. Wade<\/em><\/a> and <em>Planned Parenthood v. Casey<\/em>, the infamous decisions that discovered a \u201cright\u201d to abortion written between \u201cemanations\u201d and \u201cpenumbras\u201d of the Constitution in invisible ink. But no one seems to have expected that someone from inside the high court might leak the opinion to the press. In a statement confirming the document\u2019s authenticity, Chief Justice John Roberts called the leak a \u201csingular and egregious breach\u201d of \u201cthe trust of the Court.\u201d<\/p>\n<p>The most surprising aspect of the entire episode is that anybody should be surprised at all. Of course, they leaked the opinion. These people kill babies. Not only do they kill babies, but they <a href=\"https:\/\/www.youtube.com\/watch?v=kXhuUE7k74k\">defend the killing of babies<\/a>, not only as an evil to be tolerated but as a good to be enjoyed on demand at any point\u00a0of pregnancy and celebrated with <a href=\"https:\/\/www.washingtonpost.com\/lifestyle\/style\/how-shoutyourabortion-is-transforming-the-reproductive-rights-conversation\/2015\/11\/13\/aa64e68a-895f-11e5-9a07-453018f9a0ec_story.html\">shouts\u00a0of glee<\/a>. Compared with infanticide, the upsetting of institutional norms is child\u2019s play.<\/p>\n<p>The late, great Norm Macdonald once mocked a friend\u2019s suggestion \u2014 at the time a common refrain \u2014 that the worst aspect of disgraced comedian Bill Cosby\u2019s sexual crimes was \u201cthe hypocrisy.\u201d \u201cNo,\u201d Norm responded, \u201cI think it was the raping. It\u2019s my feeling that most rapists are hypocrites.\u201d A man willing to commit enormous sins will more easily commit lesser sins. One struggles to imagine a more egregious sin than killing an innocent little baby.<\/p>\n<p>Pro-lifers surprised by the leaker\u2019s incivility may have fallen prey to their own press releases, which for half a century have focused on the technical unconstitutionality of <em>Roe<\/em> over the evil of abortion itself. Pro-life advocates reflexively point out that the <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2021\/12\/02\/abortion-supreme-court-kavanaugh-plessy-mississippi\/\">overruling of <em>Roe<\/em> will not outlaw abortion<\/a> throughout the country but merely \u201creturn the question to the states, where it belongs.\u201d No matter what one thinks about abortion, many <a href=\"https:\/\/www.youtube.com\/watch?t=323&#038;v=QBFqGmu__Gs&#038;feature=youtu.be\">pro-lifers argue<\/a>, we should all agree that the Court ought not to have infringed on the right of the people to decide the matter for themselves. The Court\u2019s primary error in <em>Roe<\/em> and <em>Casey<\/em>, they argue, is not so much <em>what<\/em> it decided about abortion as <em>who<\/em> it concluded has the right to decide.<\/p>\n<p>To the argument\u2019s credit, it appears to have worked. Some conservative legal scholars, such as John Finnis and Robbie George, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1392\/185196\/20210729093557582_210169a%20Amicus%20Brief%20for%20efiling%207%2029%2021.pdf\">have argued<\/a>\u00a0that the Supreme Court should in fact decide the issue because the Fourteenth Amendment of the Constitution outlaws abortion at the national level. Regardless, Alito\u2019s leaked opinion suggests that the Court favors the jurisdictional modesty of the more common claim that federalism and the separation of powers compel the Court to overrule <em>Roe<\/em> and <em>Casey<\/em>. To restrict abortion, such an argument might suffice. But to understand abortion advocates\u2019 \u201csingular and egregious\u201d reaction to such a decision, one must go deeper and admit that <em>Dobbs<\/em> is not really about the relative status of jurists and lawmakers, of the states and the federal government; it\u2019s about the license to kill babies.<\/p>\n<p>Some Supreme Court cases stand out as vessels for esoteric legal debate. Others raise more urgent, practical questions. In <em>United States v. Ninety-Five Barrels Alleged Apple Cider Vinegar<\/em>, for example, the Supreme Court ruled that the Douglas Packing Company had mislabeled its product by neglecting to distinguish between \u201cselected apples\u201d and \u201cdried apples.\u201d In <em>Roe v. Wade<\/em>, the Court consigned 62 million babies\u2014and counting\u2014to ritual slaughter.<\/p>\n<p>Abortion advocates call this child sacrifice \u201c<a href=\"https:\/\/twitter.com\/JohnFetterman\/status\/1521299340169560065\">sacred<\/a>.\u201d\u00a0They will not easily accede to displease their gods. The overruling of <em>Roe <\/em>has already overturned the ordinary judicial process because <em>Roe<\/em> is no ordinary case.
