By Monday evening, an administration official <a href=\"https:\/\/dailycaller.com\/2022\/04\/18\/joe-biden-administration-public-transportation-masking-order-not-in-effect\/\">conceded<\/a> that masking for public transportation \u201cis not in effect at this time.\u201d The official, however, also noted that \u201cagencies are reviewing the decision and assessing potential next steps,\u201d indicating an appeal was not off the table.<\/p>\n<p>\u201cThe Department of Justice and the Centers for Disease Control and Prevention (CDC) disagree with the district court\u2019s decision and will appeal, subject to CDC\u2019s conclusion that the order remains necessary for public health,\u201d the Department of Justice (DOJ) subsequently announced Tuesday evening.<\/p>\n<p>\u201cIf CDC concludes that a mandatory order remains necessary for the public\u2019s health after that assessment, the Department of Justice will appeal the district court\u2019s decision,\u201d the DOJ statement added.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">New Statement on Mask Mandate Ruling <a href=\"https:\/\/t.co\/SwYHIqTG2e\">pic.twitter.com\/SwYHIqTG2e<\/a><\/p>\n<p>\u2014 Anthony Coley (@AnthonyColeyDOJ) <a href=\"https:\/\/twitter.com\/AnthonyColeyDOJ\/status\/1516541173799788554?ref_src=twsrc%5Etfw\">April 19, 2022<\/a><\/p>\n<\/blockquote>\n<p>While the DOJ noted a caveat to the pending appeal \u2013 it\u2019s subject to the CDC\u2019s recommendation \u201cthat the order remains necessary\u201d \u2013 the CDC has so far kept its recommendation of masking on public transport.<\/p>\n<p>The CDC also\u00a0<a href=\"https:\/\/www.cdc.gov\/media\/releases\/2022\/s0413-mask-order.html\">announced<\/a> on April 13, days before the federal judge\u2019s ruling, that its mask mandate for public transportation would remain in place while it assessed \u201cthe potential impact of the rise of cases on severe disease, including hospitalizations and deaths, and healthcare system capacity.\u201d<\/p>\n<p>The Biden administration\u2019s public transportation masking order was one of the last restrictions remaining from the COVID-19 global pandemic.
