To receive new posts and support my work, consider becoming a free or paid subscriber.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p>Additionally, Durham casts doubt on the declaration of Marc Elias that Fusion GPS was retained to provide \u201clegal advice.\u201d Here he makes a key point: <\/p>\n<blockquote>\n<p>\u201dif rendering such advice was truly the intended purpose of Fusion GPS\u2019s retention, one would also expect the investigative firm to seek permission and\/or guidance from [Hillary for America] or its counsel before sharing such derogatory materials with the media or otherwise placing them into the public domain.\u201d<\/p>\n<\/blockquote>\n<p>In support of that point, Durham states he is in possession of \u201c<em><strong>hundreds<\/strong><\/em><strong> of emails<\/strong> in which Fusion GPS employees shared raw, unverified, and uncorroborated information \u2013 including their own draft research and work product \u2013 with reporters.\u201d (He even filed them under seal with the court.) These include:<\/p>\n<ul>\n<li>\n<p>Emails with Slate\u2019s Franklin Foer from May 14, 2016 in which Fusion GPS conveys information on a Trump advisor and Alfa Bank.<\/p>\n<\/li>\n<li>\n<p>July 26, 2016 e-mails from Fusion GPS to the Wall Street Journal communicating allegations from Christopher Steele stating \u201ca Trump advisor meeting with a former KGB official close to Putin \u2026 would be huge news.\u201d<\/p>\n<\/li>\n<li>\n<p>July 29 and July 31, 2016 emails with a reporter (Washington Post\u2019s Tom Hamburger) concerning Carter Page\u2019s investments and meetings with Russians &#8211; of which the reporter said \u201cIts <em>bullshit<\/em>.\u201d<\/p>\n<\/li>\n<\/ul>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fac36e155-12af-49b5-af4c-7b1799168cdc_907x719.png\"><source type=\"image\/webp\" \/><img src width=\"907\" height=\"719\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<ul>\n<li>\n<p>July 27, 2016 e-mails between an ABC News reporter (Matthew Mosk) and Fusion GPS concerning Sergei Millian. Fusion GPS responded with a \u201ccomprehensive report\u201d regarding Millian.<\/p>\n<\/li>\n<li>\n<p>Fusion GPS communications with NY Times reporters pushing more dirt on Millian.<\/p>\n<\/li>\n<li>\n<p>This e-mail from a Fusion GPS co-founder to the New York Times &#8211; dated October 31, 2016 &#8211; pushing the Alfa Bank allegations and stating the US Government is investigating.<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fa3613604-2a26-4864-a5d3-a6424675044d_708x332.png\"><source type=\"image\/webp\" \/><img src width=\"708\" height=\"332\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<\/li>\n<\/ul>\n<p>Here are e-mails between Franklin Foer and Fusion GPS, in which they discuss going after Carter Page in May 2016.<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F8cf4716e-f233-46ae-9582-a05b3daac303_1030x530.png\"><source type=\"image\/webp\" \/><img src width=\"1030\" height=\"530\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>Fusion GPS and Franklin Foer (then-working with Slate, and now with The Atlantic) e-mails &#8211; in which Fusion GPS alleges Millian is \u201cclearly KGB.\u201d Take a close look at Foer\u2019s interactions with Fusion GPS. This is the press you <em>don\u2019t see<\/em>: groveling to opposition researchers, begging for their assistance with \u201comissions and errors,\u201d and pleading that his draft not be distributed to the competition. In other words, entirely consistent with the journalistic standards of Slate. <\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F428a7d30-1c9b-4937-b1a8-545ea58c7abc_984x566.png\"><source type=\"image\/webp\" \/><img src width=\"984\" height=\"566\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>And here is Fusion GPS telling a WSJ reporter to call Adam Schiff or Diane Feinstein about Carter Page. This is solid evidence that Fusion GPS, by July 26, 2016, had briefed Schiff and Feinstein (and their staffers &#8211; including Daniel Jones, a person of interest in the Durham investigation) about their Trump\/Russia \u201cresearch.\u201d<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F835bf485-e99d-48a3-8065-5ea3c69c53c4_1058x384.png\"><source type=\"image\/webp\" \/><img src width=\"1058\" height=\"384\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>As Durham makes clear, no lawyers are copied in these e-mails and this doesn\u2019t have anything to do with legal advice. And even if there were some type of privilege or work product, it was waived when Fusion GPS distributed the info to the press. <\/p>\n<p>There are a number of other important observations. The Fusion GPS witness who will testify is the \u201ctech maven\u201d referenced in their e-mails with the New York Times. This appears to be confirmation that Laura Seago will be the Fusion GPS employee to testify.<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fe453a297-ce46-4c97-8565-c5444d66f2e8_673x246.png\"><source type=\"image\/webp\" \/><img src width=\"673\" height=\"246\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>Here\u2019s more on the Fusion Witness and her knowledge of what went down leading up to the 2016 election:<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F132bdc2d-38b1-4ef3-a773-b1c26883d0d9_661x254.png\"><source type=\"image\/webp\" \/><img src width=\"661\" height=\"254\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>Durham also destroys the declarations of John Podesta and Robby Mook on behalf of Hillary for America (<a href=\"https:\/\/technofog.substack.com\/p\/clinton-campaign-fusion-gps-provided?s=w\" rel=\"\">we discussed the declarations here<\/a>), stating Mook has stated Perkins Coie was to handle and oversee \u201cinternational\u201d opposition research. Mook also received \u201cgeneral updates concerning\u201d these findings  though he says he was unaware who had been specifically retained. <\/p>\n<p>As to Joffe\u2019s privilege arguments? They fail because \u201cPerkins Coie hired Fusion GPS to assist <em>HFA and the DNC<\/em>, not [Joffe].\u201d<\/p>\n<p>Today\u2019s filing follows a series of interesting developments disclosed in these last few days. On Friday, April 22, attorneys for Michael Sussmann filed <a href=\"https:\/\/www.scribd.com\/document\/571523540\/93-Def-Reply-to-Gov-Objections-to-Motion-in-Limine\" rel=\"\">this motion<\/a> relating to evidentiary issues. I\u2019ll spare you the long and boring legal arguments (your humble author favors brevity) and get to the good stuff: <strong>the Special Counsel has issued trial subpoenas to the Clinton Campaign and the Democratic National Committee.<\/strong><\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fcabf6154-8c6f-4a10-9cd1-46876a3adb8f_747x233.png\"><source type=\"image\/webp\" \/><img src width=\"747\" height=\"233\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>The reason for calling the Clinton Campaign and DNC as trial witnesses is to get them to testify to their assertion of attorney-client privilege under oath. As you might recall, the Clinton Campaign, the DNC, Fusion GPS, Perkins Coie, and Rodney Joffe have all made appearances in this case in order to fight against the production of records to Durham. <a href=\"https:\/\/technofog.substack.com\/p\/clinton-campaign-fusion-gps-provided?s=w\" rel=\"\">We reported on that story here<\/a>, stating Durham requested the court require production of records that included \u201cemails and attachments between and among\u201d Perkins Coie, Rodney Joffe, and Fusion GPS.\u201d<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" rel=\"nofollow noopener\" href=\"https:\/\/cdn.substack.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fcbdc8826-e845-4172-bc96-aa2caf7535bb_624x196.png\"><source type=\"image\/webp\" \/><img src width=\"624\" height=\"196\" data-attrs=\"{\" \/><\/a><\/figure>\n<\/div>\n<p>On behalf of the Clinton Campaign, Robby Mook (Hillary\u2019s campaign manager) and John Podesta (the Clinton Campaign chair, <a href=\"https:\/\/technofog.substack.com\/p\/special-counsel-john-durham-continues?s=w\" rel=\"\">who has already been interviewed by Durham<\/a>) submitted declarations in support of the position that Fusion GPS was assisting with \u201clegal services and legal advice to [Hillary for America].\u201d<\/p>\n<p>One would rightly assume, then, that those trial subpoenas were issued to Robby Mook and John Podesta.<\/p>\n<p>Last Friday also saw <a href=\"https:\/\/www.scribd.com\/document\/571524943\/94-Gov-Reply-Re-Parties-Motion-in-Limine-and-Rule-404b-Objections\" rel=\"\">this filing<\/a> by Special Counsel Durham which also addressed evidentiary issues. It explained a \u201cjoint venture\u201d starting in June 2016 by Rodney Joffe and his team of researchers to collect derogatory information on Trump and his associates. Durham described the goal of the joint venture to be: \u201cto gather and disseminate derogatory non-public information regarding the internet activities of [Trump] and his associates.<\/p>\n<p>This \u201cjoint venture\u201d \u2013 what is also called a <em>conspiracy<\/em> \u2013 continued into August 2016, where:<\/p>\n<blockquote>\n<p>Sussmann, Rodney Joffe, and \u201cagents of the Clinton Campaign\u201d met at the Perkins Coie office of Mark Elias where they discussed the same Alfa Bank allegations that Sussmann would give to the FBI. \u201cThe evidence will show that at the meeting, the parties agreed to conduct work in the hope that it would benefit the Clinton Campaign, namely, gathering and disseminating purportedly derogatory data regarding Trump and his associates\u2019 internet activities.\u201d<\/p>\n<\/blockquote>\n<p>In furtherance of this scheme, Durham states the evidence (much of which is already public) will show:<\/p>\n<ul>\n<li>\n<p>An August 12, 2016 meeting with a co-founder of Fusion GPS (Steele or Fritsch) with Sussmann, Elias, and Rodney Joffe. This meeting was billed to the Clinton Campaign.<\/p>\n<\/li>\n<li>\n<p>Joffe enlisted the CEO of an internet company to \u201cmine and analyze vast amount of Internet traffic for <em>any<\/em> derogatory information he and his employees could find about Trump and his associates\u2019 internet connections and online communications.\u201d This included those already targeted by Fusion GPS.<\/p>\n<\/li>\n<li>\n<p>Joffe\u2019s coordination with his team of researchers (including those at Georgia Tech \u2013 one of whom has immunity) to compile what is now known as the Alfa Bank hoax.<\/p>\n<\/li>\n<li>\n<p>Joffe\u2019s continued meetings with Fusion GPS and Perkins Coie, in which he made clear his desire to make sure the \u201cVIPs\u201d at Perkins Coie and the Clinton Campaign would be \u201chappy\u201d with the project.<\/p>\n<\/li>\n<\/ul>\n<p><strong>One final observation: DARPA and confidential data.<\/strong><\/p>\n<p>The Sussmann indictment mentions \u201cnon-public Internet data\u201d that was exploited by Joffe, et al, for the purposes of their political hit-job. This information was provided to Georgia Tech as part of a prospective contract with DARPA to \u201cidentify the perpetrators of malicious cyber-attacks and protect U.S. national security.\u201d (<a href=\"https:\/\/technofog.substack.com\/p\/why-the-sussmann-indictment-matters?s=w\" rel=\"\">More details here<\/a>.)
