However, Durham is continuing his legal pressure as he insists those groups played a coordinated role in pushing <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/durham-focuses-on-russian-yotaphones-clinton-campaign-lawyer-linked-to-trump\">false<\/a> Trump-Russia <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/sussmann-doesnt-want-clinton-tweet-touting-collusion-claims-to-be-admissible\">collusion claims<\/a>.<\/p>\n<div class=\"Enhancement\">\n<div class=\"Enhancement-item\"><\/div>\n<\/div>\n<p>Fusion \u201cwas not primarily providing or supporting expertise relating to legal advice; instead, it appears that the investigative firm\u2019s primary, if not sole, function was to generate opposition research materials that the firm then shared widely,\u201d Durham <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/democratic-lawyer-protests-durham-case-jurors-being-asked-about-links-to-clinton-promotion-of-collusion-narrative\">said<\/a><\/u> this month.<\/p>\n<p>\u201cMeeting to agree on the express goal of a joint venture is precisely what happened here, on more than one occasion,\u201d the special counsel said early Saturday morning.<\/p>\n<p><u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/tech-exec-1-says-he-will-plead-the-fifth-in-durham-case\">\u201cTech Executive-1\u201d<\/a><\/u> Rodney Joffe, \u201cOriginator-1\u201d April Lorenzen of the information services firm Zetalytics, and other researchers began to discuss \u201csearching for and collecting derogatory internet data about the online activities of Donald Trump and his associates\u201c in June 2016, Durham said, adding Lorenzen \u201cassembled and shared initial purported data\u201d with Joffe, \u201cwho, in turn, shared the data\u201c with Sussmann.<\/p>\n<p>\u201cThe joint venture continued and crystallized early in August 2016,\u201d when Sussmann, Joffe, and \u201cagents of the Clinton Campaign\u201d met, Durham said, pointing to an Aug. 12, 2016, meeting where Sussmann, Joffe, Elias, and the co-founder of Fusion met in Elias\u2019s office to discuss \u201cthe same Russian Bank-1 allegations that the defendant would later bring to the FBI.\u201d<\/p>\n<p>\u201cThe parties agreed to conduct work in the hope that it would benefit the Clinton Campaign, namely, gathering and disseminating purportedly derogatory data regarding Trump and his associates\u2019 internet activities,\u201d Durham wrote. \u201cThe evidence will show that as a result of these conversations and during this same time period, Tech Executive-1 did exactly that: he tasked employees from multiple Internet companies and a university working under a pending national security contract to mine and gather vast amounts of internet metadata in order to support an \u2018inference\u2019 and \u2018narrative\u2019 tying the candidate to Russia.\u201d<\/p>\n<p>Joffe continued the joint venture via an Aug. 17, 2016, call with Sussmann and Elias, an Aug. 19, 2016, meeting with Sussmann and Elias, and a Sept. 8, 2016, call and meeting with Sussmann, \u201call of which the defendant billed to the Clinton Campaign,\u201d according to calendars reviewed by Durham.<\/p>\n<p>Joffe also asked the CEO of an internet company to \u201cmine and analyze vast amount of Internet traffic for any derogatory information he and his employees could find about Trump and his associates\u2019 internet connections and online communications\u201d and \u201csent the CEO a list (the \u2018Trump Associates List\u2019) containing email addresses, IP addresses, physical addresses, and other information of several Trump associates\u201d while multiple people on the list were being researched by Fusion, Durham said.<\/p>\n<p>The tech executive \u201cexploited sensitive internet data that researchers were provided to guard against cybersecurity threats\u201d but which he \u201cinstead directed them to mine for political purposes,\u201d the special counsel said. As Joffe continued to meet and communicate with Perkins and Fusion, he made clear his desire to ensure that the \u201cVIPs\u201d (Perkins and the Clinton campaign) would be \u201chappy\u201d with what was unearthed, Durham alleged.<\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/sussmann-doesnt-want-clinton-tweet-touting-collusion-claims-to-be-admissible\">SUSSMANN DOESN&#8217;T WANT CLINTON TWEET TOUTING COLLUSION CLAIMS TO BE ADMISSIBLE<\/a><\/b><\/p>\n<p>Sussmann\u2019s attorneys said they learned Durham had issued the trial subpoenas Tuesday and that the special counsel is \u201crequesting the testimony of witnesses regarding the assertion of attorney-client privilege in front of the jury.\u201d The Clinton campaign and the DNC advised Sussmann they wanted to fight \u201dthis plainly impermissible testimony,\u201d Sussmann\u2019s lawyers said.<\/p>\n<p>\u201cThe Special Counsel this week took the astonishing and legally inappropriate step of subpoenaing witnesses for the express purpose of having them testify to the invocation of the attorney-client privilege in front of the jury,\u201d Sussmann\u2019s lawyers contended in a Friday filing.<\/p>\n<p>Hillary for America also tried to intervene Tuesday, saying it was \u201casserting attorney-client privilege and work protection&#8221; related to Perkins and Fusion. The filing included declarations from Clinton campaign Chairman John Podesta, Clinton campaign manager Robbie Mook, and Elias.<\/p>\n<p>\u201cThe Special Counsel continues to overreach: he seeks to admit evidence that the law squarely forbids, he seeks to prove unduly prejudicial allegations he has not charged, and he seeks to prove conduct that is utterly irrelevant to the one discrete crime he has charged,\u201d Sussmann\u2019s lawyers argued Friday night.<\/p>\n<p>Durham also \u201cseeks to prevent Mr. Sussmann from introducing relevant \u2014 indeed essential \u2014 exculpatory evidence in the form of testimony from his former client, Rodney Joffe,\u201d Sussmann\u2019s lawyers said Friday.<\/p>\n<p>Durham pushed back Saturday.<\/p>\n<p>\u201cThe goal of the joint venture could not have been more clear: it was to gather and disseminate derogatory non-public information regarding the internet activities of a political candidate and his associates,\u201d he wrote.<\/p>\n<p>\u201cAnd that venture was far from collateral to the charged crime. Indeed, the above-described joint venture was the very project that led Tech Executive-1 to rely upon the defendant\u2019s services; the very project that gave rise to the Russian Bank-1 allegations; the very project that prompted agents of the Clinton Campaign to meet with Tech Executive-1; and the very project that caused the defendant to meet with the FBI General Counsel and lie to him about the clients who were behind all of this work,&#8221; Durham said.<\/p>\n<p>Durham has declined to promise that Joffe won\u2019t be indicted at some point in the future, but if Joffe is not granted immunity to testify at trial on Sussmann\u2019s behalf, then the charges should be dismissed, the defense team argued.<\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/b><\/p>\n<p>The special counsel made public his demand for more details on what the Clinton campaign and DNC were asserting attorney-client privilege over earlier this month in the case against Sussmann, who has been indicted on charges of <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-grand-jury-indicts-lawyer-allegedly-lying-fbi-concealing-ties-clinton-campaign\">concealing<\/a><\/u> his clients from FBI general counsel James Baker when he pushed <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/durham-sussmann-put-his-lie-to-the-fbi-in-writing\">since-debunked claims<\/a><\/u> of a secret back channel between the Trump Organization and Russia\u2019s Alfa Bank.<\/p>\n<p>British ex-spy Christopher Steele created his <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/democratic-lawyer-sussmann-doesnt-want-steele-dossier-brought-up-during-durham-trial\">discredited anti-Trump dossier<\/a><\/u> after being hired by Fusion, which was itself hired by Marc Elias, the <u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/steele-dossier-funder-marc-elias-testified-before-john-durhams-grand-jury\">general counsel<\/a><\/u> for Clinton\u2019s campaign.
