It should not have been a court issue.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/media\/fauci-wants-courts-defer-public-health-experts-public-health\" target=\"_blank\" rel=\"noopener\"><strong>FAUCI WANTS COURTS TO DEFER TO PUBLIC HEALTH EXPERTS FOR \u2018PUBLIC HEALTH DECISIONS\u2019<\/strong><\/a><\/p>\n<p>He also told Fox News\u2019 Neil Cavuto that it\u2019s a &#8220;bad precedent when decisions about public health issues are made by people, be they judges or what have you, that don\u2019t have experience or expertise in public health.&#8221;\u00a0<\/p>\n<p>Fox News reached out to the White House and Fauci for comment.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/world\/covid-cases-beijing-officials-suspend-classes-mass-testing\" target=\"_blank\" rel=\"noopener\"><strong>COVID CASES IN BEIJING LEAD OFFICIALS TO SUSPEND CLASSES, CONDUCT MASS TESTING<\/strong><\/a><\/p>\n<p>Jha reiterated that he believes that such decisions should &#8220;follow the science,&#8221; but acknowledged the role the judiciary plays. The Centers for Disease Control (CDC) and the White House <a href=\"https:\/\/www.foxnews.com\/health\/justice-department-appeal-ruling-striking-down-travel-mask-mandate\" target=\"_blank\" rel=\"noopener\">both turned immediately<\/a> to the DOJ to appeal the decision, indicating that the courts will play a role in dictating public health policy.\u00a0<\/p>\n<p>Jha indicated that the judiciary\u2019s role relies on the fact that it is a co-equal branch of government.\u00a0<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/media\/fauci-crushed-saying-disturbing-that-u-s-court-can-overrule-cdc\" target=\"_blank\" rel=\"noopener\"><strong>FAUCI CRUSHED FOR SAYING IT&#8217;S \u2018DISTURBING\u2019 THAT A U.S. COURT CNA OVERRULE THE CDC<\/strong><\/a><\/p>\n<p>The decision to repeal the mask mandate occurs at the same time as the nation recorded a 50% increase in cases over the past two weeks.\u00a0<\/p>\n<p>But Jha noted that due to the high level of vaccination and the availability of therapeutic treatments, numbers like this mean something different this year than they would have a year ago.\u00a0<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/apps-products\" target=\"_blank\" rel=\"noopener\"><strong><u>CLICK HERE TO GET THE FOX NEWS APP<\/u><\/strong><\/a><\/p>\n<p>&#8220;We&#8217;re in a much better place and we have been throughout much of this pandemic, right?&#8221; he said. &#8220;More than 200 million Americans vaccinated.
