The state\u2019s highest criminal court put a halt to those plans and ordered a trial court to review new evidence.\u00a0<\/span><\/p>\n<p><span>\u201cState\u2019s highest criminal court halts, with 2 days to spare, execution of Melissa Lucio, orders trial court to review new evidence that supporters say establishes her innocence,\u201d Austin American-Statesman reporter Chuck Lindell said on Monday.\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: State&#8217;s highest criminal court halts, with 2 days to spare, execution of Melissa Lucio, orders trial court to review new evidence that supporters say establishes her innocence.<br \/>&#8220;I thank God for my life,&#8221; Lucio says in statement issued by her lawyers. <a href=\"https:\/\/t.co\/IPr8EJ8slt\">pic.twitter.com\/IPr8EJ8slt<\/a><\/p>\n<p>\u2014 Chuck Lindell (@chucklindell) <a href=\"https:\/\/twitter.com\/chucklindell\/status\/1518650753610661889?ref_src=twsrc%5Etfw\">April 25, 2022<\/a><\/p>\n<\/blockquote>\n<p><span>In a statement after the criminal court\u2019s decision, Lucio said she thanks God \u201cfor her life,\u201d writing, \u201cI have always trusted in Him. I am grateful the Court has given me a chance to live and prove my innocence.\u201d<\/span><\/p>\n<p><span>The new evidence the Texas court wants the lower court to examine suggests her daughter\u2019s injuries could have come<\/span><span> \u201cas a result of a fall down a staircase, including a blow to the head,\u201d Fox News <\/span><a href=\"https:\/\/www.foxnews.com\/us\/melissa-lucio-execution-what-to-know\"><span>reported<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><span>Even though Lucio confessed to killing her child, her lawyers believe it was \u201can unreliable and coerced confession,\u201d and jurors were led to a wrong conclusion based on \u201cunscientific and false evidence.\u201d<\/span><\/p>\n<p><span>Prosecutors say the new evidence does not clear Lucio, maintaining she abused her daughter and ultimately killed her. According to autopsy reports, Mariah died after suffering head trauma, bruising, and a neglected broken arm that could only have been caused by abuse.<\/span><\/p>\n<p><span>Lucio also has a history of drug abuse and lost custody of some of her children at times, prosecutors noted.\u00a0<\/span><\/p>\n<p><span>Lucio\u2019s attorneys and supporters say Mariah died from an accidental fall down the stairs. \u201c<\/span><span>She and several family members maintain that Mariah\u2019s death was a tragic accident precipitated by injuries the young girl sustained two days prior to her death when she fell down a rickety flight of stairs outside their run-down apartment,\u201d the Houston Chronicle <\/span><a href=\"https:\/\/www.houstonchronicle.com\/news\/houston-texas\/texas\/article\/Melissa-Lucio-gets-stay-of-execution-2-days-17124605.php\"><span>reported<\/span><\/a><span>.<\/span><\/p>\n<p><span>Nearly half of the <\/span><a href=\"https:\/\/www.statesman.com\/story\/news\/2022\/04\/25\/melissa-lucio-death-row-texas-daughter-death-case\/7439186001\/\"><span>jurors<\/span><\/a><span> who sentenced Lucio to death 14 years ago have also come out to request her execution be stopped.\u00a0<\/span><\/p>\n<p><span>Lucio\u2019s defense has accused <\/span><span>Armando Villalobos, <\/span><span>the prosecuting attorney at the time of her conviction, of using the case to boost his political clout and help him win re-election. Villalobos was convicted of a bribery scheme and sentenced to 13 years in prison in 2014 for \u201coffering favorable prosecutorial decisions,\u201d per the <\/span><a href=\"https:\/\/apnews.com\/article\/melissa-lucio-texas-execution-what-we-know-898a415a539fee4e668332bb04993da2\"><span>Associated Press<\/span><\/a><span>. The case was unrelated.\u00a0<\/span><\/p>\n<p>The new evidence can now be reviewed by a lower court that will look into Lucio\u2019s claim that the findings clear her of murder.<\/p>\n<p><span>\u201cMariah is in my heart today,\u201d Lucio said after her execution was halted. \u201cI am grateful to have more days to be a mother to my children and a grandmother to my grandchildren. I will use my time to help bring them to Christ.
