He insisted there continue to be \u201congoing investigative matters\u201d and said that \u201csome criminal statutes are longer than five years.\u201d Judge Christopher Cooper asked for an example, and the Durham prosecutor <a class=\"Link\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1031\">pointed to<\/a> 18 U.S. Code 1031, which relates to major fraud against the U.S. government. DeFilippis specifically mentioned a DARPA contract. <\/p>\n<div class=\"Enhancement\">\n<div class=\"Enhancement-item\"><\/div>\n<\/p><\/div>\n<p>Sussmann was <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/sussmann-wants-durham-filing-about-trump-white-house-snooping-stricken-from-record\">indicted<\/a><\/u> in September for allegedly <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-grand-jury-indicts-lawyer-allegedly-lying-fbi-concealing-ties-clinton-campaign\">concealing<\/a><\/u> his clients \u2014 Clinton&#8217;s 2016 presidential campaign and former Neustar executive <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/tech-exec-1-says-he-will-plead-the-fifth-in-durham-case\">Joffe<\/a><\/u> \u2014 from FBI general counsel James Baker in September 2016 when he pushed <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/democratic-lawyer-sussmann-fights-durham-use-of-fbi-expert-testimony-on-alfa-bank-data-accuracy\">since-debunked<\/a><\/u> claims of a secret backchannel between the Trump Organization and Russia\u2019s Alfa-Bank. <\/p>\n<p>Sussmann has pleaded not guilty, and Joffe hasn&#8217;t been charged with anything. <\/p>\n<p>Durham says Sussmann similarly concealed Joffe as his client when he pushed further Trump-Russia <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/democratic-lawyer-sussmann-fights-durham-use-of-fbi-expert-testimony-on-alfa-bank-data-accuracy\">collusion claims<\/a><\/u> to the CIA in February 2017. <\/p>\n<p>The special counsel\u2019s filings reference Georgia Tech&#8217;s &#8220;Agency-1 [DARPA] Contract.&#8221; Durham\u2019s <u><a class=\"Link\" href=\"https:\/\/www.justice.gov\/sco\/press-release\/file\/1433511\/download\">indictment<\/a><\/u> of Sussmann stated that if the FBI had been told the <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-limited-in-presenting-evidence-that-collusion-claims-were-untrue-judge-says\">true origins<\/a> of the Alfa-Bank claims, it might have learned Joffe \u201chad enlisted, and was continuing to enlist, the assistance of researchers at a U.S.-based university who were receiving and analyzing Internet data in connection with a pending federal government cybersecurity research contract&#8221; through DARPA. <\/p>\n<p>Joffe and Sussmann <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-focuses-on-russian-yotaphones-clinton-campaign-lawyer-linked-to-trump\">linked<\/a> Trump to Russian-made YotaPhones near the White House and elsewhere. The special counsel has rejected these allegations and said the CIA did too. <\/p>\n<p>Durham <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-argues-sussmann-lie-fbi-mattered-as-he-pushed-collusion-claims\">revealed<\/a><\/u> this year he has evidence that Joffe <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-adds-to-spygates-chapter-on-trump-transition\">\u201cexploited\u201d<\/a> domain name system internet traffic at Trump Tower, Trump\u2019s Central Park West apartment building, and the Executive Office of the President. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/judge-wont-let-clinton-collusion-tweet-be-admitted-in-sussmann-trial\">JUDGE WON&#8217;T LET CLINTON COLLUSION TWEET BE ADMITTED IN SUSSMANN TRIAL<\/a><\/b> <\/p>\n<p>DeFilippis said Wednesday that although the special counsel&#8217;s team had not charged Joffe with anything, \u201cWe are not able to say that a crime was not committed.\u201d <\/p>\n<p>Sussmann lawyer Sean Berkowitz accused the prosecution on Wednesday of \u201coverreach\u201d by \u201ctelling a witness they could continue to face criminal liability.\u201d He claimed, \u201cThere is no good faith perspective\u201d of criminal liability related to the YotaPhone presentation to the CIA in February 2017. <\/p>\n<p>Berkowitz insisted the \u201ccriminal exposure\u201d for Joffe has \u201cended,\u201d said the tech executive is a \u201ccritical witness\u201d for the Sussmann defense, and asked for the prosecution to explain the situation to the judge privately. <\/p>\n<p>The Durham prosecutor denied making any threats to Joffe, saying \u201cwe\u2019ve been quite measured\u201d and \u201cwe have to be candid.\u201d <\/p>\n<p>Berkowitz insisted the prosecution \u201cshould be able to make a decision about Mr. Joffe committing a crime\u201d and called it a \u201ctactical decision\u201d by the prosecution to prevent Joffe from testifying. <\/p>\n<p>The judge said he was \u201cnot sure\u201d how he would rule and that \u201cI\u2019ll take it under advisement.\u201d <\/p>\n<p>A spokesperson for Joffe <a class=\"Link\" href=\"https:\/\/www.cnn.com\/2022\/04\/27\/politics\/john-durham-criminal-probe-rodney-joffe\/index.html\">told<\/a> CNN the arguments by prosecutors are &#8220;baseless and reckless&#8221; and claimed Durham was promoting an &#8220;unfounded political narrative through false innuendo.\u201d The spokesperson contended that Joffe \u201cdid not defraud or mislead any branch of the U.S. Government.\u201d <\/p>\n<p>The judge separately on Wednesday denied Joffe\u2019s sealed February motion to intervene and to expunge references to \u201cTech Executive-1\u201d in Durham\u2019s filings. <\/p>\n<p>Cooper said Joffe\u2019s February motion lamented that the media identified him within days of the September indictment of Sussmann and that \u201cJoffe asserts that the Special Counsel\u2019s inclusion of the allegations against him violates his Fifth Amendment rights by publicly implicating Joffe in wrongdoing without affording him a forum for vindication.\u201d <\/p>\n<p>\u201cThe government did not refer to Joffe by name, nor did it include the names of his companies or associates,\u201d Cooper wrote. \u201cAnd, as the Special Counsel points out, the Indictment does not accuse Joffe of criminal wrongdoing or identify him as an uncharged co-conspirator. Indeed, no conspiracy is charged in the Indictment.\u201d <\/p>\n<p>Sussmann\u2019s lawyers are furious about Durham\u2019s focus on Joffe. <\/p>\n<p>\u201cThe Special Counsel has made Rodney Joffe a cornerstone of its case against Mr. Sussmann,\u201d Sussmann&#8217;s lawyers said in early April, adding that Joffe could offer \u201ccritical exculpatory testimony\u201d but that Durham is \u201cmaking it impossible.\u201d <\/p>\n<p>They argued the judge should dismiss the false statements charge against Sussmann if Durham won\u2019t grant Joffe immunity. <\/p>\n<p>Durham\u2019s team wrote this month that \u201cevidence at trial will show\u201d that beginning in July 2016, Sussmann, Joffe, and agents of the Clinton campaign were \u201cacting in concert toward a common goal\u201d of \u201cassembling and disseminating the Russian Bank-1 allegations and other derogatory information about Trump and his associates to the media and the U.S. government.\u201d <\/p>\n<p>Shortly after Clinton\u2019s loss to Donald Trump in November 2016, Joffe said in an email, &#8220;I was tentatively offered the top [cybersecurity] job by the Democrats when it looked like they&#8217;d win.&#8221; <\/p>\n<p>The special counsel <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-argues-sussmann-lie-fbi-mattered-as-he-pushed-collusion-claims\">says<\/a><\/u> Joffe also tasked researchers with mining internet data to establish \u201can inference\u201d and \u201cnarrative\u201d tying Trump to Russia.
