Monaco\u2019s alleged use of a \u201cpseudonymous email account\u201d may be breaking \u201cclearly applicable laws,\u201d a lawyer responsible for uncovering Obama EPA Administrator Lisa Jackson\u2019s false identity told the Daily Caller on Monday.<\/p>\n<p>Monaco, <a href=\"https:\/\/www.wsj.com\/articles\/lisa-monaco-is-confirmed-by-senate-as-deputy-attorney-general-11618957906\">confirmed<\/a> by the Senate in April 2021 with bipartisan support, holds the Justice Department\u2019s (DOJ) number two gig and in part focuses on the DOJ\u2019s Jan. 6 riot investigation.<\/p>\n<p>Buried in an early-Monday morning New York Times <a href=\"https:\/\/www.nytimes.com\/2022\/04\/25\/us\/politics\/merrick-garland-attorney-general.html#:~:text=Exceedingly%20wary%20about%20cybercrime%2C%20she%20used%20a%20pseudonymous%20email%20address.\" target=\"_blank\" rel=\"noopener noreferrer\">article<\/a> about Attorney General Merrick B. Garland was a revelation about how Monaco conducted business \u2013 and Washington, D.C., lawyer Chris Horner says it raises questions similar to those asked when <a href=\"https:\/\/dailycaller.com\/2012\/11\/12\/epa-chiefs-secret-alias-email-account-revealed\/\">he learned<\/a> Jackson used \u201calias\u201d email accounts.<\/p>\n<p>From the NYT:<\/p>\n<blockquote>\n<p>Ms. Monaco\u2019s office overcame hiccups, too. It did not play its traditional management role under its predecessor, and she had to ease information bottlenecks. Exceedingly wary about cybercrime, she used a pseudonymous email address. That precaution, normally taken by attorneys general, gave those outside her staff the impression that she was difficult to reach.<\/p>\n<\/blockquote>\n<p>Horner, in an emailed statement to the Caller, argued that Monaco\u2019s alleged\u00a0use of \u201ca pseudonymous email account is a terribly\u00a0poor exercise of judgment for a government official.\u201d Horner specializes in open records matters and, in addition to Jackson\u2019s false identity, <a href=\"https:\/\/www.politico.com\/story\/2013\/06\/chris-horner-foia-epa-white-house-093264\">uncovered<\/a> other chicanery within the Obama administration.<\/p>\n<p>\u201cFor a DoJ lawyer, well, it doesn\u2019t get better,\u201d Horner said.<\/p>\n<p>Horner noted that Jackson\u2019s \u201calias\u201d email accounts ran \u201cafoul of the Federal Records Act,\u201d which requires \u201cthat all parties to correspondence be identified.\u201d He suggested Monaco\u2019s alleged use of a pseudonymous email account could pose <a href=\"https:\/\/dailycaller.com\/2012\/11\/20\/secret-alias-account-was-available-on-epa-chief-lisa-jacksons-computers\/\">similar<\/a> problems.<\/p>\n<p>\u201cA pseudonymous\u00a0email account by a government official \u2014 let\u2019s say, \u2018Richard Windsor\u2019\u00a0when your\u00a0name and position are \u2018EPA Administrator Lisa Jackson\u2019 \u2014 runs afoul of the Federal Records Act requirement that all parties to correspondence be identified,\u201d Horner said, citing one of <a href=\"https:\/\/dailycaller.com\/2012\/11\/19\/epa-admins-alleged-secret-email-account-found-in-previously-released-emails\/\">Jackson\u2019s<\/a> aliases. \u201cOf course, a pseudonym\u00a0doesn\u2019t merely obscure one\u2019s identity, like a bcc: would. It goes further by affirmatively misstating the identity of the party. The DOJ did not respond to inquires from the Daily Caller by press time. <strong><a href=\"https:\/\/dailycaller.com\/2016\/09\/25\/heres-a-list-of-obama-admin-officials-who-used-alternate-e-mails-to-conduct-government-business\/\">(RELATED:\u00a0Here\u2019s A List Of Obama Admin Officials Who Used Alternate E-Mails To Conduct Government Business)<\/a><\/strong><\/p>\n<p>Horner noted that there are several ways to use a pseudonymous email account, though he added that \u201cone should not\u201d do so in the first place. These examples, according to Horner, would serve as \u201chalfway-corrective\u201d measures.<\/p>\n<p>\u201cSo the first halfway-corrective measure \u2026 is to bcc: your actual official\u00a0email account on all such outgoing correspondence\u00a0and forward to your official email account all incoming correspondence. I suggest the likelihood of this being done by anyone creating a false-identity account is very, very low. But who knows we may have a first time here,\u201d Horner speculated before highlighting how this would aid in \u201cboth FOIA and FRA compliance.\u201d<\/p>\n<p>\u201cRe FOIA: Was there a Post-it note on the wall of the DoJ FOIA office, or possibly even a memo, explaining that certain officials are using the following false identities, for when FOIA requests for their correspondence come in, so as to not merely search the official account? If not, it is reasonable to conclude that a senior official engineered numerous violations of not one but two federal statutes,\u201d Horner continued.<\/p>\n<p>Horner also said the use of a pseudonymous email account could raise concerns with \u201ccongressional oversight,\u201d as well.
