Wade<\/em>.<\/p>\n<p>That scenario became much more likely after Monday night\u2019s revelation of a Supreme Court draft opinion that would indeed throw out the badly-decided 1973 Court decision.<\/p>\n<p>The Guttmacher Institute, an ardent supporter of abortion access, <a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/abortion-policy-absence-roe\">wrote<\/a>, \u201c23 states have laws that could be used to restrict the legal status of abortion\u201d while acknowledging, \u201c16 states and the District of Columbia have laws that protect the right to abortion.\u201d<\/p>\n<p>The Guttmacher Institute declared, \u201c13 states have post-<em>Roe\u00a0<\/em>laws to ban all or nearly all abortions that would be triggered if\u00a0<em>Roe<\/em> were overturned,\u201d adding, \u201c7 states have laws that express the intent to restrict the right to legal abortion to the maximum extent permitted by the U.S. Supreme Court in the absence of\u00a0<em>Roe<\/em>.\u201d<\/p>\n<p>\u201c[Nine] states retain their unenforced, pre-<em>Roe<\/em> abortion bans,\u201d the report added.<\/p>\n<p>In May 2021, <a href=\"https:\/\/www.nytimes.com\/interactive\/2021\/05\/18\/upshot\/abortion-laws-roe-wade-states.html\">The New York Times<\/a> surmised about states eliminating abortion access, noting, \u201cTen states have passed so-called trigger laws, which would automatically ban all abortions without <em>Roe<\/em>. An additional 12 states are considered highly likely to pass new abortion bans in a new legal environment, based on recent legislative action and state court rulings.\u201d<\/p>\n<p>The pro-abortion access Center for Reproductive Rights estimated 25 states would likely <a href=\"https:\/\/reproductiverights.org\/maps\/what-if-roe-fell\/\">ban abortion<\/a>\u00a0if <em>Roe<\/em> is overturned. Those states included Alabama, Arizona, Arkansas, Georgia, Idaho, Indiana, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, Wisconsin and Wyoming.<\/p>\n<p><em>Roe,<\/em><em>\u00a0<\/em>in which Justice Harry A. Blackmun, writing the opinion for the majority, <a href=\"https:\/\/dailywire.com\/news\/why-jurists-felt-roe-v-wade-was-a-horrible-legal-decision\/\">ruled<\/a> that the \u201cdue process\u201d clause in the Fourteenth Amendment included an implicit \u201cright to privacy,\u201d followed in the footsteps of the contraceptive case\u00a0<em>Griswold v. Connecticut<\/em>\u00a0from 1965, in which leftist Supreme Court Justice William Douglas invented privacy rights, which he had discovered in \u201cpenumbras, formed by emanations from\u201d the Bill of Rights.<\/p>\n<p>Writing for the United States Conference of Catholic Bishops in 2003, Attorney Susan E. Wills\u00a0<a href=\"https:\/\/www.usccb.org\/issues-and-action\/human-life-and-dignity\/abortion\/ten-legal-reasons-to-reject-roe\">explained<\/a>\u00a0that the Supreme Court exceeded its constitutional authority in\u00a0<em>Roe v. Wade<\/em>\u00a0because it substituted the policy preferences of the Supreme Court for what was written in law; struck down criminal laws of Texas and Georgia which outlawed certain abortions by finding that they violated a \u201cright of privacy\u201d which is not mentioned in the Constitution, and misrepresented the history of abortion by claiming it had been widely practiced and unpunished until the Victorian era.<\/p>\n<p>The decision ignored condemnation of abortion as far back as the Hippocratic Oath, which stated, \u201cI will give no deadly medicine to anyone if asked, nor suggest any such counsel; and in like manner I will not give to a woman a pessary to produce abortion.\u201d<\/p>\n<p><em>Roe<\/em> also misrepresented the common law of England by claiming \u201cit now appears doubtful that abortion was ever firmly established as a common-law crime even with respect to the destruction of a quick fetus\u201d as opposed to William Blackstone\u2019s Commentaries on the Laws of England, which stated, \u201cLife is the immediate gift of God, a right inherent by nature in every individual; and it begins in contemplation of law as soon as the infant is able to stir in the mother\u2019s womb.\u201d<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest growing conservative media companies for breaking news, investigative reporting, sports, podcasts, in-depth analysis, books, and entertainment for a reason: because we believe in what we do.
