Wade<\/em>, there was no limit to how far a conservative court might go.<\/p>\n<p>Behar\u2019s comments, which aired on ABC\u2019s midday talk show \u201cThe View,\u201d came host hours after Politico published a <a href=\"https:\/\/dailywire.com\/news\/breaking-supreme-court-strikes-down-roe-v-wade-decision-in-draft-of-majority-opinion-report-says\/\">leaked opinion draft<\/a> indicating that the court might be prepared to <a href=\"https:\/\/dailywire.com\/news\/shapiro-draft-supreme-court-majority-opinion-leaks-striking-down-roe-v-wade-heres-what-all-of-that-means\/\">overturn<\/a> both <em>Roe v. Wade<\/em> and its companion case, <em>Planned Parenthood v. Casey<\/em>.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Following clips of Dems crying Handmaids Tale and blaming Ted Cruz, Joy Behar calls the possible ruling devastating and asserts the conservative justices lied under oath about overturning Roe.And she scoffs at ACB&#8217;s scholarly argument because she doesn&#8217;t understand the words. <a href=\"https:\/\/t.co\/SQPshnNZVG\">pic.twitter.com\/SQPshnNZVG<\/a><\/p>\n<p>\u2014 Nicholas Fondacaro (@NickFondacaro) <a href=\"https:\/\/twitter.com\/NickFondacaro\/status\/1521508015198900225?ref_src=twsrc%5Etfw\">May 3, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cI woke up in the middle of the night to pee,\u201d Behar began. \u201cAnd while I was up I see my phone lighting up, people texting, look, what happened here. I couldn\u2019t go back to sleep. It is that devastating. In those hearings, all of these people that are voting to overturn this lied, didn\u2019t they lie?\u201d<\/p>\n<p>Behar was referring specifically to the three justices who were appointed by former President Donald Trump \u2014 Justices Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett \u2014 and saying that because they had all agreed during their confirmation hearings that <em>Roe<\/em> was \u201cprecedent,\u201d a vote to overturn that precedent meant that they had lied to the Senate.<\/p>\n<p>Behar went on to warn that a conservative court would be satisfied with only overturning <em>Roe<\/em>, suggesting that they might come for other rights like same-sex marriage or even work to bring back segregation.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Behar then claims the conservative justices will go after Brown v. We saw this coming. My worry that this is just the beginning, next they will go after gay marriage and maybe the Board v. \u2014 what is it, <em>Brown v. Board of Education<\/em>. They already eroded our voting rights a little bit. So I see some \u2014 I see fascism down the line, I don\u2019t know.\u201d<\/p>\n<p>Guest co-host Lindsey Granger weighed in then, saying that she was concerned about the leak \u2014 which Chief Justice John Roberts confirmed was real, calling for an investigation into how it had gotten out. She argued that it could undermine the respect for and independence of the court.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Guest co-host Lindsey Granger worries about the precedent being set by leaking draft rulings and the smears against the court as being untrustworthy.<br \/>She says if a lib leaked the docs it was a coercive action and if a conservative member did it was meant to cement opinions. <a href=\"https:\/\/t.co\/FAvZyJRnWs\">pic.twitter.com\/FAvZyJRnWs<\/a><\/p>\n<p>\u2014 Nicholas Fondacaro (@NickFondacaro) <a href=\"https:\/\/twitter.com\/NickFondacaro\/status\/1521509690835972096?ref_src=twsrc%5Etfw\">May 3, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cSetting a precedent for taking materials that the public was not yet to consume and telling us that the Supreme Court is now a partisan \u2014 it\u2019s not apolitical any more, it\u2019s part of the partisan fray,\u201d Granger commented. \u201cAnd I think that\u2019s why, as an institutionalist I\u2019m looking at this, and I think lot of Republicans are getting upset about the documents being released.\u201d<\/p>\n<p>\u201cThe bigger issue, obviously, is abortion is on the table, but people are getting upset because we\u2019re setting a precedent now that you can\u2019t trust the Supreme Court,\u201d she added. \u201cThis infighting, nobody knows what\u2019s it is going on who leaked the documents \u2026 If it was a liberal that leaked the documents, that would mean they\u2019re trying to undermine the Supreme Court intentionally. If it was a conservative on the Court that released the documents, that would mean they\u2019re trying to force the hand of their counterparts to stay firm in their early opinion, which is not right.
