Justice Sonia Sotomayor had also <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-wont-hear-new-york-city-teacher-vaccine-dispute-rcna24850\"><span class=\"s1\">reportedly<\/span><\/a> declined an emergency request that the mandate be paused.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">In <a href=\"https:\/\/www.dailywire.com\/news\/judges-approve-nyc-teacher-vaccine-mandate\">August<\/a>, Democratic Mayor Bill de Blasio and other\u00a0<a href=\"https:\/\/www1.nyc.gov\/office-of-the-mayor\/news\/578-21\/mayor-de-blasio-chancellor-porter-commissioner-chokshi-department-education\"><span class=\"s1\">officials<\/span><\/a>\u00a0\u201cannounced a new health care mandate requiring all New York City Department of Education [(DOE)] employees to provide proof of\u00a0first dose of\u00a0vaccination by\u00a0September\u00a027th.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cKeeping our students and staff healthy is our top priority,\u201d said de Blasio at the time. \u201cTo keep our schools healthy and safe, we are now requiring all Department of Education staff to have at least one dose of the vaccine by September 27. Together, we will create a safe and welcoming school experience for our kids.\u201d<\/p>\n<p class=\"p1\">The four teachers <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-04-18\/fired-nyc-teachers-rejected-by-supreme-court-in-vaccine-case\"><span class=\"s1\">involved<\/span><\/a> in the suit were either terminated from their jobs or put on unpaid leave for declining to get vaccinated.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">In a petition to the high court <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-854\/204179\/20211206133940222_21-%20%20Maniscalco%20v%20NYCDOE%20Petition%20for%20Writ%20of%20Certiorari.pdf\"><span class=\"s1\">filed<\/span><\/a> in December, the petitioners wrote that the \u201cpublic-school teachers, respectfully request the Court identify the right of public-school teachers to practice their profession,\u201d adding that the issues brought up in the petition were of \u201cNational Significance.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cThis case presents the Court with the opportunity to address a critical constitutional issue\u2014 whether public-school teachers have a fundamental right to practice their profession,\u201d they argued. \u201cFurthermore, the Court can provide needed guidance to the lower courts regarding the flood of COVID-19 vaccine mandate-related cases already pending and expected.\u201d<\/p>\n<p class=\"p1\">In an opposition brief <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21-854\/218131\/20220309130144186_ManiscalcoBIO.pdf\"><span class=\"s1\">filed<\/span><\/a> in March, the counsel for the New York City Department of Education claimed \u201cThere is zero evidence in this record indicating that the Department has foreclosed the four petitioners from pursuing their professions.\u201d<\/p>\n<p class=\"p1\">The legal pushback over vaccine mandates appears to continue in the city, as a waitress at Yankee Stadium is suing over Mayor Eric Adams\u2019 (D) vaccine exemption for performers and athletes.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Virginia Alleyne was put on leave without pay after working at\u00a0Legends Suite Club\u00a0for 17 years because she did not get the vaccine. The lawsuit was filed in Manhattan Supreme Court, <a href=\"https:\/\/nypost.com\/2022\/04\/08\/yankee-stadium-waitress-files-lawsuit-against-adams-athlete-vax-exemption\/\"><span class=\"s1\">per the New York Post<\/span><\/a>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">According to the outlet, the court documents stated, \u201cAllowing professional athletes and performing artists to work without a vaccine while terminating [Alleyne] and those similarly situated for not receiving the vaccine is unquestionably arbitrary and capricious.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">\u201cThousands of firemen, policemen, teachers, sanitation workers, restaurant workers and other private sector workers have been fired as a result of this mandate,\u201d the filing noted.<\/p>\n<p class=\"p1\">The Post reported, \u201cThe suit also challenges the claim that Adams\u2019 executive order was implemented to ensure New York sports team wouldn\u2019t be at a disadvantage if their unvaccinated athletes can\u2019t play, while visiting athletes with the same vax status can.\u201d<\/p>\n<p class=\"p1\">The court <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-wont-hear-new-york-city-teacher-vaccine-dispute-rcna24850\">declined<\/a> to hear over 100 cases on Monday and did not provide a reason for the rejection, as is customary.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">On Monday, the Supreme Court also <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-declines-to-review-salt-tax-cap-challenge-from-states\"><span class=\"s1\">refused<\/span><\/a> to review a challenge brought against a tax deduction limit which was implemented by the Trump administration and has continued through the Biden administration.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><i>The Daily Wire is one of America\u2019s fastest growing conservative media companies for breaking news, investigative reporting, sports, podcasts, in-depth analysis, books, and entertainment for a reason: because we believe in what we do.
