According to the Bexar County Medical Examiner, he died from gunshot wounds on his way to the hospital.<\/p>\n<p>Spectrum News <a href=\"https:\/\/spectrumlocalnews.com\/tx\/south-texas-el-paso\/news\/2020\/12\/10\/gov--greg-abbott-rebuffs-proposed-change-to-texas--castle-doctrine-\">explained<\/a>, \u201cTexas law permits someone to claim self-defense at trial when deadly force was used in the following circumstances\u201d:<\/p>\n<ul>\n<li><em>Reasonably believed the deadly force was immediately necessary;<\/em><\/li>\n<li><em>Had a legal right to be on the property;<\/em><\/li>\n<li><em>Did not provoke the person against whom deadly force was used; and<\/em><\/li>\n<li><em>Was not engaged in criminal activity at the time the deadly force was used.<\/em><\/li>\n<\/ul>\n<p>In December 2020, Texas GOP governor Greg Abbott decisively stated that the state would not reduce the Castle Doctrine law after a Texas Democrat introduced a bill that would \u201crequire a homeowner to exhaust the potential of safely retreating into their habitation before using deadly force in defense of themselves or their property.\u201d<\/p>\n<p>\u201cState Rep. Terry Meza, D-Irving, filed\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__capitol.texas.gov_tlodocs_87R_billtext_pdf_HB00196I.pdf-23navpanes-3D0&#038;d=DwMFaQ&#038;c=IdVe9qYOlLvEHvfqFspkfxuOEuSulhj36o8Ug6l7Bq4&#038;r=yHR4y50BmQTKofztgxrUbw&#038;m=rPHxnfgraQczktO-a2rYYfBJqM6cUS6aFyqiYYMpUXQ&#038;s=K3wwx6qlVfSE5TXUdssGekVTVPSFBg6T-4igzkN0Uzc&#038;e=\">House Bill 196<\/a>\u00a0in early November, which would modify part of the code to require a person to be \u2018unable to safely retreat before they could use deadly force to protect their habitation or property,\u201d <a href=\"https:\/\/www.click2houston.com\/news\/politics\/2020\/12\/10\/bill-seeking-to-modify-texas-castle-doctrine-causes-stir-ahead-of-2021-legislative-session\/\">Click 2 Houston<\/a> reported. \u201cIt would also remove robbery and aggravated robbery as crimes that could be legally stopped with deadly force by property owners.\u201d<\/p>\n<p>Abbott tweeted, \u201cLet me be clear. The Castle Doctrine will not be reduced. We won\u2019t force Texas homeowners to retreat. Especially with the crazy \u2018defund police\u2019 ideas, homeowners need to protect themselves now more than ever.
