It is difficult to imagine who outside the Court would have the time, ability, and motive to craft and release such a masterful document,\u201d Whelan wrote.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Outstanding Draft Majority Opinion in Dobbs <a href=\"https:\/\/t.co\/1fdD33VLoX\">https:\/\/t.co\/1fdD33VLoX<\/a> A guide to the opinion.<\/p>\n<p>\u2014 Ed Whelan (@EdWhelanEPPC) <a href=\"https:\/\/twitter.com\/EdWhelanEPPC\/status\/1521451876847394817?ref_src=twsrc%5Etfw\">May 3, 2022<\/a><\/p>\n<\/blockquote>\n<p>Whelan did not address the question of how the <a href=\"https:\/\/www.politico.com\/f\/?id=00000180-874f-dd36-a38c-c74f98520000\" target=\"_blank\" rel=\"noopener noreferrer\">draft<\/a> was <a href=\"https:\/\/dailycaller.com\/2022\/05\/03\/judicial-insurrection-ron-desantis-dobbs-v-jackson-womens-health-roe-v-wade\/\" target=\"_blank\" rel=\"noopener noreferrer\">leaked<\/a> and claimed he intended to offer a \u201creader\u2019s guide to the draft majority opinion.\u201d<\/p>\n<p>Politico released a <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a> Monday evening claiming the Supreme Court had voted to strike down the landmark 1973 decision Roe v. Wade\u00a0citing a document purported to be the initial draft of a majority opinion written by Associate Justice Samuel Alito.<\/p>\n<p>\u201cWe hold that <i>Roe<\/i> and <i>Casey<\/i> must be overruled,\u201d Alito wrote, according to Politico.\u00a0\u201cIt is time to heed the Constitution and return the issue of abortion to the people\u2019s elected representatives.\u201d<\/p>\n<p>\u201cA person familiar with the court\u2019s deliberations said that four of the other Republican-appointed justices \u2014 Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett \u2014 had voted with Alito in the conference held among the justices after hearing oral arguments in December, and that line-up remains unchanged as of this week,\u201d Politico reported.<\/p>\n<p>Chief Justice John Roberts issued a <a href=\"https:\/\/dailycaller.com\/2022\/05\/03\/betrayal-roberts-speaks-out-about-scotus-leak-announces-investigation\/\" target=\"_blank\" rel=\"noopener noreferrer\">statement<\/a> Tuesday confirming the authenticity of the document and condemning its leak to the public. <strong><a href=\"https:\/\/dailycaller.com\/2022\/05\/02\/supreme-court-overturn-roe-v-wade-dobbs-jackson-womens-health-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018Gravest, Most Unforgivable Sin\u2019: SCOTUS Leak Decried By Court Watchers)<\/a><\/strong><\/p>\n<p>\u201cJustices circulate draft opinions internally as a routine and essential part of the Court\u2019s confidential deliberative work. Although the document described in yesterday\u2019s reports is authentic, it does not represent a decision by the Court or the final position of any member on the issues in the case,\u201d Roberts said.<\/p>\n<p>\u201cTo the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed.
