Wade<\/em> should not be subject to a federal investigation.<\/p>\n<p>The Rhode Island senator weighed in on the leaker during a hearing on \u201cTransparency and Accountability for 21st Century Courts,\u201d following a Monday evening <a href=\"https:\/\/www.politico.com\/news\/2022\/05\/02\/supreme-court-abortion-draft-opinion-00029473\">report<\/a> exposing a draft opinion from Justice Thomas Alito in which the justice delivered an \u201cunflinching repudiation\u201d of <em>Roe v. Wade<\/em>.<\/p>\n<p>Republican Louisiana Sen. John Kennedy warned during the hearing that the leaker should be fired, disbarred, and prosecuted.<\/p>\n<p>\u201cThat person also has a pretty difficult decision make in the next few days,\u201d Kennedy said. \u201cI believe I\u2019m accurate in suggesting that every person who had access to this document, that they leaked, that was leaked, is going to get a visit by the FBI. And the person who leaked this document is gonna have to either tell the truth or lie to an FBI agent, which subjects them to criminal prosecution.\u201d<\/p>\n<p>\u201cSo, let\u2019s hope that our Department of Justice does its job and at least in a small way, tries to restore a little bit of integrity that this, this misguided zealot, who leaked this document, took away from the American people,\u201d he added.<\/p>\n<p>Whitehouse responded by suggesting that the FBI should not be investigating the matter.<\/p>\n<p>\u201cIt\u2019s an interesting separation of powers, question,\u201d Whitehouse responded, \u201cwhy FBI agents from the executive branch would be running around within the Supreme Court, interviewing clerks and staff and justices themselves, if it\u2019s not appropriate for Congress to exercise its legislative powers with regard to those standards.\u201d<\/p>\n<p>Kennedy told Whitehouse that the\u00a0United States Supreme Court has its own police force, saying,\u00a0\u201cI don\u2019t think it\u2019s at all uncommon to\u00a0have police forces cooperate.\u201d<\/p>\n<p>\u201cWhat I hope happens\u2026is that that the authorities at the Department of Justice, who I believe will be called in, should be called in, put the full force and power of their agency to find out who leaked this document, and to prosecute that person civilly and criminally to the full extent of the law,\u201d Kennedy said.<\/p>\n<p>\u201cI don\u2019t care who it is, I don\u2019t care what the politics is,\u201d Kennedy added. \u201cThis isn\u2019t right.\u201d<\/p>\n<p>\u201cI guess we\u2019ll begin by trying to identify what law that person might have violated,\u201d Whitehouse responded.<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n[embedded content]\n<p>Shortly after the conversation between the senators,\u00a0Chief Justice John Roberts <a href=\"https:\/\/www.axios.com\/justice-roberts-abortion-leak-da48f1b2-087f-4a43-b037-068be226ce2c.html?stream=top&#038;utm_source=alert&#038;utm_medium=email&#038;utm_campaign=alerts_all\">released<\/a> a statement confirming that the draft document is real but emphasizing that it did not represent the Supreme Court\u2019s final decision.<\/p>\n<p>\u201cWe at the Court are blessed to have a workforce \u2014 permanent employees and law clerks alike \u2014 intensely loyal to the institution and dedicated to the rule of law,\u201d the chief justice said.<\/p>\n<p>\u201cThis was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here,\u201d he added, noting that he has \u201cdirected the Marshal of the Court to launch an investigation into the source of the leak.\u201d<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies for breaking news, investigative reporting, sports, podcasts, in-depth analysis, books, and entertainment for a reason: because we believe in what we do.
