The constitution had been amended in 2014 to require a specific bipartisan procedure for redistricting and when that process bogged down in New York, Democrats simply abandoned it. The Court also found that the maps themselves were unconstitutional because they showed a clear partisan intent, i.e. Democrats trying to eliminate GOP districts.<\/p>\n<p>Today <em>Politico<\/em> has a follow up piece about all of the considerable heartburn this decision has caused inside the party. It\u2019s <a href=\"https:\/\/www.politico.com\/news\/2022\/04\/28\/new-york-redistricting-spooks-house-dems-00028753\" target=\"_blank\" rel=\"noopener\">very entertaining stuff<\/a>:<\/p>\n<blockquote>\n<p class=\"story-text__paragraph\" data-content-child-index=\"0-2\">\u201cI don\u2019t think anybody\u2019s gonna have to go to therapy as a result of it. But let\u2019s put it this way: It\u2019s not the kind of news that the Democrats wanted,\u201d said former Rep. Steve Israel, a New York Democrat and the one-time leader of the party\u2019s congressional campaign arm.<\/p>\n<p class=\"story-text__paragraph\" data-content-child-index=\"0-3\">\u201cGoing into a tough midterm, you\u2019re fighting for every yard. And when the referee tells you that you\u2019ve lost yardage, it doesn\u2019t help team spirit,\u201d Israel said\u2026<\/p>\n<p data-content-child-index=\"0-3\">\u201cI\u2019ll tell you the New York decision \u2014 there\u2019s a lot of buzz around it,\u201d said Rep.\u00a0Cheri Bustos\u00a0(D-Ill.), another former congressional campaign arm chair. \u201cYou kind of think as Democrats if you have a Democratic-led state that it\u2019s going to turn out OK. And it hasn\u2019t.\u201d<\/p>\n<\/blockquote>\n<p>It\u2019s stunning to many NY Democrats that their unconstitutional abuse of power hasn\u2019t been allowed to stand. But Rep. Kathleen Rice, a retiring Democrat, told Politico, \u201cI think it looks bad. I think we\u2019ve got egg on our face.\u201d She added that Democrats had <a href=\"https:\/\/www.politico.com\/news\/2022\/04\/28\/new-york-redistricting-spooks-house-dems-00028753\" target=\"_blank\" rel=\"noopener\">overreached<\/a>:<\/p>\n<blockquote>\n<p>\u201cIt didn\u2019t need to be that way,\u201d she said. \u201cWe could have made lines that were fair and followed the rules and still have been effective at making sure that Democrats are represented.\u201d<\/p>\n<\/blockquote>\n<p>Rice\u2019s point echoes that of Republican State Party Chair Nick Langworthy who said any chaos going forward was the <a href=\"https:\/\/www.wshu.org\/long-island-news\/2022-04-28\/whats-next-for-new-yorks-primaries-after-the-high-court-rejects-redistricting-maps\" target=\"_blank\" rel=\"noopener\">fault of state Democrats<\/a>:<\/p>\n<blockquote>\n<p>\u201cI understand that this is going to be a bit chaotic going forward,\u201d Langworthy said.<\/p>\n<p>The GOP Chair said any inconvenience or confusion, though, is the fault of the Democrats responsible for the lines, including Governor Kathy Hochul, Attorney General Letitia James, Senate Leader Andrea Stewart-Cousins and Deputy Majority Leader Mike Gianaris.<\/p>\n<p>\u201cThis chaos lies squarely with (them),\u201d Langworthy said, \u201cand every legislator who voted for these illegal maps.\u201d<\/p>\n<\/blockquote>\n<p>As I pointed out Wednesday, state Democrats argued to the NY Court of Appeals that even if the maps were unconstitutional it was too late to draw new ones. Therefore the 2022 election would need to proceed with the unconstitutional maps. The court rejected that idea and ordered a lower court to appoint a special master to quickly revise the maps while the primary dates were pushed back a few weeks to make the change. But it appears Democrats are still hoping they can force the issue. After consideration of the problem, they <a href=\"https:\/\/www.politico.com\/news\/2022\/04\/28\/new-york-redistricting-spooks-house-dems-00028753\" target=\"_blank\" rel=\"noopener\">have a plan<\/a>:<\/p>\n<blockquote>\n<p>The redistricting mess dominated a discussion of the state\u2019s Democratic delegation during a Zoom meeting on Thursday, according to multiple people on the call. Members expressed concern over the uncertainty and confusion surrounding the process and discussed potential legal avenues for fighting the ruling.<\/p>\n<p>Two seemed to gain the most traction: The state attorney general could offer a legal opinion stipulating that New York\u2019s primary must be held as scheduled in June, ensuring the current maps would stand\u2026<\/p>\n<p>\u201cThat\u2019s the law,\u201d [Rep. Sean Patrick] Maloney told reporters Thursday afternoon, citing the state\u2019s scheduled primary date of June 28. \u201cSomeone else is going to have to change that federal court order. It\u2019s in effect right now, and the state is bound by it.\u201d<\/p>\n<\/blockquote>\n<p>In a nutshell the Democratic response is: <em>Nothing we can do about those blatantly unconstitutional maps now. We\u2019ll just have to use them anyway.<\/em><\/p>\n<p>Retiring GOP Rep. Tom Reed summed it up saying, \u201cThis is the arrogance of Albany that was on display.\u201d It looks like NY Democrats haven\u2019t quite run out of arrogance yet despite the court order telling them it\u2019s over.
