We know what\u2019s going to happen when the rule goes into effect in May 2022: wave upon wave of illegal aliens claiming \u2018asylum.\u2019 It\u2019s true that our immigration system is extremely backlogged. But the answer is to secure the border, not overwhelm it even more by enacting cheap, easy incentives for illegal aliens to get into the United States,\u201d he added.<\/p>\n<p>The <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/executive-management\/Texas%20v.%20Biden%20(Asylum%20Rule%20Complaint)%20(as-filed%2004.28.2022).pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> aims to stop a Department of Homeland Security (DHS) policy that would change the processing system for immigrants who claim fear of persecution in their home nation. The rule change would move the handling of the cases from immigration judges to asylum officers.<\/p>\n<p>The current rule change is set to go into effect on May 29.<\/p>\n<p>The planned transfer of power would lead to an upending of the current system of dealing with asylum cases at the border, according to the complaint.<\/p>\n<p>\u201cThe Interim Rule transfers significant authority from immigration judges to asylum officers, grants those asylum officers significant additional authority, limits immigration-judge review to denials of applications, and upends the entire adjudicatory system to the benefit of aliens,\u201d the lawsuit states.<\/p>\n<p>Paxton also took to Twitter to criticize the Biden administration\u2019s latest border policy change.<\/p>\n<p>\u201cThe last thing TX needs is Biden to make it easy for aliens to break into USA through false claims. We know what\u2019ll happen when the rule goes into effect: new waves of illegals claiming \u2018asylum.\u2019 I\u2019m suing to stop it,\u201d he <a href=\"https:\/\/twitter.com\/KenPaxtonTX\/status\/1519666303245721608\" target=\"_blank\" rel=\"noopener\">tweeted<\/a> on Thursday.<\/p>\n<p>Last week, Paxton led a legal challenge that included the attorneys general of 21 Republican-led states in an effort to block the Biden administration from ending Title 42.<\/p>\n<p>\u201cThe Biden Administration has made one disastrous border decision after another, and I\u2019ve sued him at every turn,\u201d Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/ag-paxton-brings-10th-border-crisis-lawsuit-against-biden-administration\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cBut his new plan to rescind Title 42 is the most consequential yet. Without Title 42, hundreds of thousands more illegal aliens will flood Texas every month\u2014even more than have been pouring over in the past year.\u201d<\/p>\n<p>On Wednesday, a federal judge <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/04\/27\/federal-judge-blocks-title-42\/9560729002\/\" target=\"_blank\" rel=\"noopener\">temporarily blocked<\/a> the end of Title 42 before May 23.
